DON BRINSON DO NOT DO BUSINESS WITH HIM OR VENIE BRINSON REALTY, EVER!!! MAJOR RIPOFF, LIAR, THIEF, UNCHRISTIAN DON BRINSON

NOTICE OF INTENT TO END LEASE

I am giving 30 days written notice that I will be vacating the Premises at 1802 Drew Street, Clearwater, FL 33765 when my Lease is up on March 1st, 2008. I have many reasons for this,
which I will list below.

1. When shown location at 1802 Drew Street, there was no electricity. I could make out basic shapes due to the full length blinds running across full length of windows at the front and blind that covered the full length of door, but that was it.

2. I had the electricity turned on at 1802 Drew Street and when I tried to open the front deadbolt to get in, my key wouldn't work. After trying to unlock the front deadbolt for 30 minutes and getting blisters on my fingers and thumb, I called Don Brinson and he told me he'd never had a problem with it. This was said in a way as if I was incompetent. I said well I'm having a problem with it and since it works for you then please come open this deadbolt. Don Brinson came down then called me and said he was having the same problem I was having, with the lock. I told him my mother's employee Curt could come and take out the lock, take it to a locksmith and get it rekeyed with new keys made. Don Brinson said no, he'd call a locksmith to come out and do it. 5 weeks went by, I kept asking Don about it, Don Brinson did nothing about the lock.

All this time I had to lock the front deadbolt inside, by hand and leave out the back door with only the back door knob lock, locked. This left my facility unprotected. Finally, Curt came and took the lock to a locksmith, got the problem fixed with new keys. Don Brinson never reimbursed us.

3. When I was having furniture delivered immediately after having Electricity turned on, I was horrified at the state of this rental property. Dead huge roaches were everywhere, The heavy fabric that was called carpeting was frayed, ruined and stained completely beyond repair. There were wires hanging from 2 of the back walls, cracked socket plates completely uncovered outlets, etc. I had my video camera for the video walk through. I documented everything. Horrified, I called Don Brinson in tears.

Anyway, there were open electrical sockets, some had no covers, some had cracked covers. The phone lines were linked with lines next door.I told Don Brinson about the huge roaches, etc. Don said there's nothing wrong with dead roaches. I told Don this situation was very unchristian-like. Don told me he was a FINE UPSTANDING CHRISTIAN and how dare I say otherwise. I never said he was unchristian-like, I said the situation was unchristian-like.

It wasn't until March 18th, 2007 that I could even open the business due to painting, cleaning which came out of my own pocket and time. Don Brinson did agree to put in laminate flooring. Incredibly, my video camera and my entire desktop computer was stolen, when "someone" broke through the wall from Don Brinsons empty space, into mine.

4. On or around June 4th, 2007, Don Brinson called my mothers employee, Curt and said he had been in his vacant rental space immediately adjacent to my space and said someone had broken through the empty space through the wall into my space. I immediately went there. Turned out, the robber had gone in through the vacant space back window that had been left unsecured by the Landlord, Don Brinson. The robber had first tried to break through the wall in my sink area and couldn't however he damaged tiles and left a hole. Next, the robber broke through the wall in another section of my shop. The Thief stole my camcorder and my entire computer system. I asked Don Brinson to put a metal bar across his back vacant space window where the Thief broke in at, so nobody else could come in and steal from me some more. Don Brinson said he'd immediately fix that situation, right after the Police were done taking our statements.

9 days went by, Don Brinson didn't do anything to secure his vacant space window leaving my shop unprotected. NINE days later, I had Curt buy metal, cut the metal, solder the metal so it would fit onto the Landlord Don Brinsons window where the thief came in and had Curt install it. We've never been reimbursed for this. Furthermore, The Landlord never fixed the holes left by the robber. We had to fix the tiles, get drywall, cut it, install it, sand it, paint it. Don Brinson has never compensated us for this.

I talked to Venie (Dons Mother) on January 31, 2007. I told Venie there was a list of things we needed to be compensated for that Don hadn't compensated us for. Venie asked me to direct all questions to Don. I told Venie that was the problem, Don wouldn't address them. I explained a few things such as the deadbolt on the front door, hole in the wall from when the thief broke through the wall and metal bar on their back window that Don said he'd fix but never did. Unbelievably, Venie told me she didn't think they were responsible for problems they didn't fix. So....Just ignore a problem until the Business Owner HAS to fix them herself, then you're off the hook? I don't think so.

5. I have asked the Landlord Don Brinson to clean up the front window of the vacant space next to mine. (The same space the Thief had broken into) It is a HUGE eyesore. All kinds of broken garbage, boxes, doors leaning against walls, broken filthy chairs and a big piece of wood that is stacked up against the window. He hasn't. When my Shop was robbed, I told Don I'd rent that space as well as the space I already had, we agreed upon a price. Don said he'd immediately start getting out all the stored property from that space so I could fix it up. It's been almost 7 months and Don Brinson has done nothing.

6. After learning that my Mothers A/C units at her building at Belcher and Drew had been vandalized for the copper, I told the Landlord that he should cover our units so the same thing wouldn't happen. Again, Don Brinson did nothing. I had Curt buy the metal, cut the metal, solder the metal into a box shape and install the metal box frame over my A/C unit.

7. After having ongoing issues with the A/C, Don got very upset with me on the phone and told me he "Doesn't manage by crisis". As far as I could tell, Don Brinson didn't manage anything at all, crisis or otherwise, unless you call having your rent check delivered to you always on time, as managing at all. It was at this point that Don Brinson started hanging up on me, when I'd call. He'd screamed at me that "I didn't know how to talk to people" Don Brinson hung up on me on 4 different occasions.

8. I received a Violation from the City of Clearwater that my banner with my Business Name on it, needed a sign permit to be legal. I went down to the City, got the sign permit papers and Zoning told me I needed to have (along with the sign permit) a copy of either the survey or a site plan, of the property that lies directly on the northeast corner of Keene Road and Drew Street. I went through all the microfiche on file at the City because I try to do anything and everything possible not to have to call or talk to Don Brinson.

After finding nothing, I called and spoke with Cindy, Don Brinsons wife and asked if they had a copy of either the site plan or the survey for this property so I could complete the sign permit application. Cindy said Don would call me. He didn't. I called again, Cindy said Don said there was no site plan. I asked about a survey. Cindy said I never asked about a survey. I said Ok, can I get a copy of the survey? Cindy said she'd call Don and ask him. Cindy said Don would call me. Don didn't. I called Cindy again and Cindy said Don said there was no survey for the property either. No site plan, no survey. So there was no way I could obtain a sign permit for my business I commercially rent from these people. How can they rent out Commercial space with no legal way for their Tenants to be Legal to advertise their Business Name with a sign or a banner? This makes no sense to me, whatsoever. So the City of Clearwater knew I'd done MY due diligence and said they would give the violation to the Property Owner. Venie brought me in a copy of her Violation, wanting me to pay it.

9. My employee was hand given by Venie Brinson a Citation from the City of Clearwater regarding the hedge that was not even adjacent to my Shop. The Letter from the City stated that the hedge needed to be trimmed by a certain date. Again, why I was given this Citation I have no idea.

10. I faxed my Notice of Intent to Vacate Premises on 1/31/08. On Monday February 4th, Don Brinson calls me, said he got my fax of Notice to Vacate then says Venie wants to know why I haven't paid Februarys Rent. I said I paid first month, last month and Deposit all at once and he needed to check his records. Don said he didn't think I did. I said go check, I know I did and I'm not paying it again. Then Venie calls me a few days later, asking me where Februarys rent is. I told Venie I paid it when I secured the Lease ie first month, last month and Deposit. Venie says well Don didn't say anything about it. I said Venie, you're the one who took my money originally. Again I said, just check your receipt book, it's there.......

I've had several problems with the A/C unit. Also, the electricitys Circuit Breaker was shutting off constantly, every morning I'd have to reset the Circuit Breaker. With the A/C being off all night it was tremendously hot, every morning and would take hours to cool down because of the high ceilings. I have never once been late on my rent. I have improved this rental property greatly. I have been given no compensation for all the work, 3 weeks of not being able to work upon discovering the atrocious conditions of rental space. Several times I've had to clear my entire day of appointments due to the A/C not working properly. There is a PARTY Bus parked directly in back of my back door. The parking is horrendous at 1802 Drew Street yet Don Brinson allows another Tenants PARTY Bus to take away even more of what little parking I have, for my customers.

Even worse, my neighbors in this little strip mall have placed a picnic bench longways so nobody can even pull around TO the back to have a parking space. I have lost an immeasurable amount of income due to the parking issues that Don Brinson never resolved. These landlords are Slumlords. And I will say right now that Don Brinson is ANYTHING but a Christian. Actions speak louder than Don Brinsons lip service. And Don Brinsons actions are the opposite of anything Christian.

Today is February 29th, 2008. I've just gotten off the phone with Don Brinson who told me it will take up to 2 weeks for me to get my security deposit back. I told Don Brinson I needed my security deposit back to put it down on another Lease, elsewhere. Don Brinson said Oh well, that's their "Policy." Don Brinson said I needed to drop off the keys, then they inspect, then they send deposit to me. So amazingly enough, I have to drop off the key that Don Brinson hasn't even compensated me for (not to mention no compensation for me also paying to have the lock rekeyed, my time, etc.)

There is so much more but you get the Jist here.

I will be posting and filing this FULL Report, in its ENTIRETY on Consumer Affairs, BBB, C of C and ripoffreport.com and any and all sites that pertain to Landlord/Tenant issues as well as any and all associates associated with Brinson Realty. Perhaps it would be Christian-like of ME to let other Jehovahs Witnesses know how Christian-like their Don Brinson is. And I will state right now, IF Brinson Realty rents either of the end spaces out to a Business that survives solely on Customer access, and Brinson Realty does not inform said Tenant of Brinson Realty complete and utter lack of at least a modicum of civility or any type of Professional courtesy ie. No site plan, no survey, or how Brinson Realty not only does not comply with the Law but then expects the victim to pay for Brinson Realty Violations, I will gladly assist this/these persons with any type of civil suit as a Witness of my knowledge of the history of this, and how it has affected me personally and professionally.

$481.50 I need to be reimbursed for the 18 days (From March 1, 07 to March 18, 07 that I wasn't able to be open due to frightful conditions of space and numerous City Code Violations at 1802 Drew Street. This figure doesn't include the lost Business I suffered.

$681. 99 Cost of Computer Desktop, Monitor, Keyboard, Mouse stolen due to Brinson vacant space next door back window being unsecured.

$524.00 Cost of Video Camera Stolen due to Brinson vacant space next door back window being unsecured

$375.00 Cost to repair ie patch, sand, paint wall that we repaired where "thief" broke into.

$125.00 Cost to buy, shape and install a metal bar on Landlords vacant space back window where "thief" broke into. The one Don Brinson said he'd take care of immediately and 9 days later after leaving this window unsecured, we did it.

$56.00 Cost to rekey front Deadbolt that Don Brinson said he'd fix. After almost 6 weeks we did it ourselves. We've never been reimbursed for this.

$800.00 Security Deposit

I expect a check in the amount of $3,043.49

This figure does not include all the Business and monetary loss I have incurred for downtime, etc. This can be taken care of now or we can do it in Court later, it's your choice. In Court, I will ask for a much larger figure, because that's what I am owed anyway, a much larger figure.

UPDATE: It's now April 24, 2008, almost 2 months since I left 1802 Drew Street immaculate and moved out and I haven't received any monies, let alone my Deposit back.

I called yesterday on April 23, 2008 to ask what time I could come by to pick up my money, haven't heard anything back yet. But what's new? Maybe Don Brinson thinks I'll just go away but guess what? I'm not. I'm a single mother and this has been devastating for me financially. I couldn't get the desired Location I wanted to move to because Don Brinson said it would take 2 weeks, per policy. Now it's been almost 2 MONTHS.

This is a prime example of someone who claims they are a Christian yet are anything but a Christian, how sad is that? Don Brinson constantly bleats what a fine Christian man he is, what a joke! DON BRINSON FROM VENIE BRINSON REALTY IS A THIEF, DO NOT DO BUSINESS WITH THIS COMPANY OR WITH HIM!
