Verizion Wireless is billing me for $249.87 For services supposedly recieved from them. I had cancelled my service with them 90 days prior to recieving this billing. My usual billing was in the $80. range. The billing is incorrect. I do not owe this. I have denied payment through credit card however under pressure my credit card and banking institution paid this outrageous amount. Verizion has repeatedly denied recieving this payment and has turned the matter over to a collection agency. This false billing is additionally being reported to The State of Tennessee Department of Consumer affairs. It would be my suggestion that you not become involved with this company in any manner.

Termination for Cause

Verizion Wireless failed to correct problems with their service. They were given two months to correct the problem and failed to do so therfor being in default of their contract. I therefore terminated the contract for cause. I offer the following excert from contract law for consideration.

Termination for cause

Termination for cause (also called termination for default (TFD)) is a contract provision that permits a party completely or partially to terminate performance of the contract for material breach or other stated causes.

When there is a "for cause" event, the contract usually requires that the party give the other party notice that adequately identifies the reasons for the alleged "for cause" event, and provides a period of time for the other party to cure the problem(s). Only if that party fails to rectify the problem(s) within the prescribed cure period does the affected party have the right to terminate the agreement.
Sample clause Edit
“     Customer may terminate the whole or any part of this Agreement, by written notice of default to Vendor, in any one of the following circumstances:

    (a) if Vendor fails to perform any duties or obligations within the time specified herein or any written extension thereof granted by Customer;
    (b) if Vendor so fails to make progress as to endanger performance of this Agreement in accordance with its terms;
    (c) if Vendor fails to comply with any of the material terms and conditions of this Agreement. Such termination shall become effective if Vendor does not cure such failure within a period of ten (10) days after written notice of default by Customer;
    (d) If the other party is declared insolvent or bankrupt, or makes an assignment for the benefit of creditors, or a receiver is appointed or any proceeding is demanded by, for or against the other under any provision of the Federal Bankruptcy Act or any amendment thereof.

Upon termination, Customer may procure, upon such terms as it shall deem appropriate, services similar to those so terminated. Vendor shall continue performance of this Agreement to the extent not terminated.

Verizion Wireless Fails to Provide Service as Advertized

Perhaps I fail in my attempt to state completely the reason for my cancellation. The reason was failure on the part of Verizion to provide service under their contract. I put up with their service for a period of time and despite numerous calls to Their Tech Department I was unable to connect to any 800 number. As much as business is now conducted through 800 numbers including banking services I felt that they were in violation of the contract by not providing service as advertised.  Hope this helps you clear up your supposition.

 What YOU are being asked to pay is the ETF. Or Early Termination Fee. If you had ANY time remaining on your two year contract then THIS is what is left to pay. This is all information spelled out in the contract that YOU agreed to and signed. This is NOT a false billing issue its what YOU have left to pay for breaking your contract. But YOU would have known this had YOU actually stopped and READ the paperwork they asked YOU to READ AND SIGN!!!
