Hello, Thursday, November 17, 2010 I complained to my employer about sexual harassment in the work place. The main marketing manager, Juan C., from the beginning of my employment would repeatedly invite me on a ride and make inappropriate comments about me and other females. He would touch my lower back, grab my hand when I handed him documents, touch my face when I let my guard down and didnt expect it, pinch the back of my arm, and grab my waist. He would also use company time, in which he was suppose to train me in door to door marketing, to take me to a Harley Store just to see how I look on a motorcycle; he told me he wouldnt let me go home until I sat on one, since I was on his time. Even after I found the courage to complain, the investigation of the matter by my company, came back in Juan C.s favor. He was part owner of the company, and I hadnt expected anything different since most of the employees were blood related. I was afraid for my safety, because Juan C. is the type of person that will do anything to get out of trouble. He had tried to call me after I complained to the main owner, when the main owner had specifically told him to leave me alone and not make any contact. He also texted me asking I call him, as I had ignored all his calls, even the ones in private. I am afraid of him and I have good reason to be in this situation, being touched improperly by an old man as a child then later as a teen, Juan C. frightens me. Maybe he didnt understand the weight of his actions when he harassed me or he thought I would simply allow the harassment to continue, regardless he knew what he was doing, by laughing every time I flinched away or told him to stop, also insinuating many times to me he has a gun (various stories of how he was shot and the trouble at clubs). Tuesday, March 1, 2011 at 3:32pm, my attorney for this harassment case contacted me because of new found evidence Juan C. had given his attorney. They alleged that I sent Juan C. four text messages which incriminate me, along with two phone calls. Their evidence were pictures of Juan C.s phone with the text messages and clearly on the from area was my number.

First of all, I am having a conversation with myself? Why would I put myself in that position? There were no received messages. I am a criminal justice student, and I am well aware of all my rights. I would never give up my 5th Amendment. The messages read as follows: On December 23, 2010 8:01PM - You0 f***ed up my job so im gonna make you loose your family (I do not text like this... I have a tendency to use 'u' instead of you and 'ur' instead of your) 8:05PM - I new they would belive me and i bloced num (I don't ever spell 'knew' as new. I spell it correctly, as well as for belive and bloced... num i simply use the symbol #) 8:08PM - Im gonna make you lose ur house (Again, i never use 'you') 8:11PM - Hope u lose your job too (I never use 'your' its too many words) Finally, two calls I allegedly made. His images show that they were two missed calls from my number. However, I looked into the bill and only one call was documented at 8:14PM, and it lasted for 2 whole minutes. My attorney had advised me not to have any contact with anyone from my old employment and I followed their advice to a 'T'. I never sent the alleged texts or made the calls, but they had my number in their texts as if I had sent the messages. I told my attorney that I never sent those messages and my bill would show I didnt (in the messages detail). I figured there were thousands of online websites that can send out a message with my number as long as they know my carrier. To my horror the messages were on my message detail as if sent from my phone. Terrified I called Verizon to ask how that could have been done without having my physical phone and they told me there was no way. It was sent with Verizon's phone number. I knew I never sent those messages, but didn't know how to prove my innocence. The messages were sent at 8:01PM - 8:11PM... and only one phone call showed on my bill at 8:14PM (2minutes). No voicemail was reported; and the call came out of the Riverside tower. Thursday, December 23, 2010 at 7:58pm, I checked into the Standard in Downtown LA with my boyfriend to celebrate Christmas early. The last text I sent out before those alleged texts was to my boyfriend at 6:29PM, and my last call before those alleged calls was also to my boyfriend at 7:13PM when I picked him in Whittier, CA to go to the Standard. After stressing about the issue for two days without rest an impossible idea came to me and I called Verizon to ask if anyone had opened my account profile on that day (12/23/2010). To my great relief and horror someone (Eugenia J.)in a third party store (offers contracts for Verizon) had accessed my account that day and made an upgrade to my account. Simply put, my service was removed from my current cell phone and transferred to a dummy phone in the store in which the messages and calls were made. After which my service was reinstated to my phone (no more than 30 minutes after the change). So the activity showed in my bill detail and under my number. They had to have disconnected my phone soon after my last call (to my boyfriend) at 7:13PM and reconnected my phone before 9:38PM. My mother had called me an hour after the phone switch had occurred; I never noticed a thing. The third party store the fraud had occurred in is in Riverside, CA between 7:50PM 8:20PM. Verizon Wireless let me know that my phone had been changed back within 30 minutes. They let me know they have everything documented and my attorney can subpoena my information if necessary. I checked into my hotel in Downtown Los Angeles, CA at 7:58pm. There is no way I could have been in Riverside within three minutes. I called Verizon and let them know about the situation. They said they made notes, and their representatives (even third party stores) had the same procedures when managing their client's accounts. Must provide the last four of my social, cell phone number, and photo identification; and I even have extra protection by having an extra pass code (no one can possibly know other than Verizons representatives who must verify it with the customer) in place. I'm sure Juan C. had my social, and cell phone number; but there is no way he could get photo identification or especially know my pass code. I am 100% certain they would never know my pass code. I remember Juan C.'s younger brother Frank C.(who coincidentally lives in Riverside), and also worked in the same company, always mentioned a friend of his that worked for Verizon. I suspect that a representative of Verizon worked in this third party store and helped Frank because of their friendship. My privacy rights were horribly violated, as they tried to incriminate me by creating false evidence. I feel Verizons representative helped plan this attack on my credibility and used the resources available to her against me. She took advantage of her position. They should not have been able to access my account. I don't understand why Verizon would give this information so easily to a third-party cell shop that I would have never gone to. I only go to shops with Verizons name. I want this representative found out, I want Verizon to re-evaluate their privacy policies since its obviously flawed, and I want justice to be enforced to this representative. I asked Verizon, "What is going to be done to protect me?" They answered, that a "hot remark" was placed on my account to warn all representatives to really make sure it is "me" before continuing. I changed my pass code, something the representative can see and will ask for verification from the person trying to access my account. However, I suspect the third party employee was involved. Since they made it seem I was requesting an upgrade to change my phone to a dummy phone, yet my contract was not extended and it still shows as if I have my upgrade available online. Also, I doubt my ex-coworkers would have come up with this scheme by themselves. They would not have thought about something like using an upgrade to incriminate me with my own phone number. That is something someone who is around a lot of phone would know, or think of. Verizons representative allowed this violation of my security. I actually moved residence because I am afraid of Juan C. and if I had updated my address information with Verizon; then they would have that information too. This is very serious because they have malicious intent. My cell phone is like a part of me, I have always carried the little device with me where ever I go since I turned twelve. I have never shared my cell phone with anyone, as a cell phone is like a diary filled with personal information. Ive installed all the protection available on my documents and pictures in my phone and even lock the keypad with a symbol pass code. Cell phones are important to everyone, which makes this situation all the more violating. The representative should have protected my rights, not only because it was her job, but because the idea of manipulating anyones cell phone is unethical and wrong. Please let me know if I have a case. I tried to file a fraud claim with Verizon but they said this was called social engineering, but then when I was transferred to that department they said they couldnt do anything. I asked the last representative what was going to be done, and he couldnt really answer me. It bothers me that they dont seem to be taking this too seriously, even after I explained the situation. All they did was place hot remarks on my account. I also want to get a police report, but Im not sure how to label this violation of my civil rights. As well as requesting a restraining order against everyone who is trying to take my 5th Amendment. How should I proceed? PS: When I called for information about Dec 23rd 2010, I gathered the following information from Verizon before they began being careful with the information they gave me about my account.

 As someone who IS a Verizon customer, I can tell you that they make you jump through A LOT of hoops if you cant remember your password. It was too the point that I was getting frustrated. I know I picked my account password but couldnt remember it. And they wont give you any hints either. So unless by some magical form of telepathy they were able to get your account password, there is STILL the Identification that has to be shown. As the previous poster told you, when you deactivate your phone then reactivate it, you NORMALLY get a text message that your device is now active. They may have TRIED to access your account but if the criteria has not been met, they normal will not assist you.

It is possible that your phone was "cloned". This is HIGHLY illegal. But pretty easy if you have the right equiptment. Im not saying I dont believe you, I just call BS when a consumers THEORY is not based on solid evidence. You are jumping to a few conclusions without ANY proof. Did you ever think that MAYBE your boyfreind was involved in sending the texts?? He could have sent them while you left your phone unattended. Then erased them so you didnt see. As I pointed out that your phone could have been cloned. So thats a possibility as well.

Point is you NEED to file a FCC complaint and ask for a investigation into a wireless fraud situation. You can do it online on FCC.com. You really should AVOID putting your business out there on the web. I mean REALLY avoid it. Secondly, come on now woman!! You are WELL versed in denying a male ANY opportunity to touch you. If this individual has actual harrassed you, then you need to get your HR dept involved. DO NOT LET THEM GET AWAY WITH IT IF IT IS TRUE!!! Lastly........call the cops and file a harrasment report. Report the sexual harrasment that happends at work. Just because it happends at work is NO EXCUSE to not report this person. Given the over aggressive nature of his advances shown in your post how many OTHER women has he harrased? Even worse, how many has he harrassed and then went further.

DO NOT LET THIS STOP YOU!!! If your immediate supervisor refuses to assist you go above them. Keep going up the chain until SOMEONE will listen and assist.

OK this whole post is ridiculous. First of all, I work for the company which is why I will say that this story is LITERALLY IMPOSSIBLE. Customers really need to understand that we can't access accounts willy nilly. This person seems to believe that her ex boss or whatever had someone go in so they could put a phone on the account to text people from. What a crock. First of all, there is ABSOLUTELY NO WAY AT ALL that we can access a customer account without the password. So many customers get frustrated when they can't remember it and will say "well can you give me a hint? Can't I just show you my ID?" I repeat, THERE IS ABSOLUTELY NO WAY TO ACCESS YOUR ACCOUNT WITHOUT YOUR PASSWORD. Do I need to repeat that again? We put in your phone number is one slot and until we get the correct password to put in the second slot its a completely blank screen. There is so much account security its ridiculous. Second, the fact that you chose to write about your childhood molestation in a public forum about a cell phone company and this whole story In general says to me that you have a victim mentality. Sorry if that sounds insensitive but this whole post was TMI. Third, even if by some magical event they were to get your password and access your account, doing something like this is instant termination. Why would someone be so stupid to do this? You said at first it looks like they tried to do an upgrade but then you said they put a dummy phone on then that it was a ZTE salute. This may sound terrifying to someone who doesn't know the industry lingo but to someone who does know I can tell you right now it makes absolutely no sense. You say you didnt notice a thing that your phonw had apparently been switched. See heres the thing: when your current phone would have been put back on your would have had to reactivate it yourself. Service doesnt just magically come back on instantly. I don't love everything about the company but I will say that account security is number one, even above profit if you can believe it. Not only is it policy, but its the law. Your whole story stinks of someone looking for a scapegoat.
