I purchased a refurbished cable modem on EBay as a replacement for my Comcast supplied modem that has a monthly rental fee. Upon registering this purchased modem, Comcast  informed me that the modem is actually owned by Comcast and is subject to their monthly rental fee, and that the Seller did not have ownership rights to sell the modem to me.

I cannot return the modem, as it is now registered to my account and accruing the monthly rental fee. I requested a full refund as the buyer did not have ownership rights to sell me the modem.

CHAT Jugene Here is the note from the escalation. Let me paste it here for you.

Jugene 2.The modem now in use on acct which sub claims to own, 001DD11D73C2{C1YBU49AP535702), is Comcast-owned, it came from our warehouse. rentl fee for that device is valid. 

Company has refused to answer my emails except when I opened Return Item on EBay and the company responded that ... 

We are waiting a Reply from your service provider as we have requested some details from them. You are aware they will not respond in 1 day. Not sure why you are opening a CASE here. If you want us to deal this way we can deal here. Your service provider can't accept something and than decide to charge you rent suddenly. This is against Federal and Consumer Regulations.

I took the company at their word that they would work with me, but I never heard from them since.  They should not be allowed to to sell on EBay if they do not own the equipment.

let me try to explain more clearly

i had been paying a monthly rental fee to Comcast for a cable modem

i purchased this modem with the intent of replacing the Comcast modem and not having a monthly rental fee.

so, I returned the Comcast rental modem

to activate the purchased modem, I had to register the device with Comcast

upon registering, I was informed by Comcast that they owned that device so I cannot legally buy it from a third party, and it is subject to a monthly rental fee

Since Comcast claims ownership rights to the modem I bought, I cannot return it or I will be responsible to Comcast to replace it, as they claim it is theirs

i hope this makes the situation clearer

Just curious. You stated you "cannot" return modem. Yet, you opened a case for a full refund? How exactly is that fair? Then you will have a free item while the seller is out money and device. If you were still able to get device on your account, im not uunderstanding your issue?
