I had the same experience as Concerned Citizen.

I was first called by Jason Greene who asked me for information regarding my timeshare experience and any misrepresentations that had been made during a sales meeting.  He indicated that he would have to submit my complaint to a committee for approval.  Then I god a call from Frank Merola who indicated that he was a specialist and wanted to confirm the information taken by Jason.  He indicated that they had a program referred to as debt reduction, deed replacement where they would get me out of my high timeshare points (890,000), I would not have to pay the timeshare the monthly mortgage payments and that they would get me a new deed for 550,000 points.  He indicated that this would cost me $30,000 and I should try to get a loan for that amount and if I couldn't, then they count provide in-house lending.  I asked him how he could do this since their company had no ling to Wyndham.  He said that there was legislation that indicated that Wyndham had no choice but to follow this scenario.  I still could't understand why Wyndham wold give me a deed for 550,000 points and lose interest on a mortgage with a balance of about $850,000.  Mr. Merola assured me that it could be done.  He indicated that I would have to sign an agreement with them but not until they had all the "ducks in a row."  I printed some information from their website today and the Disclaimer indicated that "VO Financial is not a resale or listing company..... As such, our services shall not be construed to be paying off any existing timeshare debt or any mortgage that may be associated with a customer's timeshare ownership"  What a disappointment.  Scammed once again!!!

Thank you, too, for being a firm that has shown integrity in exposing the deception in the timeshare vacation business on your website.  And we are so grateful to have been offered a legal way out of debt.  Jake has been a great consultant for us as he has walked us through the whole process and we now have in hand a letter from our developer confirming that our contract number has been cancelled and their collections activity has stopped.

It really is quite simple, our services cannot fail, and you can consult with a licensed attorney to verify this prior to ever doing business (we even recommend it). In this case we will do one better just too once again prove our points that reading online, and being uneducated about a situation or company is sad because it leaves you in the same place you have always been, unhappy and in debt more than you can handle because you believed untruths.

So in closing, this (Non-Client) may e-mails customercare@vofinancial.com and we will fix all of your problems for free, once we have completed service all we will require is you come back on this site and apologize to us and the consumers you wislead with your assumptions. Your obligation in the contract will be that.

This client is correct in this post. We are not a listing or re-sales company and we will not be paying off exisiting timeshare debt. Unfortunetly this client has some skeptisim and isnt clear on what we do for her. First for this clients comfort we are willing to assist this client through and alternative financial program which will not require her to come up with the money as an act of good faith, and secondly we will provide what we are going to do so it may be verified.

As the Service Agreement clearly sets forth, after VOF verifies from a client the exact nature of the fraudulent sales tactics and/or misrepresentations the client encountered during the purchase of their existing timeshare from a timeshare developer, VOF will gather a case file on that client. Based on VOFs experience in the timeshare industry, VOF will then decide what type of services best suite the particular clients file and financial situation. If it is determined that the client wishes to eliminate the debt owed on account of its existing timeshare, VOF will walk the client through this process. Based on VOFs experience and the nature of timeshare properties, VOF will consult with the client about stopping all payments on the existing timeshare debt in order to eventually obtain a deed in lieu of foreclosure. VOF will work with the client during this process, which normally takes 150-180 days, by consulting about how the process works and providing stop call letters to the client so they can send to their mortgage holder in order to stop the harassing debt collection calls. As the federal Dodd-Frank Act permits, timeshare mortgages, as opposed to residential personal mortgages, are specifically permitted to utilize the non-judicial foreclose process i.e. a deed in lieu of foreclosure in addition to other state specific legislation permitting the same (FL Ch. 721). In addition, a deficiency judgment will not be entered against the client after they receive a deed in lieu so as to eliminate all obligations associated with the timeshare and the accompanying debt.

Facilitating the purchase of a new timeshare ownership?

As the Service Agreement clearly sets forth, when VOF enters into the Service Agreement with a client, both parties also simultaneously execute an Assignment of Contract. The purpose of entering into the Assignment of Contract is due to the fact that VOF does not hold legal title to any timeshares, and the Assignment permits VOF to provide the service of facilitating the purchase of a
new timeshare which the client requests pursuant to the terms of the Service Agreement. In order to complete the purchase of the new timeshare, VOF works with an unaffiliated licensed title and transfer company, who deals on the secondary timeshare market. VOF then enters into a contract for resale with this title company in order to facilitate the purchase of the timeshare for the client through the Assignment of Contract. This is to provide the owner with the same ownership but free and clear of an liens or encumbrances. Usually the ownership required is requested to be a lessor amount than there current account as to lower maintanence costs as well.
