I purchased a new, unlocked Motorola KRZR K1 cell phone via walmart.com. Ordered on 12/23/07 & received on 1/2/08. Phone is new & all appears well.

The issue begins when I notice the options in the manual do not match what is on the phone. After checking around online, I find the software on the phone is about 2 years old. I begin looking to upgrade this brand-new phone after having it just 1 day.
Motorola does not offer software upgrades for a generic phone, only for specific carriers. My carrier is AT&T, which Motorola does not carry software for them. If I use AT&T or any one else's software, I now have a locked cell phone which is not what I want.

After multiple calls & emails to Motorola Tech Support, they inform me that my phone was not manufactured for use in the US or Canada. It was intended for use in Hong Kong. I received this verbally & in writing from Motorola. I was also informed that Motorola does warranty this phone because it was for export.

I contacted Walmart customer service via phone at (800)966-6546 (a very hard number to find...they do not advertise it) and explained the situation.
The only option I was offered was to return the phone to either a local store or mail it back within the 90 day return period.

In summary, Walmart is selling phones that are NOT intended for use in the US nor are they disclosing this fact to the consumer. The item description contains nothing in regards to this. My phone is just one model but I'm sure this is not the only one.

I now have a phone with no warranty, no support, software that is 2 years old and I have 90 days to decide if I keep it or not.

If this information is correct Wal-Mart Stores Inc. is in violation of federal trade laws. This information would be turned over to a number of federal law enforcement agencies. However I can't believe that wal-mart would put itself in this position. If walmart has done this and isn't aware of this, they are still liable for the situation.

Since you wouldn't gain anything personally out of this ruling, I would simply leave it at this. You should have by now been refunded and had the ability to exchange the merchandise. If you haven't, then I would continue to pursue a refund.

Situations like this, are rough, im sure government agencies look at this site and this report will remain on here, you can try contacting the Federal Trade Commission regarding this however it'll probably go on deaf ears.

Yes, I am documenting every step of the way. I have the emails, downloaded copies of the item webpage from WalMart.com and am awaiting an email response from WalMart.

I'm sure this matter would be best addressed to the Federal Trade Commision due to the import/export issue as well as interstate sales. If you have knowledge of an alternative bureau, it would be most appreciated if you passed it along.
