My name is David B , and I am a former employee of Walgreens. After a misunderstanding about a missed shift I was let go. I won my unemployment through an investigation conducted by Richard Fairchild of the Workforce unemployment board. He found conclusive evidence in my favor, and my benefits started. During the time I was receiving benefits, I had to have gall bladder surgery. I reported it to unemployment, who made me ineligible for 3 weeks. Which was what I was supposed to do. I was following the legal guidelines. Along comes this appeal from Walgreens and their mighty lawyer staff for a telephonic interview(hearing). I wasn't worried, I had 3 witnesses on my behalf to refute anything they could say at that hearing. All of them were still employed at Walgreens, so they were facing backlash themselves, but I was appreciative to them for wanting to stand up for me. The morning of the hearing all 3 backed out as witnesses and left me standing all alone against the mighty defense team of managers and lawyers for Walgreens. Needless to say I lost that appeal, and 3 subsequent ones now. Even with one of the witnesses coming forward and sending in a notarized letter refuting their testimonies. I didn't ask her to do so, she did it because she felt guilty for letting me down earlier. I want to know why the original facts collected by Richard Fairchild, by a unbiased third party was able to get the truth, and why all their decisions were allowed to be changed in this interview and they weren't held accountable. I have not given up, I am now into the Court of Appeals, filing motion after motion about legal things I don't comprehend. But I refuse to give up, because I know I am in the right. Plus I have already lost enough, about 40% of what we own to pawn shops, just trying to survive. Here's the kicker. On the night I missed(which I did call in) I told them that a friend(also a co-worker) had a family emergency. She did.... She had been arrested, and someone needed to watch her kids, plus her job would have been in jeopardy, had I disclosed the "family emergency". Because I didn't disclose why I needed the night off(which was approved). I was targeted as a dishonest employee and terminated.   The summary:  I did the right thing and got fired. Rightfully got my umemployment, then was railroaded. I have been fighting to get my dignity and integrity back ever sense. Thanks for your time.

Why not put the months of effort you have obviously put in to this, in to finding another job? That is the point of getting your unemployment, so you can look for a job.

Its up in the air whether you should receive unemployment or not. Calling in to a shift and getting fired over it can be seen as voluntary separation. The only excused absence from work are those covered under FMLA. An employer can fire you over any other absence they see fit. I don't see that they wrongfully terminated you by what you have said.

The fact that you did get approved and then denied by appeals, that would be something for a lawyer to look at. If this is that important to you, then you need an employment lawyer. It would be far easier and cheaper on your part to just get another job.

First of all. Calling in on the night you work regardless of what  the excuse, is always frowned upon. You said you misunderstood your shift. But you state you called in because of an emergency for someone else not even related to you. (ill get to that in a moment) So it seems to me you understood you had to work. As far as the emergency is concerned. Seriously you had to watch a friends kids. Sorry that dosent constitute an emergency on walgreens part. I understand and applaud you for helping a friend but work comes first.  Her family emergency is not your emergency. Who approved you for the night off. some other co worker in the store? a shift manager?  No one is going to approve a night off without some sort of explanation. Sorry i call BS on that one. You were fired because you failed to provide an adequate reason for calling off. And also any good employer wont fire you over one mistake. There has to be more to this story than meets the eye.  Grow up  David
