On May 20, 2007 I attempted to write a check to pay for the merchandise I had purchased at Wal-Mart. My check was declined by Telecheck. I asked the checker to run the check through again and the result was the same. By now people were lining up behind me. She then called a Customer Service Manager over to review the situation. I explained to the manager that there was money in the account and that I hadn't written any bad checks to have my check declined. The manager handed me back my check and a slip with a phone number on it and explained to me and everyone around that I may not have written a bad check to Wal-Mart but I was apparently writing bad checks all over everywhere else.

At this point I was furious and made a few not so nice comments. I paid for my things with cash and left the store. I then called Telecheck who told me that my checking account was invalid and I was trying to write a bogus check. My husband grabbed the phone from me before I could finish what I was getting ready to say to the person at Telecheck and hung up the phone. I called my bank as soon as it opened the following day and asked them if my checking account was okay and told them what had happened. I then called Telecheck again and was able to talk to someone who explained that someone else with similar account numbers had information that was in my information and said that was the reason for my check to be declined. He also told me that I had a perfect report with Telecheck and that he had fixed the problem, but that it would be 3 days before I could write a check because of the corrections he made. Then I was mad.

I called Wal-Mart back and asked for the manager on duty and told her the story and gave her the CSM's name and my transaction number and she said she would discuss with her that her behavior was not appropriate and that she should not have talked to me that way. I called my bank later and they told me they had received several calls about Telecheck declining their checks also. What can be done about this company to avoid this? Telecheck claims to have accurate information and that they are reliable. If this ever happens again I will call Telecheck while I am still in the store and make sure that the CSM pushes carts in the snow and ice!

Maybe you should file a libel claim

If you're steamed enough about all of this, you may have a case for libel. Libel is generally defined as the making of a false statement, in writing (elcetronic form should constitute "writing"), that is made with knowledge of its falsity or reckless disregard for the truth.

If Telecheck doesn't have proper procedures in place to ensure the accuracy of their information, then it can easily be said that they are making statements with "reckless disregard for the truth."

If you wanted to, you could file a small claims case against Telecheck. Usually a small claims case is initiated by the filing of a simple form with the court clerk, and sending a file-stamped copy of the document to the company's registered agent for service of process in your state (you may have to fish around some state websites to find this information).

In the "complaint" box on the form, state simply that "Telecheck published false information concerning your finances with knowledge that the information was false or with reckless disregard for the truth, causing me emotional distress and forcing me to expend time in rectifying the matter." Ask for the jurisdictional cap on damages for a small claims action in your state (again, you'll have to fish around for this information).

That's just what I would do, if I were pissed off enough!

Telecheck Up-To-Date???

I just had to comment on this and tell you to be careful with your checks because I found out that Telecheck is not very up-to-date. I am in the middle of an expensive nightmare right now . Back in April I received a telephone call from telecheck wanting to know when I was going to take care of my bad checks. "What bad checks?" I asked them. "The ones I wrote to Walmart and Payless Shoe Source." they replied. I told them that I don't write checks to businesses, that I pay with my credit card. Come to find out, somebody had found some old checks to an account that had been closed over 7 years ago. But nobody asked for ID when the checks were presented and they were ran through Telecheck and approved. So tell me this, if Telecheck is so up-to-date, how could they not tell that the account hadn't been in use for over 7 years and was closed. They really need to update their system with all the fraud that is going on these days. So, destroy any old checks from closed accounts or Telecheck will do worse by you then what they have already done!
