Warner Health Care bait & switch advertising - one-month supply of Avlimil switched to auto ship; charging shipping on unordered product; lying about return policy. Ripoff! Cincinatti Ohio

My wife placed an order for the 30-day trial of Avlimil from Warner Health Care, Inc. June 3, 2003 for $4.50. She understood this to be a one-time trial with an option to reorder. We began receiving new packages - one about every three weeks. After numerous attempts at contacting their customer service, we finally were able to speak with a service rep who advised that my wife continue taking the product even though I reported that it made her naseous.

A few weeks later, I called them again. I was told at that time to return the unopened packages for a full credit. By this time, we had received four more packages. I also protested the charge to Discover Card which issued a temporary credit for $140.00 ($35 per month X 4 months) After six more weeks passed, Warner issued a credit to our Discover account for $100.00. I called them again and was told this time that since they have no return policy, they must charge a $40.00 shipping fee. No return policy? I had just returned the four unopened packages per their directions! I again protested the charge to Discover. They refused to take further action.

I then filed protests with the Consumer Protection Department of the North Carolina Attorney Generals Office and the Better Business Bureau of Cincinatti, Ohio.
I promptly paid the $40.00 under protest and cancelled our Discover Card for their refusal to reject Warner's "shipping charge".

The public should be made aware of the underhanded practices of Warner Health Care. $40.00 is a small amount, but it's the principle of the thing.
