Dec 17, 2008 - fraudulent charge by MYFITNESS, marked as debit without PIN. Called Customer Service to dispute.

Jan 02, 2009 - no credit for previous charge, and a 2nd fraudulent charge by MYFITNESS. Called Customer Service to dispute again, got a very nice lady who put in a temporary credit to my account. Told me to watch for a form in the mail I needed to fill out.

Jan 30, 2009 - received letter dated Jan 21, giving me 10 days to respond or the credit would be reversed. I responded, pointing out that there was no sales draft, and that I have not received any product, service or communication from anything or anyone labeled MYFITNESS. Responded via fax.

Feb 18, 2009 - received letter dated Feb 06, with attached "merchant rebuttal". Merchant rebuttal consisted of a single line stating "charge is for monthly membership fees". Once again I was given 10 days to respond and a Customer Response to Merchant Rebuttal form was enclosed. I responded by fax, once again pointing out that there is no signed sales draft, no authorization, and I have not received any product, service or communication from anything or anyone labeled MYFITNESS. Additionally, I asked them to look at my account history - in 26 years, I have NEVER used this account for any recurring charges.


Mar 16, 2009 - received letter dated Mar 04, stating that "the merchant had provided copy(s) of documentation to validate these charges (see attached)." There was nothing attached. They reversed the credit to my account.

Mar 17, 2009 - sent another fax asking them to provide the documentation they failed to include with their letter. Additionally, they had suggested that I contact the merchant directly, but since this was a fraudulent charge, I have no contact information for them. Wamu was asked to provide accurate and complete contact information for this merchant, including any persons they have communicated with regarding this matter. No response.

Mar 25, 2009 - sent 2nd request for merchant documentation and contact information.

I do not believe I will ever get a response from Wamu Debit Card claims, nor do I believe that they received valid documentation from this merchant. MYFITNESS is well known to be a rip-off scam. I have no delusions that they care about me as a customer, but what they don't realize is that my little internet account was small for a reason. . .and we're moving next month to an area that is almost exclusively Chase. Since Chase now owns Wamu, guess who *isn't* getting my accounts?
