We bought a house in 1/99 for $29,070.Our mortgage payment was $388 a month for 30 years at 7.25%.We had the taxes in escarrow.The taxes were about $2018 a year.

Then I think it was 2001 we got a letter stating that Homeside lending had bought or mortgage.At that point our mortgage went up to $406 a month.We did not refinance at any point on this house.

Then either later that year or possibly early 2002 we got a letter stating that Washington Mutuel had bought our mortgage. At that time our monthly payment went to $510 a month. Now keep in mind, all this time the taxes were supposed to be paid by the mortgage company from escrow.

Early in 2003,I think it was,a city employee knock on our door. He informed me that the taxes had not been paid in 2 years and the house was going to be taken by the city and auctioned. I explained to him that the taxes were suposed to be paid by mortgage company. He told me to call my mortgage company andthe city to get things straightend out.

When I called Washington Mutual they apologized and asked me to have the city fax them what was owed and what the yearly taxes are. I did right away. The city faxed it right away and I thought everything was fixed.

About a week later I get a letter from Washington Mutual saying that my mortgage was now OVER $800 A MONTH. Of cource I got right on the phone to see why it had gone up so much. Their answer was, "well the taxes on your property are $20,000 a year."

I told them,"NO, I don't think so. We bought it for $29,070 someone made a mistake. "They told me, "Well the city faxed us that amount. You'll have to have them fax us the right amount."

So I called the city. They told me they sent them the right info and they even had the fax to prove it. I did ask them to resend it and they did. I called Washington Mutual again and they said "yes we got the fax but we can't change the mortgage till the next review which is about 6 months away." I told them that we couldn't afford a mortgage at over $800 a month and that they need to fix it now.

They said,"NO."I called and I called and tried to get them to fix it they wouldn't. Needless to say we got behind on the mortgage because we couldn't afford $800 a month. We got letters threatening forclosure. I called Washington Mutual to see what I could do so we didn't lose the house.

Their one and only option: Make a payment and a half each month till we were caught up.$800+$400=$1200 I told them we couldn't afford the $800 a month how could we afford $1200!I told them, "Just fix the account and wouldn't even be behind." They told me,"We can't fix the account till it's current."

Again I called and called but they wouldn't fix it.We really tried to pay what they wanted so we could be current and they could fix the account. It was too much.

We decided to leave the house and file for bankruptcy.We left 10/2/03. Our chapter 7 bankruptcy was dischared 1/24/05. We included the house in it. In the bankruptcy papers Washington Mutual said we owed them $30,000. All these numbers just don't add up.

You would think that the torment from Washington Mutual would be over at this point. NOPE.

Now to the really fun part. We want to buy a new house. I had everything set up for financing with bankruptcy over a year behind us. The lender asked me to have Washington Mutual fax him a letter stating that there is $0 balance with them. I called and asked them they said "OK". The new lender calls me and tells me that there's a problem that Washington Mutual is stating that while there is a $0 balance they say that they foreclosed on the house 2/06 and that he couldn't give me a mortgage with the foreclosure date so close.I told him that the house had been included in our chapter 7 bankruptcy and we surrendered it and that we were released from it 1/24/05. He told me his hands are tied unless Washington Mutual sends him a fax stating that we were released from it 1/24/05.

I called Washington Mutual again and told them what I had told the new mortgage lender and they told me I was wrong. I called my lawyer who did the bankruptcy and he told me I was right. I called Washington Mutual again and told them my lawyer said the date we were released from the house was in fact 1/24/05. The person I was speaking with asked me to hold on while they ask their supervisor.When she came back she said that her supervisor said they would type up the letter and fax it to new lender with the new date , but I had to re fax the request to them 1st.

I did. I called later in the afternoon about 3 pm and they said "yes ,they did receive the request and the new lender would have it by the end of Monday." I said," thank you."

About 5 pm,later that day, they called me and said" my supervisor said we can't do it cause it wasn't included in bankruptcy we got a relief filed in Jan. of 05 and we weren't in the bankruptcy." I was dumbfounded. I called my lawyer and told him. He said they were wrong he had just looked at the paperwork from the bankruptcy and they were included.

I have made myself sick because of all the stess from this. There must be something that can be done!
