I have been in the restaurant business for 30 years. I have never signed a contract with Waste Management until back in 2006 when our garbage bill took a huge hike and we were looking at going with another company. Waste management made us a deal and lowered our monthly bill to satisfy us. Thats when they brought a contract in person and I did sign it. Thinking it was a year because once every year they would send me a contract to sign but I never did. Ever since then our monthly bill has been increasing. In 2009 my brother was throwing some balsom in my dumpster and they called and said that they were going to start picking up twice a week. I stated to them that no more balsom would be going into the dumpster and that we didn't need a twice a week pick up. They continued to pick up twice a week. My bill continued to go up every month. The monthly bill was at $260.00 in 2006. Last month I paid $478.00 same contract.
Last week a different garbage company came in and gave me a bid for $150.00 a month. I took their service at once. On Aug.12 2011 I had my husband call waste management to pick up their dumpsters. I didn't remember signing any contract of theirs but I was told in 2006 I signed a 3 year contract and that after 3 years it automaticlly renew for a year at a time and I would need to give a 90 day notice but my contract renewed on Aug. 1 2011 so I was past the time for a 90 day notice. We basically told them to pick up their dumpsters and they said see you in court. Today Aug. 18th. we recieved a copy of the contract stating that we would need to send them $958.00 plus $75.00 container refurbush. But I think it may be more now that were not in our 90 days. Also they want a writting notice thats certified. They recomended not making any changes yet, but I know they know we already have. Another thing I signed the contract in 2006 but the one they sent me had it marked for twice a week pick up and that never happened till 2008. Also, they have been sending me a new contract to sign offering me coupons if I sign it, but I never did. I do not have a copy of the original contract but I do have a copy of the one they keep sending me. A $328.00 savings would be great in these times. I am debating if I want to talk to my attorney or if I should borrow the $1000.00 or more and still save in the end. I know one thing will be warning people around town that still have waste management. Who really reads all the small print on the back of the contract for a garbage pick up and its a full page. They really cover themselves. I never heard of a 3 year contract that after 3 years it automatically renews for a year at a time.

ACT 192 - what was the result?

I wanted to know how you resolved this issue and if using ACT 192 as evidence that they did not act according to law helped you. I am going through the same issue now. There contract renewals cannot be legal! Something must be done to stop them.

Waste Management is often pretty harsh with their policies in my experience, however they are a big company with good legal advice, I have never seen anything done by them that is not compliant with all the laws. As to the original 3-year term and self-renewing, this is absolutely standard contract language, in fact I am surprised when I do NOT see it on contracts. I'm surprised that being in business you are not totally familiar with this concept. My advice is to take the buyout, which is actually not that big of one, and learn the lesson. You should read contracts before you sign them certainly, and keep your copies so you are not wondering later what you signed. And assume they renew year to year after expiration, I do not even need to look for that (it is always there), except to see what the notice requirements are to cancel.
The fact that they are trying to get you to sign a new one, I would not read too much into that. Again, they are a large company, they are probably just trying to get everyone on updated contracts. Often departments will cross and things that you think are being done in concert or with some goal of tricking you are simply coincidences.

It would not take me long to recove the costs. Its just making a point. I don't see anything about a Grandfather clause. I guess my next step is to inform WM about the fact I never signed a knew contract and see where it goes from there.

If you want legal advise you should consult an Attorney, which by the way if you own a business you should already have one you talk to.
But in general non-legal advise, it really depends on how that 2009 law was written. If there is a "Grandfather" clause your contract may still be valid and they may be able to collect the fees from the automatic renewal.
But if you look at this from a purely economic standpoint. If you are saving $328 a month, it would take you just about 3 months to recover this fee you are being charged from WM. To talk to a lawyer you may get a free consultation, but more likely they will charge you for a couple hours which depending on the lawyer may be around $200-$500.

After taking a closer look at the new contract thay have been sending me, I discovered why they have been offering me coupons to get the new contract signed. The 2009 WI Act 192 is a new law. The law requires Waste Management to have me sign and then inital the small print telling me about the automatic renewal. Als,o they were to give me a 15 day notice of any contract being automatically renewed. If I am understanding this right, I think my contract I signed in 2006 is void. I need some leagal advice.
