I bought a "Bagster" at Lowes - this is a big square plastic bag that you put waste in, or construction debris, it's BIG and sells for 29.00 at Lowes.

The display has a price of $29 and says BUY, FILL, GONE.

We bought the bagster and filled it yard debris, old toys, etc etc.. we went to their website to schedule pickup only to find that they charge another $89 to pick it up.

So I went back to Lowes to look at the display again as I was sure they MUST have had the details somewhere - they did not - I asked for a manager and brought my concern to her attention and she agreed that the Bagster product is a little misleading and offered to give me my money back... well - the BAG is FULL of Refuse already @ the end of my driveway! I need it picked up "as advertised", not my $29 back.I took pictures of the display and also recorded video of my conversation with the store manager and posted it at youtube.

After contacting waste management I was told that the charges for pick up are clearly visible on their displays.

Two regular trash cans

In my city two regular trash cans are 32 gal in sise so that would only 64 gal the way you speak -- but fact are a thee cub yard contaner hold 648 gallons that would be 20 and one quarter trash cans ---- big difference

Yes, Robert, that was a sad attempt on the part of the original poster. We were in Home Depot today and recalled the chaps disertation on how he was ripped off - looked at the packaging for the Bagster.

Lo and behold, there it was in plain English and all in capital letters:

"COLLECTION FEE IS EXTRA"
"See back for more details"

Quite cheesy attempt on his part to try and cover that up to try and add credence to his ramblings.

I went back and looked at the photos again.  Photo number 2 has clearly been "photo shopped" with a graphics program.  Indeed, it appears that TWO ATTEMPTS were made to alter the photo.  The first attempt wiped the the lettering out with a shade of green that was TOO LIGHT.  A SECOND attempt was made with a shade of green that was darker, but failed to hide the lighter green underneath.

Methinks someone has been caught trying to pull a fast one.  Perhaps someone should email a link of this RoR to WM to let them know.

The video on youtube is laughable as well.  The store manager couldn't find it on the DISPLAY and at no time in the video does the OP or the manager LOOK AT THE BAGS.

What a looser.

The display at Walmart has the information regarding extra fees due at pickup prominently display.....both on the package and on a big cardboard sign in the center of the display.

I am an Obama loving liberal and your statements are beyond absurd.  A liberal would be more apt to be on the side of the consumer and not the "evil big company".  I have no idea how you tried to slip a union tirade in there but it's typical of current hysterical conservatives. 

It should be obvious (even to a conservative) that a product like this would have some additional information associated with it.  Just read the d**n information on the box.  It's not a difficult task but if you are one who need to be coddled at every point of shopping, maybe you should bring your mommy along next time to help.

After reading your post, I almost fell out of my chair laughing.  I can't speak for Robert, but I don't work for WM, have never worked for them, and have never worked in that industry.  I'm retired military and have a very good job repairing computers and cash registers.

If you think that 3 cubic yards is only slightly more than 2 standard trash receptacles, you need to think again.  Get your tape measure out and measure out a 9ft by 3ft rectangle.  Now, take 3ft long stakes and stick them in the ground at the corners.  It's a lot bigger than you think.

As for them charging anything more than the $30 being a rip off, obviously spoken by someone who has never had to pay for their trash pick up.  I've lived in an unincorporated area where I had contract my own home trash collection, it cost quite a bit every month.

Not sure why you felt the necessity to interject politics into this, but you couldn't be any more inaccurate about me.  I'm probably one of the staunchest conservatives you'll ever meet.

Your snide remark about the 2 asterisks really made me laugh.  If the OP had done his due diligence and read the fine print, he probably wouldn't be in the situation that he's in.  In fact, if everyone performed their own due diligence and read the fine print, then a lot of these rip off reports wouldn't be here.  Could WM have made things clearer, sure.  But reading the fine print is the consumer's responsibility.  I guess you could say both, WM and the OP were at fault.  But I still believe a little common sense should have told him that there would be some sort of a pick up fee.

We have had our own issues with WM and their customer service is non-existent. Don't listen to the two WM minion fools Robert and Brian, they are probably the same person anyway and are probably employees of WM. 

I wouldn't think there would be more to pay after the $30 for only 3 cubic yards of waste. That is about the same as 2 regular trash receptacles. To pay anymore than that would a ripoff report of its' own. 

I hope you don't have regular trash service with them guys as they'll probably send over some of their jack-booted, socialist union thugs to bully you and your family around.  After watching the video I can't see how anyone would try and defend WM short of weenyfied, Obama loving, liberal, retard that will defend all corrupt union based industries to the death of America. 

Don't let them try and intimidate you with the silly "You saw asterisks, which usually means, yada yada" lol!

After watching the video and looking at the pictures you posted I'd say that it's indefensible.

If you watch the video, you will see the Lowes employee pouring over the bag for many, many minutes not finding it. That's all a Judge would need to see period. 

I work in the legal system and although I can't offer any legal advice to the complainant, I would be very surprised if Waste Management didn't settle this matter quickly, quietly, with little to no fanfare

Aside from state law, Federal Advertising Statutes are going to be on the side of this consumer without a doubt. 

While the terms "false" and "deceptive" are essentially the same for most, being deceptive is not the same as producing deception. What is illegal is the potential to deceive, which is interpreted to occur when consumers see the advertising to be stating to them, explicitly or implicitly, a claim that they may not realize is false and material. The latter means that the claim, if relied on for making a purchasing decision, is likely to be harmful by adversely affecting that decision. If an ad is implicitly false, evidence must be obtained for what consumers saw the ad saying, and for the materiality of that, and for the true facts about the advertised item, but no evidence is required that actual deception occurred, or that reliance occurred, or that the advertiser intended to deceive or knew that the claim was false.

In NC, VA, SC and TN - The statutes revolving around deceptive advertising are even more aggressive at consumer protection than at the FTC.

I have personally seen a far less obvious case which started off in Small Claims and was appealed up to District Court where the Def. was ordered to pay fines of almost $6k per day and the Pla. was awarded the maximum 15K.

From what I see out on the web, it looks like this is not a unique problem.

Do you really want us to believe that you honestly thought that for $29.00, you could purchase this bag, fill it up, and have Waste Management come and haul it away?  That has to be the most ludicrous thing I've heard.  I noticed in one of your photos, under the word "GONE", there was a paragraph explaining what number to call to schedule a pick up.  I also noticed that there were a couple of asterisks at the end of the paragraph.  Those tell you to look for the fine print, which I'm sure, told you that there would be an additional pick up charge.  Although, that shouldn't have been necessary, anyone with half an ounce of common sense would've known that.  You screwed up and didn't use your head or check the fine print, this is on you.  I'm sorry to be so harsh, but common sense should've told you there would be additional charges.

Your pictures are not that clear and it seems that there is additional details that we can not read.

Perhaps you can get a clearer picture of the "BUY..FILL..GONE" picture.  Because under the "GONE", there is defiantly two ** at the end that usually denotes additional details.  Then there is obviously additional text under the phone number that is out of focus.  Whether or not that discusses the additional pickup fee is impossible to say unless you can post a clearer picture.

Also, in the other picture there appears to be a holder for pamphlets that is empty, if so perhaps those provided the information as well.
