In 2000 I was arrested one week before my wedding for unpaid child support. I was given a court day just before christmas to go in front of FOC Judge for this to be resolved. At that time I informed him that I did not believe the child was mine and proceed to explain all the reasons why. I was told in no uncertain terms that because the child was nine yrs old that I could not have a paterinty test done and to just pay my support and like it or go to jail!!!!

Being that I had 2 kids and a wife I choose to not go to jail. They then proceeded to garnish my wages every week for a child that I didn't even get to see or even know at that time.

I have subsequently lost my job due to illnesses and have fallen behind in my support payments. I was arrested in may of this year for felony nonsupport, where I was once again told to pay or go to jail for 4 years. I have once again chosen not to go to jail but to pay $218.00 a month for just back arrears plus my support order, which due to me being unemployed should have been $38.00 but I was informed today that I can pay $100.00 a month for the next 5 years of my probation so in total a month I pay $318.00 while my ex still collect aid for the last 14yrs

I have received my file from foc and now have proof that there is resonable doubt of paternity. If anybody out there can help me please let me know!!!! Somebody needs to stand up to FOC and let them that we have "HAD ENOUGH OF THEIR CRAP"........

My wife's brother has been paying child support for 15 years. His ex-wife gets greedy and goes after him for even more child support. His new attorney wants a paternity(DNA) test. One is taken. Turns out he's NOT the father. Either take the test or pay up. Resonably doubt probably means the child isn't yours, some other guy tested positive and is paying also. Get an attorney.

This exact thing happend to me. There is no winning with these people. Lesson learned is how important paternity really is. My only recourse now is to have my own test done at my expense so I will know if what I am paying for is mine or not. Sure the court will only do this test after you are sentenced but only for their information bank only "for the next time".

But for all those out there that have not been through this yet my advice is "DON'T" go there. If you and your partner are having a child, get the test done ASAP so you know what your rights and options are, plus it is also good for your child.

Also if you have any agreements with the mother before the courts step in, for any reason, always have an agreement drawn up, signed by both parties, witnessed and notarized and keep the copy in a safe place. You never know when this will come into play and you have the legal document between both parties.

, the only rights you have is to "go along" or else. So protect yourself from the begining and don't be a victim to this messed up system.
