I was contacted by Jared Diamond on behalf of WebiFusion.com through a suspicious email with no clear header, no physical address, not from his company's direct URL, and no clear opt-out options, all of which are violations of the Federal Trade Commissions CAN-SPAM act of 2003. Upon informing the sender that I no longer wished to receive their emails and citing why I would not be using their services, the sender threatened me and wrote a malicious yelp review as retribution for my asking to opt out of their services.

Since the yelp review, I have received several personally threatening messages from the sender, 6 total in a 24 hour period. I have reported him to the FTC, Yelp, and to Gmail, who he was using as an anonymous email sender, likely to deflect negative attention generated from his spam campaigns and associated with his company website and server IP address.

I have also reported the threatening emails to the local authorities.

This report is both grossly and intentionally misleading.

I'm delighted to have the opportunity to clear some of the grossly misleading allegations levied by the complainant (Rocky Hall):

Let's start with examining statements that range anywhere from blatant exaggeration to wanton deception: "The sender threatened me and wrote a malicious yelp review as retribution for my asking to opt out of their service"

"The sender threatened me": Can you please clarify exactly what threats were levied? This is a grossly and intentionally misleading statement with no substantiating proof, as no threats of any kind were levied against the complainant.

"Wrote a malicious Yelp review as retribution": By this definition, any non-positive review of any business could be classified as "malicious" and as "retribution." The review left on Yelp was a factual and objective recount of my experience involving the staff person of a business communicating on a company email.

"I have received several personally threatening messages from the sender" Again, no substantiating proof to this claim. I urge the complainant to produce any email excerpts which even remotely constitute something "personally threatening" in nature. I speak to individuals with utmost respect at all times (even those who clearly do not deserve it); This is once again a gross and blatant exaggeration at best and misrepresentation at worst.


"Upon informing the sender that I no longer wished to receive their emails and citing why I would not be using their services"
The complainant (Rocky Hall) asked that I no longer send him any emails. In the very next email, I replied that "If you would like, I can make a point to not contact your email. I am glad to do that"


Unfortunately, the complainant, Rocky Hall, decided took the liberty to levy personal insults that were both unwarranted and uncalled for. (Contradicting his allegation that he objectively asked that I don't email, which I happily offered to oblige).

To set the record straight, let me share one excerpt of the complainant's email, in which he states to have objectively requested to no longer receive emails (which I gladly offered to oblige):

"Are you seeing our P&L statements?
LOL... Maybe you should have stuck to selling suits and renting tuxes.
"

I will allow the intelligently-minded individuals reading this make their own interpretations.

Rocky Hall (the complainant) is attempting nothing more than to intentionally mislead readers into believing gross exaggerations at best, and intentionally deceptive statements at worst.

This is complaint contains allegations that are nothing more than attempts to make both libelous and slanderous statements against a individual/company who works exceedingly hard to perform to clients' best expectations.

I am of the hope that the intelligently minded people reading this can make their own assertions as to the merits of the complainant.

I can assure that anybody who interacts with our company at any level will be sure to experience nothing but the utmost respect and professionalism that is bestowed to all people.

I would like to point out a few fronts where this report (by Rocky Hall) is intentionally misleading:

Claim: "the sender threatened me and wrote a malicious yelp review as retribution for my asking to opt out of their services."


Let's clarify a few points here:


"The sender threatened me". Can you please enlighten the audience as to exactly what threats were levied?

"Malicious Yelp review." In what sense can you brand an objective and truthful review as "malicious?"

"In retribution for asking me to opt out" A review was left to state the facts of how a company staff member communicated from a company email. If "retribution" was the motivation, then wouldn't any non-positive review of any business be technically a "retribution?"

"I have received several personally threatening messages from the sender": This is intentionally and grossly misleading. I urge the complainant to show an example of any threats that are even remotely "personally threatening" in nature. This is an absurdity.

Excerpt from the complainant's email claiming to be a simple request/explanation:

"Are you seeing our P&L statements?
LOL... Maybe you should have stuck to selling suits and renting tuxes."


I'll let the intellectually capable folks reading this make the determination as to whether this quote constitutes a simple opt-out request (which I told the complainant I would gladly process) - or an insult.

To the individual levying this complaint: You made focused attempts to insult me. However, you would wish for readers to believe that your correspondence was both objective and well-intentioned, which is simply not factual. Your actions on this form are both libelous and slanderous, and are intended simply to deface somebody's name.
