In October 2005 we listed out home for sale with Weichert Acclaim, Brodheadsville Office. Michelle Cappabianco was our listing agent as well as the CEO and president of Weichert Acclaim, Charlie. They promised that they would do everything they could to sell our home.

It has now been almost 6 months, and after us asking on various occassions what the problem was to why there were a limited number of showings there only answer was that the house might be overpriced. We then dropped our asking price by $10,000 which Michelle indicated would be sufficient and that they would change the advertising and continue to try and market our home. Michelle was then promoted to the Sales Coordinator in the Tannersville Office, which is a new location.

Since Michelle took this position it seemed to us that we were being put to the side. She wanted to have other people within her office who were not familiar with our home run an open house, with us providing the agent a tour of our home 1/2 hour before the open house is scheduled to begin. We found this unacceptable as we had indicated to Michelle, and her and Charlie promised us that they would be here for any open houses or showings that were scheduled for our home.

I then indicated to Michelle that since she was now the Sales Coordinator, maybe it was to everyone's best interest if she referred us to another agent in her office. She did this and we were passed off to Shari Hamilton. She met with us and made more false promises regarding showing our home, and trying to work hard for us.

This past week we had a showing, which Shari did not know the name or phone number of this listing agent. She indicated to me that she was waiting for a phone call back from the agent who wanted to show our home, due to the fact that we were unable to accomodate the time that the agent would arrive at our home. This never happened and the agent showed up at our door at 1:00. My husband was home and instead of turning the agent away, he showed the agent and her client the home explaining all of the items within the house.

After speaking with Shari on the phone the same day she indicated to me that she would contact my husband and stated that she did try to call but no one answered the phone. I indicated to her that he was probably showing our house, since she wasn't there, which was promised to us that we would never have to show our own home, and that she would call back in 20 minutes. This also never happened.

She contacted our house today and my husband asked her why she never followed up with him yesterday after the showing. She stated that she tried to call, and remarkably my husband stayed extremely calm, and simply stated to her that that was untrue and that he was home all day yesterday and the phone never rang, nor did we have any kind of message on our answering machine. Her response to him was that he didn't hear the phone, even though there are six phones in our home. Apparently she did not like being put on the spot or caught in a lie, so before she could get another sentence out my husband stated that he thought her actions from the previous day were unprofessional. She said in the exact words "It could all end right now". So my husband asked for either the owner or sales coordinator, Michelle, neither of which were in the office. As usual.

My husband then called Michelle's cell phone and was told that she was in a meeting, to find out what was to be done about what happened with Shari. He was told that she was in a meeting and to give her a half hour and she would get back to him.

Almost 1/2 hour to the minute the owner, Charlie, called my husband from a cell phone and said that there will be a release of the real estate contract prepared because he will not tolerate my husband abusing his sales associates. And when questioned what was he talking about he would not be yelled at or he would hang up on him. My husband never raised his voice.

After almost six months of nothing but disappointment and false information, my husband and I are now willing to withdraw from the real estate listing agreement made with Weichert Acclaim. It seems that all they wanted to do was tie up our listing with the hopes of making some money. I don't believe it was ever their intention to sell my house due to the fact that no matter how much we asked for input and information as to why it wasn't being sold all we got was the run around.

If you ever sell your home, don't use Weichert Acclaim. They are rude, lie to their customers, and everyone with the exception of the receptionist have a bad attitude. Thank god they didn't sell our house, lord only knows how many other surprises there would have been.

When you list a house with a Realtor. the Realtor will go over a marketing plan with the seller and discuss how he or she plans to sell the home. Weichert has an excellent system for this. A Realtor does not get paid unless the home sells so he or she wants to hold open houses, advertise the property, and sell it.

When a property is listed, a professional is in charge of marketing the home. The owner needs to quit micro managing and stay out of the process. If the home is not advertised or if it is apparent that it is not being promoted, the seller should contact the Realtor or Broker but once you have listed a house then follow the directions of the Realtor; stay away during showings or open houses; don't make personal comments to a prospective buyer, and let the Realtor take charge. Assume that you are going to have to be inconvenienced during showings and you will have to keep your house clean and clutter-free. Your personal wall of baby and family photos should be packed away. You want the buyer to concentrate on the house, not Cousin Tilly in her bathing suit.

It is better if you aren't visible. Prospective buyers are leery of making negative comments about the house in front of you; you could remind them of their Uncle Fudd who they detest, and the whole scenario is strained. Let the Realtor sell your house. If you have a problem with progress discuss it with the Realtor and/or the Broker.

Sounds Like You Demanded Too Much!

It sounds to me like you were demanding that the listing agent be present for all showings?

That's NUTS. The buyer's agent is more than qualified to show the house, and there is NO REASON WHY you or your husband needed to "do your own showings."

Of course the agents should never have promised that they WOULD be present for all showings. They also should not have lied about the phone calls.

BUT... If I were your agent and you demanded that I had to be present at all showings, I would have handed you a release from the contract.

Having the seller or the seller's agent hovering around inhibits the buyer's ability to feel at ease in the home and thus imagine themselves living there. As has already been stated, they feel pressured, or like they are intruding.

If you want to sell your home, the first thing you need to do is RELAX and LET GO of it. Let the other agents do their jobs. And a $10,000 price reduction in this market is hardly worth blinking at.

Trying to sell an overpriced home in this market that is difficult at best to show is nearly impossible in a buyer's market.

I am a realtor in California for the last 15 years, have helped many clients buy and sell homes. The best way to sell a home is to let the agent and the company you hired do their job without micro-managing. The seller should rely on what the agent suggests. If your agent says lower the price, do so at the price she suggests. Please allow the agent to put a lock box on your home so other cooperating realtors can show it without you or the listing agent being there. The buyers want to feel comfortable looking at your home and want to say what is on their minds to their own agent. When you or the listing agent are in the house, or waiting outside, they feel pressured, and will not stay in the home long. And really in this market, there are other homes to choose from with easier access. You may have a wonderful home, and feel so close to it. Then maybe you should stay there. The sellers should distance themselves emotionally from the home they live in BEFORE listing it. It becomes just a house to them then. You are on display at all times when your home is listed and should be ready to show at the drop of a hat. Especially in this market.

So because your pile of sticks and bricks on a piece of dirt isn't getting the bidding war you fantisized about, its the realtors fault. Apparently you feel they should drop everything and focus on your house that they know is overpriced and, frankly, a waste of their time at your wishing ( asking ) price. The proof of that is Charlies eagerness to ditch you as a client. Real estate is entering a pronounced slump. Time to face reality and lower the price untill it sells or stay put. Those are your choices.
