Landlord illegally took my deposit and missed statutory deadlines for notification of same. Landlord did not meet the time requirements of Fla. Statute 83.49(3)(a), for claiming damages against my deposit AND illegally charged me for what statutes define as "normal wear and tear" for which landlords may not impose a charge.  Specifically:

1. landlord missed the 30-day deadline to notify me of their INTENTION to impose a claim on my deposit. I signed a notice to vacate on 8/3/2015, provided a forwarding address and received a refund check of $40 on 9/21/2015 (18 days past the statutory deadline).

2. landlord did not allow me the 15 days provided by law to respond to said claim.

3. landlord simply mailed a check which I received 48 days after I signed notice to vacate.

4. landlord charged me for "normal wear and tear" as defined by statutes (listing as "damages" cleaning, painting and carpet cleaning) even though the apartment was immaculately clean. They also did not honor their commitment to give me a chance to clean or correct anything that might have been charged against my deposit.

5. They also charged me $10 for a late fee they had verbally told me they were waiving because they could not determine why it was on my account, even though I had never been late in 3 years.

6. I sent a certified letter on 9/24/2015 which was signed for on 9/28/2015 notifying them of all of the above and protesting their claim on my deposit as required by statute and received no response.

7. I called many times asking to speak to the top manager, Tracy, but was never permitted to speak to her.  The millionaire owner, Jeffery W. Wells’ contact information cannot be located.  I was finally called by apartment manager Amanda on 10/14/2015 and told that charging for cleaning, painting and carpet cleaning was their standard procedure (as if that made it legal). When she realized that she could not win the legal argument, she accused me of yelling and refused to discuss it further or refund my deposit.

8. I can prove that the date of receipt of notification was not in compliance with statutory law, which automatically forfeits their claim on my deposit as stated in the statute.

9. I have documentation that they illegally charged me for "normal wear and tear" as defined by Fla. statutes, labeling routine cleaning, painting and carpet cleaning as "damages" in their statement of charges.
