Wells Fargo Bank Four months I deposited a check in the amount of 1550.00 it cleared with no problem at almost four month of the check being cleared an me using it I went to check my back three fridays ago to find that my account was overdrawn 1550.00  Altamonte Springs Florida

they kept my pay I went to the bank and they said the check was returned the banker asked me if I returned it I said why would I do that when I dont own any checks dont know nothing about checks she called the help desk they talked to her I really don't know what all was said all I was told is that either the checked didnt clear on his in or he disputed it with his bank but because it was pending they couldnt tell me much I fought with them for three weeks about this every time the reason changed this friday after they kept yet another check I called back got transfered from one person to the next each time I was told something diffrent then they put me on the phone with a woman an then it was the check was fraudulent an that they loaned me the money till it cleared on his end I have never heard of any bank loaning money till it cleared from where ever the check came from I am so mad an dont know what to do 

four months ago now I deposited a check in the amount of 1,550.00 in to my checking account with wells fargo. it cleared before I took it out of my account I asked the bank so their was nothing wrong with the check. the banker said no everything was fine the check cleared with no problems. I said ok so I slowly took the money out of my account. then three weeks ago on a Friday I went on my phone to chrck my accout to see what my check was to see that I was overdrawn 1,550.00 and they kept my paycheck I went stright to the bank to talk to a banker to see what was going on. I sat down with a banker she said the check got returned I said by who and almost three weeks later she said it wasnt you? I said no I dont have checks.

Why would I return a check that I cant afford to pay back I have a three year old son and a one month old that just passed away I cant afford. she said because it was still pending there was nothing she could tell me.So I waited kept calling them got hung up on by a tech support person and a manager. they have kept three of my paychecks so far I have filed a claim on the money. I called them friday the 9th of september an got transfered from one person to the next all telling me a diffrent story of why the check was returned then they put me on the phone with the person over my claim an she said that the money was loaned to me till the check cleared then she said that the check was a fraudulent I said almost four month later an why am I being charged I didnt write the check I am not the one who cleared the check she then told me to file a ploice report. I have been so stressed I dont know what to do I have no money because of this bank. I am praying someone can help me get my money back..

The employees at wells fargo are the ones who got sandbagged by the top big dogs at wells fargo. They made them open the fradulent credit card and checking accounts. The employees did it and they still got fired I mean sandbagged while the higher ups at wells fargo still have their jobs. And they are given $95 million to someone over the department who was in charge of opening the phony accounts. They should not get that kind of money.

 

Why does one person deserve so much money for being a criminal. It was organized crime at wells fargo. They was throwing their weight around by closing peoples checking accounts, and not telling them. They would get embarassed when they tried to purchase something because they didn't know their accounts had been close.

 

WELLS FARGO IS EVIL.

 

Wells fargo former employees have come foward saying wells fargo, was a hostile work envirement.  I believe it.

You received a check in the mail from someone you don't know.  Most likely it was a "Customer Service Evaluation" where you would go to one of the "Big Box" stores and buy something and report your experience.  You would then also need to evaluate Western Union and to do so they want you to send them a good portion of that $1550 to one of their managers.  Where for what amounts to a little more than an hour or two of your time they are going to allow you to keep what ever you bought and another $200-$300. 

Or perhaps you sold something on a site and "by accident" they sent you too much money.  Where to make it easy they said to just go ahead and send them the difference back.

Well guess what...this is a SCAM that has been around in various forms for decades..yes I remember getting checks like this back in the 1990's.  Let me just say that right off the bat you are very lucky you are only overdrawn.  As what you have done is considered fraud and for that amount of money many banks will prosecute if you don't return the money.

Now, I bet you are asking "but why am I responsible".  Simple...when you deposit a check you are presenting it as valid.  As such you take full responsibility to that bank if it comes back bad.  Now, if it was a legtimate person/company you in turn would go after them for giving you a bad check.  But in this case these people are not even in the US and every bit of contact information they gave you is 100% false and by now totally inactive.  So you have no one else to go after..therfore you become responsible. 

Also, when a check "clears" that doesn't mean it is good.  As you found out it can be reported fraudlent many months after it was deposited.  By FEDERAL law a bank must relesae the funds after a certain amount of time(generally a couple of days, but never over 11 business days).  That is what these scammers rely on.  That you get the funds before the account holder reports the fraud. 

So sorry to tell you this but you are not going to see that money again, and unless you can work out something with the bank your troubles are just beginning.  You may want to see if they can put you on a payment plan where you pay back so much every month.  At the very least if they are withholding your paycheck you may want to think about changing banks.  But with the realization that if you do that and they are getting no money they may start to pursue other legal means.  So a call to an attorney may also be in order.

As for future reference...unless you PERSONALLY know who you are getting a check from..NEVER accept it.  Especially if they ask you to return even a dime back to them. No matter how convicing they are...because it is a SCAM.
