August of 2012 I went into the Wells Fargo in Henderson Nv where I bank. Refinanced my car for a lower monthly payment. Made all my payments on time, until March and April 2013 when I made a human error. I am 80 yrs of and have a cataract in one eye.I made the mistake of making out the check for those two months for 117.00 intead of 167.00.

In April 2013, I started getting phone calls from the collections dept of Wells Farg Auto Financing telling me that my account is in collections. I was shocked and tried to explain what had happened and that i would try to make it up in the next few months. She said that if I didn't send in two pmts that month before a certain date that they would be charging me a 39.00 penalty. I begged her not to do that and can't we work on some solution by paying more in the next two months or so. Not good enough they wanted to keep charging me the penalty, plus the high interest rate (26%)-----------

 

The phone calls continued with the rude people threatening me with my account is in collections. I called my banker crying and he did not want to do anything about it. After many calls to him he finally called the finance company and told me if I made one pmt of 235.00 that my loan would be current. Again he lied. They sent me no statements until Aug 2013, the first one I got stated that I need to pay almost 400.00 (two pmts for the month of Aug) 

 

I am on social sec. and cannot afford this. I am in the process of trying to sell my car before they take it away. There is a buyer but we need the title to be sent to the bank here in Henderson, by Mon. Aug19th to make the deal. One banker said that it can be sent overnite, and the other bankers tell me not so, it will take 4 days at least. If its not here by then , the buyer will be gone to Europe for 30 days and I lose the sale, can't make the almost 400 pmt and might lose my car. 

 

I am just sick about this and would like to sue them, but no money for legal fees. The phone calls continue. I call them and the first thing they say is "your account is 26 days late" I tell them it is not late. I have made all my pmts just that two of them were short that totals 100.00 and my statemenet shows I owe almost 400.00 for this month. 

 

I really need some help. I do have high blood pressure and my readings have be very high, I do take medication but it won't help me because I am in a contant state of panic, and frustration and losing a lot of sleep. thank you ---------maybe this letter will let the public know not to do any business with Wells Fargo--------

If you cannot be helpful or supportive you should not reply to someone's issue. Especially if you do not know all the facts. Stereotyping and attacking someone only makes one appear to be lacking in education.

Another issue is the lack of respect for one's elders these days. I am only in my early forties but I see persons younger than me with no morals or respect for their elders.

  I do wear special glasses that are approved by the DMV

- Well perhaps you should now start to wear those glasses when you are paying your bills to avoid writting the wrong amount.

Why not search the records on how many court  cases have been filed against Wells Fargo for exactly the same problem. There is a case that Wells Fargo is appealing in court right now. Check it out BoBo.

At least I don't drive drunk like I'm sure your age group does

- Aw back to the "temper tantrum" and "name calling".  I am not lumping every person in their 80's into your group.    You actually don't even know what my age group is.  Am I in my 20's?  30's?  40's?  perhaps I am even in my 60's?  But it doesn't matter what age group I am in I am sure that there are people who drive dunk..so on that point you are correct.  In fact when you get to older groups you may get even more because they think they have had enough experience that they "know" their limits.  But you missed one key point by making that statement...this has NOTHING to do with you writing down the wrong amount for your payments.

Oh and in case you were wondering this is the same advise I would give to my parents or even my grandparents..if any of them were still alive.

Caveat emptor when this this report. The OP is a straw man as well.

Now, the author knew that the excuses used in the original report are lies, he/she could not back up his/her other "facts," so he/she had to distort the story by swaying it. Too bad.

 

"There is a case that Wells Fargo is appealing in court right now. Check it out BoBo."

 

And is that your case? If so, good for you and I wish you good luck; otherwise, it is irrelevant.

That's when someone throws a tantrum by insulting others because he/she got caught. Even though it is true, it does NOT make the other "facts" in the report disappear.

 

"One last thing you menition that I act like an "8" yr old. Well here is my challenge to you as a person acting like an "8" yr old. I will take you on any tennis court, ski mountain, or golf course and challenge you -------and I will bet that I will win."

 

Irrelevant... I hope and wish you get what the person means. I know you will get it if you think hard becuase you are educated. And oh, if you lose what other tantrum or excuses are you going to give? Actions worth more than words.

I have never done any drug in my life, so I guess you are an expert in that. That's why you know what they are and expect others to do the same?

So common comment for any generation. The answer is may be or may be not. You should also ask others to smell you too because you get used to your own smell and can't tell bad from good.


The bottom line is, your report is full of excuses. If you simply state ONLY what happened instead of pull all other stories to get sympathy from readers, I would completely agree and have no objection about how the bank is toying their customers. However, you go on and on with multiple irrelevant excuses/stories, it makes the report looks like a fiction. Also, attempting to sell a car because you KNEW it would likely be repossessed instead of go all the way to resolve the issue illustrates who you are. Other people are not as stupid as you think.

I really hate to correct my elders..but you are an 80 year old..acting like an 8 year old.

First of all in your 80 years I am sure you have learned what a contract is...and that when you refininanced your loan you made a legal agreement to make a specific payment for a specific amount of time.  Your monthly payment does NOT change and Wells Fargo(as well as other companies) have heard the "I accidently sent the wrong amount" from people who made no accident.   The fact is that they gave you the opportunity to "make good" without any penalty by sending the back amount by a certain date.  There is NO reason if you truly had the money that you could not have done this. 

So what is your reaction....the first thing you want to do is sue them for being rude and basically not giving you time to pay them on your schedule.  Well.even if you had the money to sue them..your court case would last about 30 seconds before the judge throws it out.  On the plus side..by that time Wells Fargo would have probably reposessed your car and sued you that the judge may just handle at the same time saving you a 2nd trip to the court house.  On the negative side..you would loose that case.

By the way...it is very unbelieveable that you have some buyer who is in such a rush to buy the car that he wants the title before he goes to Europe for 30 days.   What exactly is he going to do with the car 5000 miles away?  There seems no reason if this is legitimate that waiting the 4(or so) days before you get the title is fine...because he is gone for 30 days.

Also..just some friendly advise.  If you are 80 Years old and making a claim that your Cataracts caused you write the wrong amount.  One also has to think about how safe it is for you to be behind the wheels of a couple thousand pound vehicle that in the wrong hands can be a deadly weapon.  Not only for the people around you..but you as well.  So in a way I really hope you do push it and if you bring enough attention to yourself you may have someone close to you start thinking about this.

You inadvertently wrote two checks for $50 less than the correct amount so that indicates that you have the $100 to send them. Did you send them the money to offset the error? Apparently not, because you requested an additional two months. That was four months ago. Your loan is in default and you have no grounds for a lawsuit.

My response to the nasty person about my complaint about Wells Fargo Bank in Henderson NV. Looks like I hit a nerve with you. After insulting me I hope you feel like a big  person. 

So sorry that you never had a mother that you respect. 

You are a bully, a mesogonist ( woman hater) that gets his kicks by insulting women. 

Enough said about you------don't want to waste my time and take away from your hookah. Thank God we still have the freedom to speak our minds.

its money you owe...

 Its money that you owe them. How can you beg them for mercy?? You cant. You owe them this money, pay it off and you wont have to worry about your blood preasure. I can understand if funds are tight. But had you budgeted correctly you would have had that $100 aside. This is business. It is no longer the "friendly" business that you may have grown up with. Ppl like you are the very reason thaey have to keep calling. Youre boohooing and crying expecting them to take pity on you for your age. It wont work. This is a simple business issue. Handle it as such. They cannot and will not "work with you". Thats part of why we have this to deal with. To them youre just a deadbeat that owes them money. Nothing more.

Also when you dont pay the full amount, the bank is allowed to charge you interest on what you didnt pay. This interest is whats costing you so much.
