I lost my job in Oct 09 & Wells Fargo offered us a loan modification to help us get back on our feet by skipping 3 payments & then paying 3 trial payments calculated to fit our income. I called 2-3 times a week checking status after we made the 3 trial payments & did all that was asked & was told by different people each time that everything was going fine they were just a little behind & nothing was needed from me. I even left the loan processor 3 voicemails asking status on the modification & never heard back from her (Maria Reyes). The day after one of my calls I receive a call from loss mitigation telling me the modification was denied for failure to return requested documents.


I NEVER RECEIVED ANYTHING- The man stated "oh it doesn't look like any papers were mailed out to you so I will put the account on a 15 day hold for you so you can send us your updated income & expense reports." Then all the harrassing phone calls begin & within 1 week I had received over 20 pieces of mail threatening to foreclose. I sent them the papers & they told me the loan was taken off default status & in review once again. Meanwhile, my self-employed husband was in a severe car accident in May & he was out of work for 4 months. We were still making payments & was borrowing the funds from my mother to do it. Now they tell me that we do not qualify? I was furious & demanded to talk to a supervisor & file a complaint against Maria Reyes for not doing her job & requesting documents or calling me back.


Two weeks later my house floods from a power outage & my sump pump wasn't working. We had sump pump copverage of 5,000 maximum & received a check for that made out to us & WF. They have now held on to the funds & are jumping me thru hoops on my husband's business contracting the work because the property address can't be the same as the company's address (home based business). We were not able to meet their requirements nor hire anyone to do it with just $5,000. So the only thing left to do was apply the funds to our past due balance which happens to be 5295.00. I told them we had no other alternative & they sent the request in to apply it to the loan. After this conversation we took the funds that were intended for the Aug payment & paid our cobra fees & truck payment. This would get us on track, mortgage only 300 behind & we would do the repairs ourself over a few months.


Two weeks no calls received so I call back t find out that the request was denied. I was now approved to do the repairs myself but they needed to send a request for self-contract documents to be sent out to us. 24-48 hrs for the request to process & 7-10 days for the mail to go out to us. Outrageous!! Now I have papers they want notorized & sent back in order to get 1/3 of the money to start repairs, WHICH WE WERE GOING TO SEND RIGHT BACK TO THEM FOR THE MORTGAGE & PAY OUT OF POCKET FOR REPAIRS THRU THE BUSINESS.. I got this eerie feeling not to send them back these papers & looked up & shockingly found all the complaints against WF for the exact same modification program problems we were having. Now what do I do? They have a 5,000 check & we are 5295.00 past due & I'm afraid if I send them these papers that they will start foreclosure process. The papers are giving them full access to my home owners claim and all access to the contractor. Who happens to be my husband. I have $30,000 in equity in my home & I can't lose it, my husband is back to work but it's impossible to get caught up at this point on all our bills, even with me drawing unemployment. SOMEONE PLZ TELL ME WHAT TO DO TO KEEP MY HOME & CAN THEY LAWFULLY HOLD MY INSURANCE MONEY & DRAW INTEREST ON IT TOO? THEY HAVE DONE NOTHING BUT MAKE ME JUMP THRU HOOPS & STRING ME ALONG. IT SEEMS AS IF THEY ARE STALLING FOR SOME REASON.

File a petition in federal or civil court.. You must call the courts now..If you wait they will take your house.  The court clerk will tell you the paperwork you need, they will not give you legal advice.

CAN WF FORECLOSE WHILE THEY HOLD 5000 INSURANCE CHECK?

CAN ANYONE TELL ME IF WELLS FARGO CAN FORECLOSE ON MY HOME (WHICH IS 4 PYMTS PAST DUE OF $5295.00) AS LONG AS THEY ARE HOLDING MY PROPERTY LOSS CHECK OF $5000.00? THEY KEEP JUMPING ME THRU HOOPS & SAID WE COULDN'T SELF-CONTRACT THE WORK BECAUSE OUR HOME BASED BUSINESS OFFICE IS IN OUR HOME & THAT THE ADDRESS ON THE W-9 FOR THE BUSINESS CAN NOT BE THE SAME AS THE PROPERTY ADDRESS. THEY INITUALLY SAID WE COULD DO THE WORK, THEN WE COULDN'T & THEN SAID THE ONLY THING WE COULD DO WAS CONTRACT THE WORK OUT TO A DIFFERENT COMPANY OR PROVIDE THEM WITH ANOTHER W-9 LISTING A DIFFERENT ADDRESS FOR MY HUSBANDS BUSINESS. THANK GOD WE I BOUGHT ADDITIONAL SUMP PUMP COVERAGE ON MY HOME BUT THE MAXIMUM COVERAGE WAS ONLY $5000. WE HAD A COMPANY BID ON THE REPAIRS & HE GAVE US A QUOTE OF AROUND $14,000 & REQUIRED HALF THE MONEY UP FRONT. SO I CALLED THEM & TOLD THEM WE COULDNT HIRE ANYONE & I WASN'T GOING TO FALSIFY ANY DOCUMENTS & ASKED WHAT WE COULD DO. I WAS TOLD: "UNFORTUNATELY THOSE ARE OUR GUIDELINES & THEY WILL NOT MAKE ANY ACCEPTIONS." I CALLED BACK THE NEXT DAY & ADVISED THEM THAT WE WERE UNABLE TO MEET THEIR REQUIREMENTS TO SELF-CONTRACT AND WE DIDN'T HAVE THE FUNDS TO HIRE ANYONE ELSE TO DO THE WORK. THE ONLY OPTION LEFT AT THIS POINT (ACCORDING TO THE PAPERWORK) WAS TO APPLY THE FUNDS TO OUR PAST DUE BALANCE, WE WOULD MAKE THE REPAIRS OVER THE NEXT FEW MONTHS & CALL THEM WHEN WE WERE DONE TO COME & INSPECT THE PROPERTY. THEY SAID OK I WILL SEND THE REQUEST OVER TO HAVE IT APPLIED. ONLY TO FIND OUT 3 WEEKS LATER THAT THAT WAS ALSO DENIED AND WE WERE NOW APPROVED TO DO THE REPAIRS BUT NEEDED SELF-CONTRACT PAPERWORK FILLED OUT. AFTER SIGNING THEM & GETTING THEM NOTORIZED, I FOUND THAT ONE OF THE GUIDELINES YU HAD TO MEET WAS TO HAVE YOUR MORTGAGE CURRENT DURING THE REPAIR PROCESS. HOW CAN I DO THAT, IM IN THE MIDDLE OF A LOAN MODIFICATION? SO I REFUSED TO RETURN THE PAPERWORK & TOLD THEM I DID NOT TRUST THEM. I THEN TOLD THEM WE WERE DOING THE REPAIRS NEXT WEEK & I WOULD CALL THEM WHEN DONE TO INSPECT. THEY ARE SCREWING WITH US & ARE DEMANDING THAT WE SHOW THEM ALL THE RECEIPTS FOR THE MATERIALS. SOME OF IT MY HUSBAND HAD LEFT OVER FROM A JOB & SOME WAS DONATED. WHAT CAN THEY DO IF I CANT PROVIDE RECEIPTS? ONCE IT IS COMPLETE, THEY SHOULD APPLY THE FUNDS TO MY MORTGAGE BALANCE CORRECT? IM NOT SURE WHAT THE LAWS ARE, I HAVE CALLED EVERYONE IN THE COUNTRY FOR ADVICE BUT NOBODY KNOWS IF THEY CAN FORECLOSE AS LONG AS THEY HAVE THE INSURANCE CHECK FOR ALMOST EXACTLY WHAT THE ACCOUNT IS IN ARREARS FOR? I CANT AFFORD A RETAINER OR FEE TO MEET WITH AN ATTORNEY LIKE THEY REQUIRE JUST TO GET THIS QUESTION ANSWERED. HELP!!!!!!
