I have direct deposit payroll set up with wells Fargo bank. For the past 2 years The deposit was immediately available once my company issues the check.

Last week I received my email confirmation that my check had been deposited. Believing that I had access to those funds as I have always had in the past two years, I made approximately 4 purchases using my bank card. Two days later an email alert was sent to my email for Wells Fargo stating that my account was overdrawn and I might incur overdraft charges. I immediately checked my bank account online a discovered for no reason I can imagine they had placed pending on my paycheck. This caused my last 4 purchases to overdraft my account which the bank charged me $35 for each purchase.

Foolishly I thought walking into the bank a showing them what had happened they would apologize and reverse the charges. Once there, I explained what had happened and the branch manager said she would not reverse the fees and began to lecture me on how I spend my money! I asked her about the pending placed on my check which she answered by saying some customers prefer this and I never specified thT I wanted my money available immediately.

I will not go Into details on how she treated me, but I will say I have never been treated so poorly by a merchant or manager of a business in my life. She then told me she would be closing my account immediately. Stay away from this bank. They behave like criminals and seem to practice at best unfair banking. I believe the late charges accessed is theft, and I will treat it as such while I purse this. The manager's name is Dulce Ruiz at the Parmer and Scofield Austin tx branch.

Understand that if I went into every single detail about what happened last week it would take several pages to write. To summarize, my check was sent to the bank as always early tuesday morning. I used my debit card (my falt I should have looked at the balance on the wells Fargo web page first) which sent my checking into a negative balance with several overdraft fees becaus as result of the check being posted as (p) for pending. I thought if I went to a branch in person I could settle some of the fees. The bank manager was very rude and said, "the problem is not the fees the problem is you cannot manage your money properly". I asked for my card back but she took it and went into one of the bank's back rooms. When she returned, she said that she could not help with any of the fees and she was going to CLOSE my account that day.

I am typing this on my phone because my computer stoppped working several weeks ago. I am not a lawyer, I was a psychology major, but what happened to me feels a lot like theft. I agree that the actions of the bank and branch manager do not add up, but unfortunately for me all of this did take place.

You didn't specifically say who "they" are,  so sorry if I took that as the Manager did this personally.

But then that makes even less sense because then you must be saying that their automatic process put this hold on.  If this was truly happening without a valid reason I imagine there would be thousands of reports of this happening..not one.

So there are a couple of other things.  You never mentioned the exact dates.  If the Direct Deposit actually was received after hours on Friday or the weekend then the next business day would be the next Monday so this is valid and in lines with the Funds Availability requirements.

Second it appears you are relying on the e-mail from your employer to figure it is in your bank account.  The problem with that is that there could be many issues not related to your bank that may delay the actual posting.  So you should verify that the funds have actually been received.  Yes you did it for 2 years without an issue, but if this is a case of some delay you could have avoided the overdrafts.

Also, I still don't see how she would just close your account out if there was not "rudeness" going both ways, or there are things you are not posting.

Unlikely but true

First, I did not say the branch manager placedycjrck on pending status. I had the pleasure of meeting her afterwards when l was attempting to fix the problem. Yes I agree it all seems unlikely, that is why I am upset enough to post on this web site. Believe what you want and put you money at a wells Fargo while you are at it.

Something is not quite right

First of all there is the Regulation CC(AKA Expedited Funds Availability Act) that banks must follow as to when they must make funds available.   A direct deposit must be made available no later than the next business day.  So I won't say it is not impossible, I just find it very unlikely that a branch manager would go out of their way to "hold" a direct deposit unless they had a very good reason.

I find it even less likely that they would then lecuture you on spending your money, treating so you "poorly" that you won't go into detail and closing your account if there is not some additional details you are leaving out.

Also, the laws regarding Overdraft coverage on Debit Cards changed a little over a year ago. So you would have had to physically "opt in" to overdraft coverage.  Had you not opted in, if you didn't have the money available in your account the purchases you made would have been declined.
