Seller on eBay: mitchelljayreiff had a Brand New, New, Never Opened, New in Box Olympus Digital Camera listed. No mention whatsoever in the listing that a dropshipper was being used nor that the item was REALLY REFURBISHED/RECONDITIONED 2003 model camera -- that's definitely NOT a new camera! That's FRAUD.

He also sold 4 other Olympus Reconditioned cameras to other buyers ... and a recent negative feedback from another buyer yet who received a USED Fuji 550 camera instead of the Brand New listed in the ad ... Mitch Reiff obviously told her it was a TYPO in the listing!!!

May 10th--Won a supposedly new Olympus Digital Camera:
(link deleted). Paid $213.25 immediately through PayPal. This listing for the Olympus Digital C-60 states "Brand New!" in the title; and Condition: "New, Never Opened" with "BRAND NEW IN BOX 14 Day Return Policy - Satisfaction Guaranteed!" in the description in rather large print.

May 13th--My Question of Mitch: "Hi there. Thanks for this tracking number. I see that it states Los Angeles, CA. Is this being shipped as a dropshipper item as I see you're located in Dallas, TX? Just curious. And it is new, right? Not refurbished."

May 13th--His reply: "Yes its new and from a distributor."

May 18th--I received the package through FedEx showing that the dropshipper was: WESHIP2U . COM, 1600 NAOMI AVENUE, LOS ANGELES, CA 90021 (111) 111-1111 -- That's an interesting phone number!!!

May 18th--My Message through eBay to mitchelljayreiff: "Mitch, as you know, I previously asked: ... 'Hi there. Thanks for this tracking number. I see that it states Los Angeles, CA. Is this being shipped as a dropshipper item as I see you're located in Dallas, TX? Just curious. And it is new, right? Not refurbished.' You responded 'Yes its new and from a distributor.' HOWEVER, the item arrived today, in a partially dented shipping box with the camera box stating Reconditioned + Refurbished Product 11/23/05--That is clearly NOT a NEW product or Brand New! as your listing clearly states. I will be consulting with my husband when he gets home this evening to get his input. No where in your ad did you state refurbished or reconditioned."

May 18th--Direct email to Mitch Reiff: "Mitch, As I mentioned in my previous email, through the listing on eBay, the Olympus camera is not Brand New! as you stated in your listing. It is a Refurbished Product and also marked Reconditioned. I specifically asked if it was "not refurbished" and you assured me it was brand new. The pictures I've attached are of the camera box.

Also, the shipping box was dented, as you can see in picture 3. I could hear the camera "rattling" around in the camera box--with all the other parts--in other words, it could have been packaged within the camera box to protect the camera better.

When my husband gets home this evening, I will be consulting with him to see how he would like to proceed with this matter.

Personally, I'm not very happy that you did not tell me the truth and that your listing is inaccurate."

May 18th--My Message through eBay to mitchelljayreiff: "Mitch, My husband says that I should return this immediately, plus send you a bill for $100 for the waste of my time. I want ALL my money back--including shipping--because you misrepresented the product. Plus, it would seem fair that you arranged to having fedex or ups pick up the product from me. I see you are a relatively new seller. This is NO way to build a reputable business by misleading your buyers. I expect to hear from you in a timely fashion with rectifying this issue."

Mitch Reiff did not reply to my emails.

May 18th--Advised eBay through Safe Harbor that item was significantly NOT as described. "Customer concern: I have emailed the seller to advise that I received a product that was NOT Brand New! but marked as Refurbished 11/23/05 and Reconditioned. He clearly confirmed that the product was brand new in an email to me before I received the product. I've sent him a picture of the camera box to show that it is NOT new."

May 19th--Opened PayPal Complaint--My Comments: "I did a lot of researching on eBay to determine which NEW digital camera I wanted to buy. I bought on eBay what I was told was a BRAND NEW, NEVER OPENED, NOT REFURBISHED Digital Camera. The listing stated: Item name: Olympus 6.1 Digital Camera with 12x Zoom - Brand New! Item number: 7616758978. Condition: New, Never Opened. (link deleted)

This product was misrepresented and I was even told, in an email by Mitch Reiff, that I would be receiving a New, not refurbished camera. I've sent several emails to the seller, who has yet to respond. I sent him also an email of 3 pictures showing the semi-crushed/dented outer shipping carton, plus pictures of the camera box with "Refurbished Product 11/23/05" and "Reconditioned."

And, a note that the camera was loosely put in bubble-wrapping at the bottom of the camera box and was rattling around next to the battery charger. In other words, not expertly packaged for a camera. I've requested that the seller arrange to have this picked up as I want to return for a full refund for a misrepresented product."

May 20th--PayPal--My comments: "Dear Mitchell Reiff, I am NOT look for shipment tracking information. You TOLD me in an email explicitly that I was getting a brand NEW Olympus digital camera. INSTEAD, I RECEIVED a "Refurbished Product 11/23/05" and "Reconditioned."

I do NOT want this product because I did not receive what I paid for. I don't want a refurbished / reconditioned camera. I want to return it immediately for full refund of my $213.25. If you can arrange for FedEx to PICKUP this refurbished camera, that would be commendable on your part. Plus, I'm awaiting a full refund."

May 20th--PayPal--My comments: "...I'm asking for returning instructions--where to ship this, if it is your DROPSHIPPER: Click2U.com 1600 Naomi Avenue Los Angeles, CA 90021 Or if it is someplace else. And I expect a FULL REFUND!"

NOTE: There were subsequent entries into the PayPal log, but for intents of this RipOff Report, the facts have been already stated.

June 3rd: PayPal finally made a determination on my behalf and emailed me to ship the package back to the seller at his Dallas, Texas address. PayPal did NOT advise to ship to Click2U.com [dropshipper] nor did PayPal or seller provide a RMA.

June 3rd: I prepared the package for shipping, USPS priority mail insured $213.25 + signature confirmation for a total of $12.95. I logged into PayPal to provide the shipment tracking information.

June 3rd: Mitch Reiff FINALLY copies me on an email acknowledging that he [or Melinda Carrington] has read the PayPal determination. His email: "We don't not accept any returned products without prior notification and provide our own RMA. NO Returns permitted after 14 days as listed in the advertisement. See line below provided via your webpage and the date ... This transaction has been reversed. We have no idea what her problem is but she received the product. Could have contacted us for a RMA within 7 days for a full refund or replacement. After 7 days there is a 15% restocking fee up to 14 days as listed in the advertisement. It is past 14 days, PayPal ruled in our favor one this once and held up monies for almost 30days now she files a claim again with no merit. When this product arrives it will be refused and sent back to shipper per information provide above via your webpage!"

June 4th: I called PayPal to alert them that the seller was threatening to REFUSE the package. Contacted eBay Trust & Safe Harbor dept.

June 5th: Seller FILED a UNPAID Strike against me on eBay saying that I did NOT pay for the item!!! Imagine that! I've not yet been credited.

June 5th: I called PayPal to advise package was being shipped as instructed and to let them know that now the seller had filed the unpaid with eBay. I then contacted eBay Trust & Safety Harbor dept. to advise them of the frivolous strike that the seller filed.

POSTED: Tuesday, February 27, 2007

I've never received a response from Mitchell Jay Reiff aka Mitch Reiff OR Melinda Carrington with regard to my requesting a RMA to return the refurbished camera that they shipped me telling me that it was BRAND NEW. In June 2006, a Dorothy Reiff had contacted me through eBay's dispute console to tell me Mitch had died. At first, I thought that was true, but upon contacting a few Dallas authorities, it was determined Mitch had moved quickly and was indeed quite alive.

This morning, 2/27/06, after going through my emails regarding Mitch Reiff, I decided to do a "quick" google search on the words: Mitch* Reiff. To my amazement, I found links which told me he was ALIVE not DEAD as I had suspected. I found him active on Stumbleupon and Smugmug. He's writing poetry to sell and has started another medical supply company. He's also selling digital cameras and other electronic products with a new website!

He frauded 6 or more customers on eBay and to my knowledge, he has not made it right. PayPal refunded a portion of my money, but not all of it. And, I mailed the camera back to him as instructed by PayPal.

I hope he is not continuing with his bad business practices.
