WEST LOOP AUTO BODY SHOP ripoff, Insurance scam including 3 parties State Farm Insurance, West Loop Auto and Enterprise rental car Fraudulent claims and auto repair and auto theft a big ripoff kept my car and will not return very fraudulent behavior, in a scam to collect money from insurance and consumers Chicago Illinois

My neighbor hit my car while driving intoxicated and did some damage to the body not any major damage but he was very nice and responsible about the whole ordeal. Any way we call police and got a report and my neighbor willie malone gave me his insurance card and advised me to contact his insurance co. (state farm insurance co.) which I did and they agreed to pay for repairs and the agent I spoke to whose name was Jackie advised me it would be faster and taken care or more quickly if I agreed to let her arrange for one of their machanics to repair my car, so I agreed to this and I asked her how long would repairs take because my car is my only means of transportation for getting to work. she said she would give me a loaner car and she would arrange everything for me and i did not have to go into office or speak to a claim officer all this she said she would take care of at no charge to me.

so around Sept. 20 th she called me told me she had spoken to their machanic at west loop auto and he was sending me a loaner car until my car was repaired so the machanic name Ryan called me at work and told me everything was arranged and he was sending me a car so he did just so,

but when the driver delivered me the rental car and picked up my car he asked me to sign a rental agreement and I said no because i could not afford a rental and explained to him that ryan had said that state farm was paying so the driver called ryan on his cell phone and let me speak to ryan and he informed me that I was just signing the rental agreement as only driver so i question again about signing the rental agreement ryan assured me that jackie at state farm had agreed to pay for rental and i could be sure i would not be charged because i did not have to put up any collateral or credit card information or money because state farm was paying the bill.

So I still question him and he said that if any one rents a vehicle they have to leave some deposit therefore thats that we are not asking you for any of this because you are not liable.

Now after holding my car for 2 months for minor repairs and after numerous calls now Ryan at the auto body shop tells me that he's been paid but just found out that state farm is not paying him for the whole rental and hes holding my car until i can pay the entire car rental.

But like I explain to ryan you are paid for your service what do you have to do with holding my car until Enterprise rental car gets paid. Then he told me because he put up the money for me to get a rental car and like i asked him why would you put a deposit for me you didnt even know me and i never agreed to pay you and he told me hes going to hold my car until i pay him even though hes been paid for his services and charge me $50.00 A day..

so i have been paying for a cab to go to work and this is so very unfair for ryan to hold my car even though hes been paid. I even threatened him with calling an attorney he told me call whomever you want you are not getting your car.

Your response sounds more of a defensive mechanism rather than the truth, I agree that Betty signed the paper that she is responsible for payment yet at the same time I believe that she was told that the other party who caused the accident would pay for the rental. Most Auto Insurance Companies realize that when a car is being repaired it takes longer than (30) days depending on how much damage the car substained yet this is why insurance companies only cover 30 days because they realize that the cost for a rental car is roughly 25-50 dollars a day and they dont want to pay for that!! that is obvious despite who's fault it is, I dont believe Betty didnt pick up her phone if this car was her only means for transportation and she renting a car she is very concerned on why her car is taking longer than a month for repair's alot of body shops get low balled when dealing with insurance companies, and they repair car's who pay cash first then when they get around to the other car they will repair it, regardless if the person has to waite 4 months, the insurance company and the auto body shop do not care, because there is no law protecting the person, meaning there is no law on how long a car should take to repair, alot of auto body shops intentionally leave repairs out so the appraiser can later return to the car to give another supplement check and know the repair will be delayed, but this was all planned from the get go, the auto body shop knew this damage was there, it's just that appraiser's only look at the damage reported so when they come back out they would never realize if the damage was done prior or intentionally so the auto body shop can make more money,
Betty take them to small claims court they will back down because they lied about having your number documented as called 4 times. if they cant prove it you win. They will make you a deal in mediation small claims court is about 150 dollars you dont need an attorney just document everything, you get the money back, go to the insurance and ask them how much time did the auto body shop say it needed to repair the car? then it's ussually standard 18 day's then you can say since they neglected to repair your car within the period of time you want rental reinbursement you were told the car would be repaired no longer than one month and since it took longer you are not at fault for the delayed and carelessness of the body shop....

AS THE EMPLOYEE IN QUESTION IN THE COMPLAINT, I FEEL IT IS NECESSARY TO RESPOND TO THESE WILD ACCUSATIONS. THERE ARE SEVERAL THINGS THAT BETTY DOESN'T TELL IN HER CLAIM. WHEN THESE HAVE BEEN EXPLAINED, IT WILL BE OBVIOUS THAT WEST LOOP AUTO IS NOT AT FAULT OR "SCAMMING" ANYONE.

FIRST, BETTY WAS AWARE OF THE FACT THAT, AS A COURTESY, WEST LOOP WAS COVERING HER DEPOSIT ON HER RENTAL. ENTERPRISE POLICY IS THAT ALL RENTALS, NO MATTER WHO IS PAYING, MUST HAVE A DEPOSIT. ALSO, ON THE CONTRACT, IS A LINE THAT MUST BE SIGNED BY THE CUSTOMER STATING THAT IN THE EVENT A THIRD PARTY (I.E.-STATE FARM) REFUSES TO PAY, THE RENTER IS RESPONSIBLE FOR ANY COSTS ASSOCIATED WITH THE RENTAL. BETTY SIGNED THIS LINE, ACCEPTING THE TERMS OF THE CONTRACT.

I FEEL THAT AS A COMPANY WE PROVIDED A NECESSARY SERVICE TO A PERSON IN NEED OF SOME HELP. UNFORTUNATELY, SHE DECIDED NOT TO HOLD UP HER END OF THE BARGAIN. TO FAULT MY COMPANY, FOR AN ACT THAT ONLY BENEFITTED THE CUSTOMER, IS A CHILDISH ATTEMPT TO AVOID HER RESPONSIBILTY. I HOPE THAT ANYONE READING THIS DOES NOT BELIEVE HER RAMBLING TO BE AN HONEST REFLECTION OF OUR COMPANY

SECOND, BETTY REFUSED TO RETURN PHONE CALLS FROM EITHER WEST LOOP OR ENTERPRISE FOR FOUR STRAIGHT WEEKS. THERE ARE LOG NOTES FROM BOTH COMPANIES OF DAILY PHONE CALLS AND VOICE MESSAGES THAT WERE NOT ANSWERED. THIS LOG IS NOT TO ONLY ONE PHONE NUMBER, BUT TO THREE. NO ATTEMPT WAS MADE ON BETTY'S END TO CONTACT US, EVEN THOUGH WE WERE TRYING TO LET HER KNOW WHAT WAS GOING ON AND GET HER OUT OF THE RENTAL UNTIL THE INSURANCE ACCEPTED LIABILITY. HAD SHE RETURNED OUR PHONE CALLS, SHE WOULD HAVE HER VEHICLE BACK AND THIS WOULD NOT BE AN ISSUE FOR HER.

FINALLY, BETTY DOES NOT OWE ENTERPRISE ANY MONEY. SHE OWES THE MONEY TO WEST LOOP AUTO. NO BUSINESS OWNER ANYWHERE IS GOING TO RELEASE A PRODUCT OR CAR WITHOUT PAYMENT OF SERVICES. WITH NO GUARANTEE OF PAYMENT AND NO EFFORT AT COMMUNICATION FROM BETTY, IT WAS NOT AND STILL IS NOT REASONABLE TO BELIEVE SHE WOULD PAY, WERE I TO GIVE HER VEHICLE BACK.
