Misrepresentation-Fraud-Theft-Lies.

They've stolen my money and countless others. Don't trust Darin Delgardo or his business. 

Here's the nitty gritty:

I purchased a fireplace from Enjoy Your Home's Fireplace Patio Shoppe, the owner Darin Delgardo sold me the unit and assured me that I would have it within 1 month. I wrote him a check for the entire amount. 

Well, 3 months later after being feed countless lies about the whereabouts of my fireplace, I was completely frustrated and had the intention of making one last call to cancel my order and demand my money back.

I received a recorded message about how they were in the process of moving from the Eastchester showroom to their warehouse in Elmsford. Something about losing their lease etc...This had me worried.

After leaving several messages I drove to the location at 369 White Plains Rd in Eastchester and found other angry customers stationed outside his door looking for their stuff as well. We exchanged information and agreed if any contact was made we would notify each other. 

I ended up getting the address to the warehouse in Elmsford through a contact I had at the town hall. I went up their, banged on the door- NOTHING! I went back on the internet, searched for them but noticed that what came up for the address at 9 Haven St. in Elmsford NY, was this Westchester fireplace and BBQ. 

I called the listed number and I pretended to want to buy something new and asked for Darin. He got on the phone and I began to question him about the situation and frankly, where the hell is my money!

Darin told me some story about how he and a couple of other services guys formed their own company. How he wasn't the owner of the Fireplace and Patio shoppe, how their were two Darin's and how the owner of the Fireplace patio shoppe's son committed suicide, coupled with losing his lease, forcing him to close the store.

I bought it for a minute.

I looked up the corporate records of the both Fireplace and Patio shoppe and Westchester Fireplace and BBQ and found that Darin Delgardo owns BOTH! I found out their is only one Darin. Fireplace and Patio shoppe is actually a DBA of 369 White Plains Rd corp. All this information is online. 

I called the landlord of 369 white plains rd, and he told he didn't lose his lease, but instead owned him a large sum of money as well, and he bent over backwards to help Darin out. He also confirmed Darin as the owner. 

I called the other people I met at the store and they told me similar stories. They said that Darin told them (secretly-like he was doing them a favor) to cancel their credit cards with Fireplace and Patio shoppe, and then had the audacity to ask them to re-order with this Westchester Fireplace and BBQ.  Claiming no connection between the two, and misrepresenting himself as not the owner of both. 

Here's another layer of out right fraud.
 
Since I paid by check I had to contact a lawyer. My lawyer said he is committing massive credit card fraud by telling people to cancel their charges. He is implying the liability of his crooked business practices rests on the shoulders of the credit card companies. HOW IS THIS MAN NOT IN JAIL?!

Truths

Darin Delgardo owns both, Westchester fireplace and bbq and Enjoy your homes fireplace and patio shoppe. 

Coincidentally, Westchester Fireplace and BBQ opened right around the time that Fireplace and Patio Shoppe closed their doors. 

Stay away from this company and this owner. 

If you've been a victim of Darin Delgardo, please do like me and contact a lawyer, the district attorney, attorney general, and police for that matter-I still think its credit card fraud is illegal.
