In March of 2003 I was diagnosed with an autoimmune thyroid disease. It took a year for the doctors to figure it out, during that time I became very ill.

Even though I am on treatment for this, I have periods where I become bed ridden. During this time I have fallen behind on payments to WFS. I am commission based, and paid once a month. I have always managed to catch my payments up.

This time I had two escrows fall out and am waiting for one commission check. I am two months behind. I left a message for WFS regarding this.

WFS sent a stranger to my door on 2/17/05 where my elderly mother was here watching my son. He wanted to hand her paperwork, but she was so sacred of him she refused it. He left a note for me to call WFS in my mailbox.

The letter read:

Date: February 17, 2005

Dear: Catherine H.

In an attempt to make immediate contact with yourself, WFS Financial has requested the services of Guardian Portfolio Services.

The purpose of this action is to encourage you to call WFS Financial within 48 hours of this notice.

I called the number twice within the 48 hours and left two detailed messages about waiting for the commission checks and their approximate arrival based on the closing of escrow.

Today, 2/28 I was sick in bed and someone knocked on my door, by the time I got to the door no one was there. I walked out my door down towards the parking lot and a man was going through my mail. He got back in his truck and left. It took me a bit to realize it was my own mailbox. There was nothing left for me in the mailbox - other than my mail. I am sure this is one of the Guardian Portfolio reps looking to talk with me.

Is it legal for them to touch my mail? Also, there are three Private Property Keep Out signs posted at this condo complex. Is it legal for them to be coming here? I only owe 4700 of an original 18,000k loan. When I bring it current in the next two weeks it will be less than 3700k on my Ford Ranger XLT. After reading some of the posts here I am worried they will repossess it now that I am so close to the end because the balance is so small compared to what the truck is worth.

I am thinking I should contact an attorney and see what my rights are at this point. I use my truck for work and it is the means that gets me to my client's offices.

Also, WFS calls my business cell phone all day during business hours. I cannot take these calls usually because I am sitting in front of clients in the client's offices. I have explained this to them on at least 7 ocasions. I understand my rights under the Fair Debt Collection Practices Act, but do those laws include collection practices from the company itself and not a third party collection agency?

Any advice would greatly be appreciated.

I know nothing about the loan company, and know how cut-throat they can be.  But may I mention that Gaurdian Portfolio is contracted as a "last reort" between loan company and client, as I understand it.  They come to you not to "strong-arm" you, or repo, but to act as a direct representative between you, and for you, and the company.  If he placed a letter and went through your mail, that is wrong.


But if you had talked with him, he would have explained his job, and how he could help you.  He would have made his report, explained your intent, and made sure that the "breakdown" in communication between you and the company would have been resolved.  Of course you would have had to keep your promise to the "tee" without excuse.  But had you done that, you most probably would have your car, and no stress concerning the situation.


Loan companies NEVER make money on a repo.  Regardless of what you owe.  Most people get a 4 year loan, and thru the whole time the car depreciates.  Paperwork, personel etc. eat them up on repos.  They are in the loan business, not car sales.  Most people that get behind, is in the last 2K of a loan, as the car is old to them, maintainance higher, and they think "have paid for the car, those crooks are getting blue sky".  Their business is making money off their money, not making people happy by buying them cars.  So a red flag goes up during that time.

Congratulations on your action. You instincts regarding this company are better than you probably realize. the are predatory. You should not quit ever. Understand that during these times governmental regulatory agencies are taking a backseat to the woes and victimizations of the average working American. you have the Bush administration to thank for that. The DOJ comes with a wimpy disclaimer touting that they are incapable of resolving issues for the average circumstance, yet they dance around claiming justice and the people being severed for stupid issues like coupon scams and mundane issues that are diminutively of little to no consequence.

What you have is a company committing consumer fraud and legally it is called "EXTORTION" WFS uses the law to break the law then they threaten you the consumer with their corporate stature and exercise illegal acts based upon that.

I to as of the date of this message to you have file a complaint with the California DOJ.

Additionally, I have referred them to your case to establish credence and credibility to the aforementioned. I would strongly recommend that you contact them and tell them of the case file in the Los Angeles office of the DOJ although all of the cases are ultimately sent to Sacramento for investigating it is really important to network on this.

I know I have spent the past 3 years investigation WFS and they are crooked. My mother had a loan with them when they were doing business as Western Financial Saving Bank. They lost their charter for anti-trust violations and predatory lending practices then later started WFS and Westlake Financial Services.

My situation is similar to yours. However I never got behind nor did I ever allow my insurance to laps and in fact I have as of Jan 2005 paid off my loan with them 6 months early I might add.

WFS turned my account over to a collection agency that I think is in bed with them. They are called Sure-Tech and a guy named Meza has been calling me to collect on the illegal insurance WFS added to my account.

I would also recommend you file complaints with the FTC and the OTS they both are panzy spinless agencies but do it if any thing just to put heat on WFS. contact me if you are interested in filing a class action. I am with the State of california DOT in Los Angeles.

On 3/1 they took the truck. Turns out i am only down 1 1/2 payments. There was never a notification regarding this proceedure.

The 800 number customer service is telling me that the Santa Rosa office IS their corporate office and refers all calls back to loan service counselers in Santa Rosa. I spoke with Sabina, who is supposedly a supervisor who indicates Michelle has not told her of my messages.

Michelle has three messages from me and has not returned my call. I have the figures to bring it current. This will happen with tomorrows commission check.

I again attempted to reach someone higher up in the Santa Ana office and they will not allow me to speak to anyone but the Santa Rosa office. I cannot get through to anyone above the sutomer service level.

I filed a report with the CA Attorney General's office. Will keep you updated on the outcomes.
