This is a letter I wrote to the Lt. Governor's office of Illinois. I blocked or altered some information of privacy.

Dear ***** ***********,

Thank you for your assistance in this matter, I do appreciate this. I have put together documents to fax to you along with this letter and thought by recapping in this letter it would flow much better.

The originator of my loan was Fremont Investment & Loan they sold the loan to Wilshire in November of 2004. We, my wife Leslie and I, received a letter from Fremont that Fremont would not accept any more payments as of Dec 1 2004. As of December 31st we hadn't received anything from the new loan holder so we called Fremont Investment & Loan. Fremont gave us the contact information and I was going to call them from work the next day. However we received our first communication from Wilshire in the mail that same day in the form of our first billing invoice showing a Dec payment and late fee and a current payment. I immediately called Wilshire; I was greeted by a very nice girl. I explained to her that I had to call Fremont to get information and was concerned about the lack of communication to us about them. She agreed and said it is very common problem. She told me that she would wave the late fee and discount the payment over the phone' fee in half if I could bring the account current, of course I agreed and did this.

The next problem was with the next billing, since the payment by phone was so expensive and without knowing what kind of company they are for automatic withdraw, I chose to use 'MY BANK' check payment system. It is guaranteed payment within 5 business days. I received a letter on the 19th stating that Wilshire had not received payment. My wife was home first and called. She stated that I handle the loan payments and that it should have been sent in, she said they were rude and that it posted to the account as of that day and that they were preparing to put in on our credit record if it was two more days.

My wife hung up and when I came home it started a fight, I showed her the receipt from the bank on using their system. I immediately called and spoke to **** @ 9:15 I explained to him the letter I received and he told me that my payment goes from me to Dallas and then to where ever the loan is serviced (PORTLAND). He told me it can take up to 7 10 business days. I told him that that was not right.

We shouldn't be held responsible for there slow processing, and that once the payment reaches Dallas I should be posted as paid. I was then hung up on. I return called and spoke with ****** @ 9:22 she was a lot nicer especially once I told her I was hung up on. She also explained to me that it followed that process and that this was a common problem. She said she would remove the late fees but this was the last time we could do this, I explained that this was not a good start with the new loan holder, she apologized and that was the end.

The next one happened late Feb 17, my wife and I were watching TV and the phone rang. I answered and it was Wilshire. The man on the other end was ****** and he asked if I had sent in my payment for Feb. My heart dropped, I thought not again. I immediately went to the computer and looked up my bank account to see if my check had posted. It hadn't. This is odd since I sent it priority mail (2-3 days). I told him that I had over two weeks ago. He then said for how much and I said for the full amount of *** something. He said well I have a posting to your account for ***.** (30 DOLLARS LESS). I said no, it was made out for ***.***. I checked on March 1st and looked at my check and it says in writing **** ****** ****** dollars.

I called my bank and explained to them the problem and it was taken care of, the person I talked to there was Tonya. I asked her what my responsibilities were in this and she said none, it was a failure by either 'MY BANK' or Wilshire. And that they would handle it on there side (MY BANK).

Well I got another call last night at 7:30ish March 1st from Wilshire. Name of person talked to is ******. She informed me that I still owed 30 dollars and that I was being charged late fees and my credit was at risk. I informed her that I saw the check and that it was written for the right amount and that I had called my bank and that they were handling the payment problem that they (WILSHIRE) started.

I explained how very upset I was during this whole 4 month period of having them and a loan holder. I sent my payment for this month priority mail with confirmation receipt. So I know when they get this. It costs me 4.30 to do this which is ridiculous, but I want to show that this is a scam and try to help my defense as much as possible.

Since this letter to the Lt. Governor's office. I have recieved a letter of default. I called to find out they hadn't credited my account for march, I have confirmation reciept showing payment delivered to Dallas address 4 days prior to the phone call. I am now looking into Class Action Suite or other legal options. If anyone is interested, please contact me through the rebuttal key.

Sounds like Attorney General Should be contacted

Looking at the other horror stories here, we can see we weren't the only ones. Wilshire "lost" 8 months of our 2004-5 payments according to our pay-off history. We have all cancelled checks to prove payment. Our original loan was for 65000.00 and we have had the loan since 1998 and their payoff quote was 85000.00 plus. Hmmmm. Talking does no good since the person you talk to today usually doesn't work for them very long and apparently no history notes are ever posted to the accounts. I would love for these crooks to get whats coming to them. Wilshire bought the account from Fairbanks Capital Corporation who were already in a class action suit for illegal fees, etc. Our settlement check for over 4000.00 in illegal fees...357.00 and they still didn't credit the account back the illegal fees...WHAT!!! If anyone does anything with this, my husband and I are more than willing to provide information, etc. for a class action suit against Wilshire. We have plenty of documents.

I am a Victim of Wilshire Financial like you.

I have had a bad experience with Wilshire financial like yourself. We refinanced our home in december of 2004 with Ameriquest Mortgage (another problem company). In May of 2005, my company tranferred me out of state. I had to sell my house. I put the house up for sale and then I received a letter in the mail stating that Wilshire bought my loan. I called Wilshire stating that the house was on the market for 115k. I owed 108k on the house. Ameriquest appraised the house for 120k. No one was touching the house at the price. In fact,the highest offer was $94,000. We contacted Wilshire and told them that we could'nt even get 100k for the house. They told me that they would do a "short sale". We needed to move and I wanted to continue my job. I filled out all of the paperwork for the short sale and waited. Well, after 2 months of waiting, I called Wilshire and they told me that they would'nt process my request. They sent thier appraiser and he said the house was worth 95k. This is 6 months after Ameriquests 120k appraisal. I informed Wilshire that the people that put in the offer wanted the house and I had to move. Finally, to make a long story short, I stopped paying on the house. I could no longer afford to keep it. Wilshire took it and I now have poor credit. I hope that Wilshire credit and all the employees in the loan workout department go to prison! They are scam artists. I will also be glad to be part of a class action lawsuit against Wilshire. I hope you like your new house Wilshire!

Well I wanted to comment on what has transpired since this post. I had retained an attorney, thank goodness with no cost to myself, and was preparing to file suit. None of my letters to the 6 officers were ever responded to. I couldn't send them certified because they only list POBoxes, how cleaver.

But through all the agencies and legal firms, you know what got their attention the fastest??? It was this original post on ripoffreport.com. I recieved a call for the loan division vice-president. I got the usual ,"this isnt our fault" kinda thing, "but what can we do to make this better?" They FORWARDED me the missing funds. First of all how can you forward me funds that you were paid. Anyways, they denied breaking the law with RESPA, go figure.

I have since gotten rid of Wilshire, I got an equity line of credit through my bank (no closing costs) and kindly paid them and told them to *#@^ off. My payments are 50% less. And the bank is 5 miles from my front door.

All I can say is from now on when dealing with companies that can destroy your future with misinformation and employing retards, tape record the conversations, and let them know you are doing so. This way there is no mistake on who is breaking the law! And you will have the best witness you can ever have that doesn't forget and can't get baught.

Wilshire will rip you off-They lie,steal and should be put in prison

Your in for a long ride down a dead end road. Ive been dealing with these people since 1996.And it doesnt get any better,just worst,I tried the same thing spending extra money to send my payments certified.But that didnt help either.It did get some responce though, I was yelled at and told not to do that any more.The lady that said that also questioned me as to why I was so stupied to send a certified letter to a postoffice box. Which my respond was so I know and you people know too when my payment was recieved,couse I was told once by a man there that the reson one of my payments was short was because they only cashed half my check.That was a big laugh.He even as much as told me to check with my bank on that.Where do they get them?Im sorry to give you bad news,but it really does get worst,I stuggle with them every month and will until I can find an honest attorney thats willing to fight for the consumer.Good luck, And if you hear of a lawsuit let me know,Ive got lots of evidents.Some I dont think they know they gave me.

Wilshire Incompetence

I have had the exact same problem, right down to my billing address that it took them 6 months to correct. Fortunately, I kept all documentation of my attempts. I'll be looking for similar problems as proof of Wilshire's negligence if I have to sue them, and would be happy to help others if I can.
