WINDSOR INSURANCE COMPANY denied claim for stolen vehicle citing that son was not listed as an eligible driver on initial application MELVILLE New York

I initially took out a policy for my only vehicle, a 1994 Ford Thunderbird, in April 2000. At that time I was the only driver in the household. In July 2000 I purchased a 1997 Mitsubishi Diamante and added it to my policy with full coverage. In October 2000 at about 1 AM, my children heard a car horn, they looked out the window and saw someone pushing the Mitsubishi off my driveway. They screamed at them and immediately called the police. They arrived several minutes later but the car had already disappeared. The police filled out a report and I complied with every request for information and documentation from Windsor. Their initial investigation took approximately three months.

In February 2001 I received a letter in the mail stating that Windsor insurance would not pay for the loss because "I did not disclose that my son was a possible driver in the household." I then was forced to get an attorney (Jeffrey Wasserman)who after three years said that he did not want to handle my case any longer because the courts were not looking favorably on these types of cases anymore. Now both the attorney for Windsor and the attorney for Spirit Agency (the broker who filled out the application) are looking to be dismissed from the case that had been initially set on the court calendars. I am frustrated and disgusted that insurance companies and their representatives can get away with ripping off consumers, and with such disregard.
