On May 30, 2007 I was sent a letter by Wolpoff & Anderson, L.L.P. claiming to represent Palisades Acquisition XVI,LLC, ASSIGNEE OF MBNA AMERICA BANK (Purchaser, who I have no doubt is one of their many solely owned shell corporations). They have demanded $30,671.68 against a corporate debt that MBNA charged off in 2002 and sold later, that I was, unfortunately, as an officer of a failing family business, (which I bought and owned from 1994) considered by our creditors as a Guarantor to the Debt [standard practice with ALL company credit cards]. The Statute of Limitations (3 years) has long expired on the original debt! I have prepared a written response to these crooks which I will be sending, certified-return-receipt, AFTER I retain a QUALIFIED legal counselor to represent me in this case.

This great Web Site, (RipOffReport.com) has been an invaluable source of information on Wolpoff & Anderson, L.L.P. and their many Subordinates (Cohorts in legalized Thievery AKA Crooks Incorporated) and many others I have reviewed on this web site! I give RipOffReport.com the highest accolades as it is THE BEST resource of information for someone being threatened by Predatory Collection Law Firms such as Wolpoff & Anderson, L.L.P.! OK, enough said, buckle up for the meat of the story you want to hear now!

Like a lot of new small business owners, I had done pretty well in the computer software industry, and when I departed, I HAD disposable cash to buy and hopefully improve the bottom line on the (2) business equipment companies that I soon acquired. I was expecting to do great things in a small town, providing a valuable service to not only the public, but most of the school systems, the city, the county, the Sheriffs Department and even the Highway Patrol (All under annual service contract). The unfortunate truth about owning a small business against the prices the Superstores offer, is, unless you want to work for free and live to pay salaries, benefits and mandatory City, County, State and Federal taxes for your employees and their families (which I did from 1994 to the end of 2001), you have to make command decisions sooner or later. I finally did! It was the most painful decision Ive ever had to make I closed the business and hired a law firm to negotiate with all of the creditors to come up with some kind of liquidation settlement Not one of them was willing to negotiate with my attorney, so I released him from our contract after over (6) months of expensive paperwork that came out of my own pocket, and donated the bulk of the company assets to a local Fire Department who really needed what I gave them (A little over $30,000 depreciated value [Validated with a written receipt and acknowledged by the IRS) Nevertheless, I should have filed for Bankruptcy at that time, but being a proud and stubborn person, I didnt. Bad Mistake! Now the vultures come out of the woodwork!

Last year, my wife was sent a similar letter from Wolpoff & Anderson, L.L.P. (One in the same) claiming to represent PORTFOLIO RECOVERY ASSOCIATES LLC ASSIGNEE OF MBNA against the one and only Personal credit card we had used to cover payroll expenditures. Being somewhat (Not) savvy in legal matters, I told her to ignore these people as the statute of limitations had expired in this matter. WRONG!! They, as they expected, got a Summary Judgment because we DID NOT follow legal precedent and DEMAND lost our legal rights, even though we sent them a letter denying any obligation to the so-call debt. The long and the short of this story is that they got the judgment, cleaned out our checking and savings accounts with no warning and Garnished her wages for nearly a year.

These crooks cleaned us out to the tune of nearly $20,000.00!! Here we go again Only this time forewarned, is forewarned!! The war is about to start, and I have ABSOLIUTELY NO INTENT of letting these legalized criminals win this time! If you have EVER been sent a collection letter by these crooks please follow through and make them pay dearly if it ever goes to court!

Final note I won against another one of these idiot firms out of Cincinnati, Ohio who tried to sue me over corporate debt. The Judge agreed with me that they had no right to a Telephone Trial The case was dismissed! A Telephone Trial is exactly what you Never Want To Allow at ANY cost you will lose by default every time dont do it! Final note: I monitor daily the local Court of Common Pleas to see if ANYONE is trying to sue me You should too!
