Ordered Xtream Media Server Pro-3800 Dec 23rd 2009 was told server would arrive Dec 39th 2009. Januray 12th a Dirty, Used,dented server without owners manual arrived.Immediately informed Xtream and they confirmed their error-They claim they sent us a consumers repair by accident.They said they would replace with a new Server and send call tag.As of January 27th they have done absolutely nothing & they do not return my emails or calls.Very unprofessional perhaps criminal operation

More lies  folk's

I never threaten anybody I did infact promise that I would Post my experience with this  horrible company on the internet & I have done just that

I purchased  the unit to evaluate it & to see IF it was something I could sell my clients.The rep WAS a friend and convinced me to give it a try and that we would have a working unit for my annual Superbowl party in My home.Regardless the server that was sent was sent after many excuses & Lies and  weeks late.Iam a consumer that happens to own a business that doesnt change the Horrific condition of the junk they delivered

It arrived in herndous condition and Xtream Media is a sleezy operation-That's a fact!

Since my first post I have received Three emails from three other disgruntled individuals that have purchased their Garbage anyone interested should email me I will fax , or email you their complaints but they are very similar.Defective merchandise,lack of customer service, people that have been ripped off by these people

Sorry I haven't been keeping up with Mr. McEvoy's complaints, but I figured now was a good time to check in.

He threatened us several times that he was going to post all over the Net and he certainly has done exactly that. I surprised he had the time for it, but maybe his wife helped. He usually represents himself as a consumer, which he of course is not. He's American Theater in

We were ready to do something for him, but the volume of phone calls and threats (including one physical threat) convinced the President to just leave this man alone. It has probably cost us a client or two, but sometimes you just have to say enough.

For the record, he has never ever been told that the Rep would have to write him a check. That's ludicrous on it's face, and everyone knows it. Also, there's no doubt that this was sold to a company and not an individual, and we have the paperwork to prove it. Kevin is also aware that if he is going to sue he needs to do it in California, as per his contract, and that he has no reason to sue the Rep under any circumstances.

And, if the unit is so awful, why is he calling it a 9 out of 10 on AudioGon.com? Here's the link, if I did it right:

Well, not a great link but I'm sure you can find it. Like I said before, Kevin is not slinging the whole story. He's mad; I get that. He's selling it on Audiogon, at a screaming deal, I might add. He's right that we aren't responding to him recently; no one needs that kind of grief.

Spoke with the owner of Xtream Media today to follow up on a check number and a call tag to pick up defective item/wrong item purchased back on 12/23/10.    Jeff told me that because we told our story here he will not be returning our funds of $2,258- In other words he feels he can ship an item that we did not order and keep our money  WOW   

If you plan to become a dealer or if you currently are I would beware because if they send you an item via ups that does not work they do not send you a refund they just keep your money.  We felt it was a shady deal when our local representative Richard Spanier came here picked up the check before delivering the item and deposited it into Xtream Media's bank account (Bank of America) here in Florida They are in California.  I asked again for a refund today and was told Richard Spanier has to return our money not the company.  Folks this has been a nightmare as a dealer I cannot imagine buying this product as a consumer.  Any dealer who would sell this please note that this company will not stand by you or your customer.  Do not make the same mistake we made Do not purchase from this illegitimate company.  All we did was state the facts if anybody would like to see pictures of what was sent to us i will be happy to share with any dealer or consumer.  Even the serial numbers were put on by a label maker the unit came in a box from a different company.  This company does not even have manufacturer boxes.  Beware.  As I promised Xtream Media if they return our money and pick up there Garbage I will be happy to post I received my money back....

LAW SUIT FILED AGAINST XTREAM MEDIA SERVER

We have decided to file a law suit against Both XTREAM MEDIA SERVER & their Florida rep who accepted the payment  in my home Richard Spanier.We will easily win and ask for all legal fee's. Anyone reading this please stay away from this horrible company.

STILL NO REFUND CHECK!

Well it's Feb 3rd or should I say Feb 3rd has come & gone with No refund  check in hand.Now the loser that owns Xtream Media Server ,  Jeff Asherbranner claims he will hand deliver a check next week ofcourse they are always delaying the Refund they have promised.


My attorney is ready to file a law suit agaisnt XMS If  there any attorneys reading this update and interested in a piece of this  Email me immediately.I have been informed that since they have admitted fault & said they would give me  refund & with alll the supporting emails I have that suing for legals fees is a given!

February 1st No check No call-Tag .Get this their representative now claims that Only the owner Jeff Asherbranner can sign a check & that takes six weeks wow their gross  incompentence gets even more obvious as the weeks pass!

Not much new information to report other then the fact that Xtream Media Servers still has NOT responded or to my attorney's demand for a full refund and .............. Ofcourse still No refund!

   I ordered it for me personally  as well as to Demonstrate to  my home theater customers.The  used, dented, dirty server, folks there are greasy finger prints all over it (just look at the pictures) was shipped & delivered to my home.Obviously My original post of Dec39th was a typo, it should have read 29Th but for Xtream Media to make a joke of it speaks volumes to the arrogance & attitude  of this company.I never authorized a purchase of a B stock,  They claimed that this is a customer repair.If this is the condition they return repairs to their customers That speaks volumes of how poorly run this business is & WHY do they have repairs to begin with this is supposed to be a $5000 dollar server already in for service???As to their claim that they havent moved fast enough, once again please hear the arrogance in their tone-It's been (6) weeks already, come on!Our phone system has a caller ID system  not Once has anyone from this company called us although my wife called them several times and each time she was lied to that a replacement, Call Tag, or refund check was sent.I have More supporting documents & encourage any interested party to contact me I'll be more then happy to supply them to you.Not a  crime? Mail order fraud consists of any illegal scheme that fails to deliver or Misrepresents merchandise, False or Misleading claims in which  a payment of a considerable sum of money is made only to find that the product is Not what you expected,defective or stolen merchandise-Buy an Ecceint or Kaleidescape This company is a scam!

There are some details missing from the complaint. To start, this is a dispute between two businesses, not between Xtream Media Servers, Inc. and an individual. This complainant is a retail business, not some ripped off consumer.

The first part of this post is basically accurate, except that the machine was supposed to ship, not be delivered, on the 29th or so. Maybe I should have waited to ship it on the 39th after all. And it was the wrong one, and we were supposed to send a different one. But it was never supposed to be new. The dealer ordered a "B" stock demo unit at a massive discount, which would have been a used or warranty return unit anyway, but certainly in better condition than the one he received. He knew this, we have acknowledged this, and were ready to go forward to satisfy him.

The root of this dispute is that we didn't move fast enough to suit this individual. When we began hearing  about the threats and abuse being heaped on our local representative, who had nothing to do with the mistake, the president of XMS quite reasonably wanted to talk to this fellow about the situation before we went forward with a business relationship. Several calls went unanswered, including one from me. The best we ever did was to speak to his wife, who hung up on the prez.

Ultimately, we won't be doing biz with this company, and he will get his money back in full, he won't have to pay return freight, and we'll all be done with each other. A dispute, certainly. A ripoff? Hardly. Criminal? Not at all, and shameful for him to have implied such.
