I saw and ad for a face cream on Facebook.  It was advertised as a "free trial" offer and you pay only $4.95 for shipping.

There was nothing about further payments or cancellation dates.  I paid the $4.95 with my Capital one visa card and forgot about it.  Withing the week, I received the free trial.  There was no receipt inclosed in the package or anything that indicated there would be a charge of $84.95.  Only instructions for application. Not even a list of ingredients.

Shortly afterward I was hospitalized for 8 days on an emergency basis.  When I arrived home and was checking transdactions on my credit card, I noticed the fee of $84.95.  I went online and found a phone number and called the company.  They told me they could deducted half of the fee but I owed the rest.  I told them that I was going to dispute the whole charge with the credit card company.

I did a dispute with Capital one and they remved the charge.  Then the charge was put back on as the company said they had proof that I bought the product.  I'm disputing it again with the credit card company and have faxed my information to them.

I feel this cmpany is a scam and I should not have to pay anything except the $4.95 that I initially agreed to.  I saw nothing that indicated there would be another charge of $84.95.  How many people have they done this to???

You ask at the end of your post "How many people have they done this to???"  The answer would be every single person that signed up for the 'free trial'.

All those 'free trials' have opt out continuity programs where you are automatically enrolled in the monthly delivery of ___(whatever you signed up for).  By accepting the free trial and not proactively opting out, you are accepting delivery of the item and the corresponding charge. That is why you saw the charge on your card again. There are exceptions for the credit card charges on continuity programs.

I know you said that you didn't sign up, but if you look at the website small print you will see that simply by ordering, you signed up for the program. You have to OPT OUT immediately in order to not get the extra charges to your credit card.

If I were in your shoes I would find out the proces to cancel the face cream from the company website and follow that process to the T.

Keep excellent records. If the company doesn't cancel the charges and the shipments, contact the CFPB.

The best solution is to not ever order "Free Trial" anything again. These telemarketing/website marketing programs operate under this same type assumption that you won't notice the charges and they can get away with it for months before you cancel.

If you want more information, go to the FTC website and look up 'continuity programs'.
