I have never had a Dish Network account, satellite dish, or any sort of affiliation with this company. I would like to know how it is legal for them to charge my credit card for a balance due on someone else's account?

A really good friend of mine was running a little late mailing out some bills and asked if I could help her out by her giving me the cash and using my check card to pay her bills for her immediately, rather than wait for the mail to run. Since I get cash back for using my checkcard, I had absolutely no problem with doing this for her. She would've done it for me had the situation been reversed.

8 months go by. No worries. Then when balancing my checking account a few days before Christmas, I noticed a $580 charge to my checking account from Dish Network. This was money I was planning on purchasing Christmas presents with, so this was not good.

I called Dish Network and got the run around. They said they charged my card because I did not pay my bill. I explained to more than one person, that I DID NOT have an account with Dish Network, and I never had an account with Dish Network. They looked the info up by the card # and said, that yes, I had an account and that my name was (my friend's name), not mine. The woman told me that when I signed the contract, I gave them this credit card number and because I didn't pay my bill that they were not only charging me the amount due, but charging me for all the equipment.

I told the woman, "I am looking at the credit card. This card belongs to (me) not (my friend.) " She said, "When you signed your original contract, you agreed to let us charge this card if the bill was not paid." Again, I explained to the woman, "I DO NOT have an account with you. I did not sign anything! It's 3 days before Christmas, I need my money back!" So by paying 1 bills for someone, your card # gets attached to their account? Is that right?

Of course, Dish Network did nothing. If it wasn't for my bank and Visa's unauthorized charges policy, I probably would have never received my money back. Certain people did not get Christmas presents until mid-January.

I would like to know how Dish Network can do this without authorization in seconds, but it takes a month to get the money back. Is this legal? The only reason they had my card # was because I paid a bill for a friend. Can they keep it on file forever?

prepaid visa or american express

next time your friend wants a bill paid direct her to the nearest walmart or cvs and buy a prepaid visa or american express. they can be used to pay these bill, i've done it before i know that they can. that way, you don't have to worry about it anymore.

also, i would never pay that bill for that friend again, not saying she isn't a good friend but she should have mentioned something when the charge came up and she should have paid you back when it did come up. but like i said before, if she wants her bills paid quick she can take her money up to one of those two stores and buy the cards and pay the bill herself

This is terrible!

I've seen this happen multiple times. And was one agent out of thousands. This happens literally all the time. There's something written into the residential agreement about using any payment method put forth toward programming for equipment/cancellation fees. Which would be fine, except that you never got a chance to read that contract so it wouldn't seem binding for you. There's no way that you, having never had a Dish account could have known about that. More than anything, I am sincerely sorry that you had to go through all that. It was never comfortable supporting the company line on that, and I always felt a little bit ashamed of myself.

I hope you got it all worked out.

Sorry but you were asking for trouble!!

Although it is commendable that you would help out a friend, you really did something very stupid. Never, ever, give someone your CREDIT CARD NUMBER'S!!!!! HEELLOOOO!!!! You are just asking for trouble and a poor credit rating.

I worked for Echo star and if a credit card is used to set up an account with a package that includes equipment most likely a term agreement is set up along side of it. And darling' if they are adding the cost of equipment, than that is what she did. She set up an account using your credit card. She is guilty of FRAUD!

As a CSR we have no way of knowing that the card that is given is not that of the user. There are several questions that are asked such as your SSN# and billing address. However please mind that the billing address and the service address can be different. However, all billing information re: non-payment is disclosed at the time of the initial phone call that, in the event that you don't pay your bill, (they give you about 52 days to pay a one months bill.) they have the right to charge that initial credit card with the balance and cost of the equipment.

My advice?

1 Admit to your self that you did something very STUPID.

2. Take legal action out on this friend for fraud. (She misrepresented herself to Dish and basically stole your credit.)

3. DO NOT blame Dish network for your LACK of judgment nor for following their policies that would ensure them that payment of services is made, remember they too have been made a victim of fraud by this "friend".

4. Check your credit rating (you can get a free report on-line). Chances are if she did this to you once, she has a few more things up her sleeve.

5. CANCEL YOU CREDIT CARDS ASAP AND NEVER DO SOMETHING LIKE THIS AGAIN.

Shouldn't give your check card to anyone either for that matter

You should be going to your so called friend for this not Dishnetwork. If your friend paid her bills you wouldn't have gotten stuck with this. When you gave your check card to your friend you screwed up not Dishnetwork.

Whoa you guys aren't right!

I read and re-read the post and you guys are just rude to this person. She never said she gave her card to anyone. She paid a bill for her friend who gave her the money up front. It seems plausible that one of the "prepaid" credit cards could have been used to set up the account. It also seems plausible that she had the only usable credit card that was on the account and Dish Network in an effort to get it's money attacked that card. Obviously what happened was was enough to convince Visa to issue a refund causing Dish Network to seek funds from the original creditor.

Addressing Mkc:
She gave Dish Network her number. I find myself wondering why you no longer work for Dish Network after calling this lady Stupid not once but twice!! Maybe she made a mistake maybe it was intentional but she is not stupider than you for your having worked for them. So here is my list of things you should do.

1. Admit calling this young lady stupid was in fact, stupid!

2. Admit that you don't know the law and you can't accuse someone of a felony without all the FACTS!

3. Dish Network has a severe history of taking payments out of accounts and off credit cards without permission (as shown on this website). Many of these payments are just supposed to be one time payments and just maybe since it's the only workable card on the account, Dish Network is going to try to get their money from it!

4.I agree with the free credit report.

5. Stop typing that you work for Dish Network ASAP and never do anything like this again!! :)
