Entered into 2 yr contract w/Planet Beach with knowledge of $50 early termination fee and 30 day notice. Unexpectedly, needed back surgery and unable to give 30 days, but terminated contract with my signature.
Employee stated that paperwork would be sent to corporate to review. Disputed early termination requirements since surgery was required and unable to give 30 day notice and employee stated that corporate will have to collect from me when I get a bill in the mail.
I never received any bill and my account has been charged each month since I signed off the contract for the $49.95 a month. Called Planet Beach and was told by owner that her employee stated she called me each month to tell me I needed to come in and pay the $50, which was a lie. No one had called me from there since I terminated.
Owner, Cindy, stated she has to go with what her employee said and since owner didn't sign off of my contract, they can keep deducting from my acct and that the most recent withdrawal this month can act as my termination fee but not to expect any refund.
I informed her that this was illegal and should have been billed for the early term fee. She said they can't bill for that and the fee just has to be PIF at time of termination. I informed her the contract doesn't state that. Am disputing on regular basis and will have to go to small claims court if not resolved.
