Travelcomm violated the contract deliberately not answering my calls, faxes, emails, not making the reservation of the travel package I paid for, spoiling my family vacation.

I got Travelcomm popup about Travel package 6/5 all inclusive Cancun and Orlando 4/3 vacation for $299.00 pp. I got something like very strange contract from them for 2 years, but paid $683.78.

I sent the Reservation Form with check for $198.00($99.00 pp.) to Travelcomm more then 45 days prior to my family vacation according to the contract. The 1st date of vacation was set on 02/23/07, and alternative date was 03/23/07.

Travelcomm made call telling me the list of available resorts to make choice from and to call him back when the choice done. I made the choice, and begin to call back to Travelcomm.

Travelcomm did not answer the calls. I called from different phones several times a day within more than a month, but nobody answered phone except one time, on 01/19/06, phone was answered, but I was told that I need to talk only to the agent who arranged the order, and the agent will call me back at night. But the agent has never called back.

Except phone calls, I also sent to Travelcomm faxes, emails, that Travelcomm for sure received, but, also, never answered.

I have done everything according to the contract.
Travelcomm violated the contract deliberately not answering my calls, faxes, emails, not making the reservation of the travel package, spoiling my family vacation.

More, Travelcomm made false statements for the complaint case 0602-04442 /BBB that was filled out with Florida Department of Agriculture and Consumer Services, saying that:

--- I requested different date;

--- I claimed that there was not his voice on tape;
--- I said that the written confirmation is somehow false;
--- there is record of many my calls;
--- they booked the resort for 02/23/06, and I canceled it;

There was not any communication between Travelcomm and myself because of Travelcomm; so all these Travelcomm's statements are false.

Also, Travelcomm said in the email submitted for the complaint case 0662-04442/BBB that Travelcomm will be glad to book for me vacation package when " He decided that he actually wants to travel".

I has never heard from defendant anything about that, but, really, was eager to travel at the dates that was requested in the reservation Form, especially on 02/23/2006.

The matter is, I paid money to Travelcomm for the vacation package, but Travelcomm did not give me this package violating procedure of the reservation deliberately not communcating with customer. Travelcomm refused to refund.

Currently, The Florida Department of Agriculture and Consumer services is suing Travelcomm industries, Inc. in Circuit Court in Orange County, Florida,
case # 2006-CA-008738-O. The action was filed on 10/2006.
