The California National Guard under Col. Sylvia R. Crockett's direction discharged
a brain injured National Guard Soldier. The Soldier, CPL Gary L. Pifer 1/18 Cav 40th BCT, was injured during a work detail, carrying a heavy metal desk down a flight of stairs. CPL Pifer fell 4 steps and the desk landed on his back.

Returning from Active Duty, CPL Pifer requested medical care and disability pay from the National Guard. CPL's Pifer requests were denied. Instead Col. Crockett
issued orders back dating his discharge by 9 months in a attempt to hold the California National Guard, non-responsible for his injuries. Cpl Pifer's TBI, Traumatic
Brain Injury was diagnosed by the V.A. Since his injuries happened on State National Guard time. He can not by law receive V.A. disability benefits and
has to pay the Veterans Administration for his medical care. Cpl Pifer is currently in dire straights and his home is in the foreclosure process.

If true as reported, this is the most reprehensible thing I've ever heard of. I am a veteran, mother of a reservist, and former wife of an Army officer (22 years of that!)

You need to contact your congressman NOW! If that doesn't get you anywhere, look under the ogvernment web sites and find out who sits on the Armed Services Committee in congress. A congressional inquiry makes everyone pay attention.

I would also urge you to assist the soldier in getting copies of his medical records, perhaps a second opinion, and any other documents (particularly affadavits from witnesses to the accident) and start building a case for him. You might also consider finding an attorney who speciailizes in military affairs.

Traumatic brain injury ?

Did the Cpl hit his head when he fell? Did the desk Land on his head. If not and he just injured his back that is not a TBI. However if the injury was while he was drilling and the Col tried to backdate his discharge to avoid paying i would consulte a lawyer. the col cannot hide the fact that the member was on active drill because he was getting paid by the guard for however long he was drilling for, this will show on his LES. My advice would be get all his direct deposit information from his bank and his medical reports on when this injury happened. A good lawyer can coorelate when the injury happened and prove he was on active drill during the time he was hurt

Now with that being said here is where it will get tricky. If he corporal did not seek immediate medical treatment for his injury after it happened and he went to the VA after the fact lets say a few weeks down the rode there is no paper trail to confirm that it was done on while he was actively drilling. If He did seek aid he should have gotten a copy of his medical report with the date the incident happened this will help you when you go talk to your lawyer. The Col can do whatever he wants but you have medical proof it happened while on drill. If not your out of luck. Unless you contact the governer and congress man of your state to try and put pressure on the guard.
