Fidelity National Home Warranty Breach of contract by failing to promptly authorize repair of a leaking shower valve Walnut Creek California

Fidelity National Home Warranty is in the business of selling home warranties that allow the insured to make a claim when something that is covered by the policy in your home breaks. Fidelity was notified on 05/10/02 that my shower valve was leaking and causing damage to the interior of my wall. This was covered by warranty. Fidelity had a plumbing service come out to diagnose and repair the problem. Plumber showed up, adivsed a part would have to be ordered and then left. Plumber never returned to fix the valve.

MULTIPLE calls were made to Fidelity to get action to have the valve repaired. Fidelity refused to dispatch another plumber to fix the problem. Shower valve continued to leak requiring water to be shut off to the home when not in use. As of this date, 05/18/02, Fidelity would not return calls by me requesting immediate service. This companty is negligent in the processing of insured's claim. Further, the breached their contractual obligations. Legal action in the form of a lawsuit is forthcoming. This report is a warning to all potential purchasers of "Fidelity National Home Warranty's" home warranty plan, which is often pushed by real estate agents in home re-sale transactions. You may want to consider the problems I and many others have had with this company prior to entering into a contractual relationship with them.

Fidelity National Home Warranty also has an UNSATISFACTORY rating with the Bay Area Better Business Bureau. Compalints have been filed with that agency as well as the State of Ca., Dept of Insurance.
