I'm Orlando, Manager of Pinwheel Media, LLC. I stand behind every service that our company provides. The individual (Damon Shyvers) who issued a negative report about us is in my experience a thief and a con-artist. I am happy to leave his comment up and give you insight into the issues our company confronts.

This individual, Damon Shyvers and owner of Melodic Hustle, LLC, was just such a person. We were doing business with him for the last 2 years and performed as a courtesy many free development and hosting services in addition to all of the services he paid for as a great value. We ended up building his website in 2 different platforms as he was unsatisfied with how the Contact Management System(CMS) worked on the first website, then at no extra cost we migrated his website to a better technology platform and added MORE FREE services to improve the website. Since the beginning of the project, Mr. Damon Shyvers was always behind on his payments and obligations. We tried to help him out by creating several installment payment plans, to make sure he could afford to make payments every month and on time. He was still late, disappeared for months and only paid when he felt like it. During the first 6 months of the development stage of his website, we were offering Damon Shyvers FREE hosting space. After we noticed that he wasn't cooperating (and disappearing from us), we decided that it was time for Damon to pay for his hosting obligations in which he agreed and signed a 2 years contract for hosting services. Damon Shyvers, now owes 1 year of his hosting contract agreement and now without any comprehensive explanation, he refuses to compensate us in any form.

As of today, the website is complete, we performed the work and invested money and time into Damon's case, and instead of paying us the money he agreed to pay, he reneged on the deal. 

In our drive to satisfy every client, even bad business people, we agreed to get him out of his hosting contract by settling on payment for just the use of hosting services from August 20, 2009 until today(Nov 18, 2009)... Instead, he threatened us by reporting on websites just like this, reporting us to the Better Business Bureau, and other extortion tactics. He has obviously failed to present any case that a neutral party would even accept to review. His only recourse was to badmouth us on unmoderated websites like this one.

I welcomed the client, Damon Shyvers to contact the BBB and resolve this issue. The website is finished per his requirements and ready to upload. I will not release it until I receive 100% payment for hosting services and not a penny before then. The clients conduct in the last few weeks has been bizarre and not fully understanding what the cause has been for his issues with our company...  Between August 20th until now he contacts us over 25 times in email with various threats about litigation, and defaming our company if we do not cower to his demands. 

Our attorneys are now involved in monitoring the situation and advised us to only seek action against the client if Damon Shyvers slanders us outside the BBB process.

The report that Damon Shyvers, owner of Melodic Hustle, LLC created is a complete hoax and our company demands that Damon pays for his hosting contract obligations.

I'm happy to provide numerous references of the 99.9% of our clients who are normal, intelligent, and extremely satisfied customers.

Let me start by saying reports have been filed against Pinwheel Media / Mr. Orlando L. Ramirez to following agencies who are currently investigating Pinwheel Media’s deceptive and fraudulent business practices.  It is my sincere goal to make sure that Pinwheel Media LLC will never scam another unsuspecting consumer out of their hard earned money.

Mr. Orlando L. Ramirez / Pinwheel Media once again have proven himself and his company to be a fraud.  I Damon Shivers under my attorney advisement have not communicated with Pinwheel Media / Mr. Orlando L. Ramirez since October 28, 2009 at which time Pinwheel Media / Mr. Orlando L. Ramirez was placed on notice by mail that I was consulting with counsel and taking legal actions against Pinwheel Media LLC and it owner Mr. Orlando L. Ramirez. 

As I result of my decision to exercise my consumer rights and to pursue a lawsuit against Pinwheel Media, Mr. Orlando L. Ramirez in retaliation posted his falsified rebuttal of the facts and also sent me an email where he attempts to not only scam additional money from me thru a web hosting scam. He then pleads with me to delete this post. (e-mail has been included)  

Pinwheel Media has set up a web hosting scam that is very popular among cyber thieves today.  But it isn't an isolated case, and the possibility of a website hosting company scamming customers is something to be aware of.  The problem with this type of scam is that the average consumer like myself wouldn't know how to spot it.  Please beware of companies like Pinwheel Media / Mr. Orlando L. Ramirez who advise you in the middle of building your website that in order to complete designing your website they will need you to sign a two year contract for web hosting for $400 a month to be paid 6 months in advance. This is addition to the $31,783.32 that was already scammed out of me by Pinwheel Media LLC.   

Please take note that in Pinwheel Media’s rebuttal Mr. Orlando L. Ramirez never once denies anything that I have said in my complaints, he only attempts to justify his wrong doings.

In addition I would like to share this very offensive email that I received from Pinwheel Media’s Owner Mr. Orlando L. Ramirez on November 16, 2009 just two days before he posted his illusive rebuttal.  I will let you be the judge as to whether you would do business with a man of such very low caliber.

Did you send my money for the Hosting services that you owe? If not, what are you waiting for? This transaction is very simple, you pay for the money that you owe and your obligation to my company and contracts and then we'll finish the transaction and transfers of files.

You've been doing some very stupid and moronic things lately:

1) Changing the DNS of the Melodic Hustle domain without consulting me caused an issue on your website's database. The site was working perfectly until you did this stupid move. This is just giving hackers the perfect opportunity to get a hold of your website and files. Do you remember what happened when your Drupal site was not secured the last time around?

Luckily enough after long, long, long hours we finally recovered all files last week and put them back into the hosting server.

2) Acting like a child is not going to get you anywhere. Writing bogus complaints on the web and BBB is not going to help. I already spoke to BBB and sent them copies of your emails and contracts. They already know the real story and they know that I never said or agreed to refund you any money. The website is complete. Development work is already done... Are you serious? They know what is really going on here!

3) I'm also aware that you are posting false statements about me and Pinwheel Media on different websites. This is SLANDERING, and I'm already reporting these activities to my lawyers so we can start a lawsuit immediately. I never said, I wasn't going to give your files, why would I need those files for?

 Again, this is very simple, you pay the money that you owe for hosting(via check), and then I'll send you the release forms for the website and it's files. It's your call if you want to continue to be a CHILD or man up and pay what you owe under our hosting contractual agreement. I'm actually giving you a BREAK and will let you pay hosting until this week. $1,059 due NOW!. This payment covers part of August, September, October, two weeks of November. After all, I can't CANCEL your account because your files are in the server. (ALL 3 Gigabites)

So the question is, what is stopping you from paying and get your files and move on? ...Is it stupidity?

I'm asking you nicely to STOP the defamation and to take down ALL postings. Understood?

Just pay the amount that I'm asking above ($1,059), bring DOWN any CRAP that you posted about ME or Pinwheel Media and then we'll make the website file transfer to your new hosting. It's very simple!
