On Jan.31, 2010 my wife, paid in fill and in advance one years membership(#MSO18816) with Premier
Fitness by debit card. she paid the $50 assessment fee by credit card (told by sales rep this could not be paid by debit). On Jan 14, 2011 a cancellation notice was hand delivered to Premier Fitness (an exchange my husband video-taped) it shows a young man accept the letter and state he just needed to have Danielle sign it. He brings it back saying everything has been taken care of. Jan 18, 2011 my wife received a letter stating her membership has now been upgraded to Gold Plus Status and reminding her that the next month would be the one year anniversary of her membership, this letter was dated Nov. 28, 2010 but the envelope was postmarked Jan 15, 2011. On April 19, 2011 she received an email from Premier Fitness stating her account was in arrears and she owes $98.34 and her file would be sent to their third party accounts receivable company. May replied by email on April 20, 2011. On or about June 1, 2011 she received a phone call from Premier Fitness stating that Dave wanted me to setup an appointment for her to come in and discuss my delinquent account. She told the young lady to please have Dave call me himself. On July 26, 2011 she received a letter dated July 7, 2011 with a final demand for payment giving her until July 17, 2011 to respond or they will commence with further debt collection procedures, this letter was signed by David Ellison customer relations and included a 60 day pass to enjoy the facilities free of charge! My wife sent Mr. Ellison an email and attached the correspondence that had occurred so that he could familiarize himself with the chain of events as well as a copy of the cancellation letter that was signed and dated by "Danielle". On July 26, 2011 she received a phone call from Mr. Ellison that involved them both yelling at each other. I took the phone and said that we sent everything we had including the letter signed by their staff member, Mr. Ellison then stated that "anyone could type a letter and sign it and say it was from them". I then uploaded the video of the cancellation letter being delivered onto Youtube and sent the link to Mr. Ellison. On July 27, 2011 Mr. Ellison called to say that he forwarded the emails and video to two executives at head office for them to examine.
