On November 11th, I purchased a motor from ASAP motors in Houston Tx. W/ an extended warranty. The company did over over the phone check with me and shipped the motor promply when the check cleared. Once the motor was installed by my mechanic he and I both noticed the motor had an internal chatter. I contacted ASAP motors immediately to inform them. I wasn't able to talk to a manager right away so i told my story to anyone who answered the phone. Since the motor automaticly comes with a 3 month i saw no problem with them fixing the problem.
I was told to sign and return a Return Authorization Form and they would send someone out promtly to pickup the motor once my mechanic removed it. It took 11 days to finally get the proper forms to sign and return as they kept sending me copies of the warranty info and not the proper forms. Once someone finally did come pick up the motor nearly 2 weeks had gone by. At the time i called ASAP motors to find out the status of my claim. I called for 3 weeks and no one could tell me anything, All i kept hearing is " someones on it right now and we'll have an answer for you tomorrow."
Finally i was able to talk to manager which i had been requesting since the beginnning of the motor trouble. Elvin Jones told me quote" Since that motor has been returned aint nobody even looked at it." Remember now this has been 3 weeks since i had returned the motor. He told me he would get someone on it right away and i told him that's all i had been hearing since dealing w/ them. He promised and said he would call as soon as he found something out. Another week went by and i had to call again. He informed me that the heat tabs had been melted which means I over heated the motor and was the one who damaged it. I told my story again as to how as soon as the motor was installed it made noises well before it ever reached operating temperature. As a matter of fact the motor never reached operating temperature during the time i had the motor. It only chattered when you reached 2500 rpm or higher. So to be cautious i shifted gears while driving the truck earlier than normal to prevent the chattering. The motor had to be damaged before the ever shipped it to me. It couldn't have been tested because they would have heard the chattering as soon as they started it up and revved it. Every time i started the motor it chattered and then quieted down.
Elvin informed me that my warranty was now voided, because their policy states that melted heat tabs void the warranty. So i was upset but stiil tried to get ASAP motors to help me. I asked if they would give me the same motor back but just use the money i paid for the extended warranty to fix it. He told me "NO." I asked even though i was only able to use the motor for less than 2 weeks, and the fact that it never was a properly running motor. Still he said"NO". So I asked well will you at least return the motor to me for free. I did pay $199 extra dollars for an extended warranty. He told me any repairs or shipping i would have to pay for my self. Since all the warranties are voided. And that ASAP gets to keep all monies spent with them. I asked to speak to someone higher than him who might be able to help me. He referred me to Dina who makes all the final decisions. I expalined the whole story to her in great detail and she also refuse to help.
I explained to her that i was offering to keep their defective motor even though i didn't damage it, all she would have to do is pay $85 for shipping. She too told me "NO". She added that i have 10 days to decide what i want to happen; she would either ship the motor back to me at my expense or she would throw it away. I opted to have the motor shipped back to me and just have my mechanic fix the chattering. But i began to realize that i had been duped. They sold me a bad motor and a warranty i cant use and they wont even help me out. I informed her that i want the motor back and i will be seeking satisfaction further through legal actions. At that point she got slightly rude and transferred the call back to Elvin Jones and he said he would get the paper work in order to have the motor shipped back to me. THat last phone call was the first week in January and it is now February 16. I have been trying since November 28th to get this resolved. I still have not received my motor back from them and i live only 3 hours away from this company. I sent them a demand letter from my Law firm of Ross & Matthews stating what i would be seeking in monetary satisfaction on January 20th. No one has called and Elvin was the one who sign for the Certified Letter. I have spoke to Elvin 3 times since the letter was sent and he hasnt mentioned it once. I have called nearly every Monday and Friday since January 11th to check on the status of them shipping my motor back to me.
I keep hearing the same thing."it's being prepped to be shipped, it'll be out either today or tomorrow. If not give us a call back." To me the people that answer the phone down there At ASAP have a script to go by to keep disgruntled consumers on standby. They have never called me at all. Everytime i call i have to remind them of who i am and what my problem is. I am on a first name basis and recognize certain employees voices ie. Bruce Coleman and Elvin Jones. I have no desire to speak to Dina (head manager) as she was rude and unkind.
complaint for me.

...get together and write the Attourney General, we can get a class act law suit against them. I have sent an entire packet to them about a month ago and havent heard anything. I believe we have to wait at least 90 days after you file to hear something....Just to add to my report ASAP finally sent me another motor to replace the one that was damaged when i recived it, and this one too has problems, the oil pan leaks and we havent even started it up yet. So i still am unresolved with them. Dan see if you can get a refund NOw since you havent recieved the motor yet and go with another company.

Any successful suits against ASAP?

I wish I had seen this site sooner, as I paid for a motor I have yet to see. But I'll give it some more time and will have the garage fully inspect it before it goes in, and afterwards.
But my questions are these -
Has anyone had a successful law suit against ASAP Motors?
What is the status of those complaints to the various AG offices?
I want to follow all this in case I end up with the same problems as those explained on here.

Voided Warranty

Sir no one stated you were not within the warranty timeframe, you voided your warranty by returning a unit with melted heat tabs if you will refer to the warranty of any company that sells motors melted heat tabs is a voided warranty regardless of timeframe. But as I stated we did dispose of your non warranty motor in error. As stated previously "Anthony" doesnt know anything about our company and so far has fabricated a bunch of information. I can not help what people chose to belive or say for that matter but it does not make it the truth.

Anthony knows a lil toooo much about you, kinda scary isnt it?! And for your info, my motor did have a 90 day warranty which you provide upon purchase and i bought an extended warranty from you for an extra $199. Check my reciepts dated November 11th, 2005. Larry Smith (Cove Auto Repair). You will be proven a liar again.

SUBMITTED: Friday, March 17, 2006
Ive been here for 8 years and I have never had anyone named "Anthony" work here, and none of the information "Anthony" has stated is true. As for the customer: Elvin threw your motor in the core ben and it was picked up by the core company for disposal if I were dishonest as you state I would have told you tuff luck! Instead I knew we owed you a motor even though the one you returned had no warranty, I did the rite thing and sent you another motor. Im sorry you cant see that. But we will not be paying the labor as the motor you sent did not have a warranty on it to begin with. We as a good company stood up and did the correct thing, you as a customer should recognize that.
Anthony why dont you stop lying and hiding behind a false name, and making untrue statements. Or do you just not have anything to do? Business alittle slow?

Amazing that she doesn't remember me. Well not so, since she will forget that she sent you a junked out unit an hour after she just talked to you & head your complaint. I guess that is to be expected since she talks to a great number of people and I'd guess 90% of them are compaining about a POS they received for their hard earned dollars. And if I never worked there, how would I know of Scott, Brian, John, David, Gary, Jason, Steve - good ole Steve, Kay, Armando, Miguel, oh and that guy that took my place, sorry I forgot his name, and what was that old driver's name?
Oh well, yea and how would I remember a particular story when Jason and David were trying to screw some guy out of his warranty because HE sent the motor back himself, or that Jason really didn't have any of those Honda SWAPS (what a joke) to sell in the warehouse, but that he was trying to get them from some chinese guy, but STILL selling them anyways. Orrr that basically this place was ripping people off left and right. What a joke Dina. It is too bad that so many people get jacked for their money by your company while you are (were? prob upgraded by now) driving a BRAND NEW SHINY BLACK LEXUS SUV!! Pathetic and I hope the karma comes back to you and ASAPripoff gets shut down.

UPDATE continued from the rebuttal for Dina
AUTHOR: Larry - (U.S.A.)
SUBMITTED: Tuesday, March 14, 2006
Also Dina if you read my whole letter you would see that my first complaint was that upon installation the motor chattered from the get go. i contacted you guys that day i recieved my truck from my mechanic. It took almost two weeks to get the right paper work from you which allowed me to put 29 miles on the motor.
I work 3 miles from home, what do you consider a extended period of time, the radiator and thermostat were new. The coldest week in November is when the truck was completed...There is NO way I overheated that motor. Like i said it chattered as soon as i recieved it from you. If Anthony doesnt exist why did he call you an angel? Sounds like a compliment to me. Should i also question the truth about that. Do you remember me making the offer to you to keep my $199 for the warranty as long as you pay the frieght on the damaged motor. I was willing to take a loss and you would not help me out. Doesnt sound angelic to me......

Your responses are scripted, i have read this before and heard it all from you guys!!!

Well, Dina in response to your rebuttal...I did call you just 4 days ago and asked if you could give me an update as to where my motor was, you told me you had no idea and that the warranty manager would be able to get my paper work faster. So you forwarded my call to him and finally i have a motor.
But guess what, you and i talked the first week in January to return the motor you say i damaged..Some how you guy have LOST that motor and sent me another one, but w/ no warranty, i dont even think that is anywhere in the warranty agreement that such a thing could even happen. Did you guys fire Elvin or did he quit because his conscience wouldnt let him work for such a company anymore. Did you guys actually lose a whole motor or did you accidently resell it to another unsuspecting buyer.
Dina i have heard all of ASAP's excuses and reasons and the fact remains, you guys are ripping people off. I hope you dont think that just because you finally sent me another motor that i am outta your hair...you guys still owe me the rest of my warranty, which is paying my mechanic $35 an hour for reinstalling this mystery motor you guys have come up with. i been dealing with you since november 11th and i just recieved SOME of what is owed to me now on the 13th of March. More to come upon completion of the install.....

First of all we have never had an employee by the name of Anthony work here, so unless they are willing to use thier real name I would question what they state. Second it is never my intent to keep your merchandise and your money however if you did overheat the motor I would be unable to warranty that and that does mean I am unable to pay the freight back to you. If you return a unit that is under warranty we do replace the unit at our expense anyone who has worked here does know that. If a heat tab is melted the motor was run in excess of 290 degrees for a extended period of time. Motors dont overheat cooling systems do. If you would like your motor returned to you just contact me toll free at 888-221-1440 ext 232 I will see to it that it is returned but you would have to pay the freight upon arrival.

that you didn't want to talk to Dina. She is really the one to talk to and can make the others jump. She will act as rude as an **** one minute and then turn into a charming flower the next. She is very good at what she does, which is keep your money for ASAP. You did pretty good with getting it picked up mentioning the chatter. The old 'heat tab' excuse got you though. I had forgotten about that one. They'd use that to void warranties and keep customer's money. Hard to refute and since you weren't in the neighborhood to drop by and dispute it, well hey, looks like they just kept another customer's dough. I worked for this company for a short time and saw this happen all the time. Being a well to do person I felt badly for the people who were getting shafted. All too often I saw these exact situations and they were handled pretty much the same way. They won't ever call you unless they know absolutely sure they messed up. Even then most times they'll try to get by and hope you just don't pursue it. I hope you keep pursuing it and sue the crap out of them. Willing ex-employee right here waiting to meet you at the courthouse.
