Bayview Loan Servicing LLC Bayview Financial Fair Credit Reporting Act Violation/ class action lawsuit Coral Gables Florida

 My ex wife and I got a home loan through Swartz & Brought inc. using my VA disability separation pay as the down payment. A short time later she kicked me out and was awarded the property (and the financial responsibility) in the divorce. Divorce decrees don't always release you from the debt (as Bayview has eagerly pointed out). But, my ex tried to refinance the loan without my name on the loan. Bayview refused. I was involved in the application process with Swartz & Brought. I didn't even know Bayview existed until this year when I tried to obtain a home loan (13 years later) and found a charge off from an unknown company. I contacted Bayview to see what could be dome to remove it. They told me that the loam should have been refinanced without my name on the note before it was charged off. I informed the representative that I was speaking with that my ex tried. She said there was nothing she could do. I reported this issue to the BBB, but got no results because Bayview said that I should have assumed financial responsibility when my ex became delinquent. There was a lawful order in place before Bayview purchased this loan stating the property and the financial responsibility belonged to my ex that I have to obey. So not only did I not know that the loan was delinquent, but I didn't even know who it was being paid to. This is a fair credit reporting act because I did not know the loan was delinquent or even that a loan was being paid to this company in my name! All a asked them to do was remove this negative item from my credit reports from the beuros. Bayview refused. I am currently looking into further action.
