First Texas built our home in Eagle Ranch out of spec to the red line dimensions which we had approved. The house sits approximately five feet over to one side. This makes the use of the garage nearly impossible. We cannot get our cars into the garage without jockeying them back and forth and crossing the property line into our neighbors driveway. Originally we had a five foot turnaround on the driveway, but First Texas removed it without notiying us.

When we were about to close on the house, First Texas proceeded to tear the turnaround out and move it to the side of the house where it cannot be used for any practical purpose. They also left the gas meter unprotected next to the driveway.

First Texas sent a representative (Al Slovik)to our house to discuss compensation for the lost footage. He offered us an extension to the house or a backyard kitchen and other amenities. We also discussed the building of a garage in the back of the house to replace the useless one in the front. Al and his assistant (Bill Alderman) even had plans on what this would look like. After agreeing to this Al dissapeared and First Texas denied that he and Bill ever visited us in our home.

Secondly the home had a crack in the foundation which was repaired completely after about one year. When we were going to back out of the deal, the First Texas salesperson (Jeff Spann) told us that if we did not purchase the house that we would be sued for the costs of building the house and that they would keep the house anyway.

After all of this happened and we complained to First Texas time and time again through e-mails, phone calls, letters, and lawyers, First Texas sent in people to tear down our fence, pull up our grass, and put up an eight foot fence with a two foot concrete base in our neighbors yard, getting rid of the shared fence that was on the property line. The HOA who seems to be in the builders pocket has been notified but refuses to do anything about it, or even acknowledge our registered letters.

Imagine coming home from work and finding First Texas has sent their goon squad to destroy your property without even giving you any warning. This is the kind of people that we now have to deal with. Don't buy a First Texas home.

There are other defects with our house that you would think that a one year old home would not have, but for the sake of brevity I will not list them here. Save yourself a hassle, buy from someone else!

Response to Jeff Spann: The Real Truth

This is in response to the rebuttal that JEFF SPANN published. We believe that since such a slanderous attack has been taken, that a nerve was hit upon or no maybe our original copy is THE TRUTH'? I can't believe that his company, FIRST TEXAS HOMES is standing behind his terribly unprofessional retort. I'm going to skip over all the innuendo spewed and get straight to the point. Here, for all to see is the survey that we signed at closing. Look closely at the document. Every piece has a measurement except in the area of the driveway. It has been circled for you to see.

We were promised that our house would be completed by January of 2005. We were not able to move in until March, and then FIRST TEXAS HOMES dragged their feet in completing the work.

When the driveway was cut off, we were never privy to this information. One day we arrived at the construction site and the concrete was cut off. (See picture)

We had to go see JEFF SPANN about this since we were not supposed to communicate with the builder directly. We were told that they had poured it too wide to begin with and not to worry, as he would take care of it. We then tried pulling our vehicle into the driveway as a test, found out the concrete that was cut out made it extremely difficult to maneuver.

JEFF SPANN was notified of this again, and once again we were told that he would take care of it. Well, another slab of concrete was poured next to our single car garage, and we were told that this would resolve our problem. Then we find out about our home having a defective foundation. Diversion Tactic?

You talk about what we have in our garage! The foundation problem wasn't noticed until all the construction debris was emptied out. But it is nice that FIRST TEXAS HOMES and their salesman care so much about the contents of our garage now, since that is not the issue. We have been unable to utilize our garage for parking a vehicle; we decided to use it for storage while FIRST TEXAS HOMES had to level our flooring in the upstairs because FIRST TEXAS HOMES has trouble with basic measurements.

All of our paperwork that we have from FIRST TEXAS HOMES reads totally different measurements than what we now have. (oops). I guess that didn't matter when the house was being constructed. The truth and actual measurements should never play a factor in the construction of a house, right?!


If these issues are so frivolous, why did FIRST TEXAS HOMES send out a MR. AL SLOVIK and BILL ALDERMAN? We are not the only people that know the truth. MR. AL SLOVIK was the first man, along with BILL ALDERMAN that confirmed with us, during the warranty period, that yes our driveway was not constructed to specs. Why is it that our survey has numbers everywhere but at the very spot where our driveway is incorrect? (We signed this survey at closing because we were told that the numbers would default to the red line copy that was signed and OK'd by all parties.)

We were told that FIRST TEXAS HOMES would return with an offer after meeting with AL's boss, MIKE CRYER. AL and BILL came to our home as spokesman for FIRST TEXAS and asked us what they could do to get this resolved. AL and BILL made an offer of expanding the house in the back to compensate for the 'loss of use' of the garage. They produced drawings showing a garage in the back with a driveway down the side of the house. If this was not satisfactory, then Al said that FIRST TEXAS would offer an outdoor deck/kitchen area if we preferred.

We told AL that a garage in the back would be the logical choice and AL stated that he would start the paperwork on it immediately. Earlier that day, we had talked to MIKE CRYER (who sent AL SLOVIK and BILL ALDERMAN) and MIKE had said that AL was the authority and he trusted him to find a solution and that he would go with what AL suggested. This was the last we saw of AL SLOVIK.

So it ends with these points of THE REAL TRUTH'.

1. The actual driveway does not match the specs. in the red line that was signed and agreed to by all parties.
2. The measurements of the driveway were intentionally deleted.
3. FIRST TEXAS HOMES offered to make restitution and then reneged on their promises.
4. FIRST TEXAS HOMES can't get basic measurements correct (See red line and survey)
5. FIRST TEXAS HOMES uses threats and diversions (expose and embarrass / see Jeff Spanns retort)
6. FIRST TEXAS HOMES sent in their hired goon squads to tear down an existing fence, carve up our lawn, destroy our sprinkler system, cut off our cable/internet system, and generally cause havoc and mayhem. This is supposed to correct their errors?

In closing, examine the photos, check the red line, check the survey. You will see that the incompetence of FIRST TEXAS HOMES is obvious. This is the Real Truth.

I sold Tony his home in Eagle Ranch. He's a pleasant man with a kind, child-like disposition. During the planning phase, we spent many hours re-designing the floorplan to suit his family's needs. Quite regularly, Tony would glare beneath his heavy glasses and study the design proposals. Sometimes he would praise the ideas and other times he would scowl, telling me that 'Donna' (his wife) would never go for it. My perception was that Donna wore the pants in the family. It didn't seem to matter what Tony liked or wanted, it only seemed to matter what Donna wanted.

I enjoyed working with Tony. He stopped by often, and spent lots of time visiting. His family was still out of state, and he seemed lonely in their absence. Since we had written the contract contingent on the sale of other property, Tony seemed nervous about the prospect of losing the new home because the current home was taking longer than expected to sell.

As we approached completion of the home, and Tony's out of state property was finally closed, The Weaver's became a bit impatient and pushed for finalization of the project.

During the course of construction, we experienced a situation where a stress cable broke and caused minor damage to the right front corner of the homes foundation. While not common, this occurrence is not unheard of in new construction, and is certainly nothing more than a minor hindrance to the building process. We repaired the damage prior to closing and provided engineering reports & inspection certificates to the Weaver's.

During the course of repair, Tony mentioned that they might not want to close on the house. I informed him that his contract did not allow him to simply 'change his mind' and also informed him that his modest earnest deposit would be at risk of being retained if he defaulted on the contract. It was never even suggested that he would be sued.

Upon inspection of the final property survey, it was noticed that the Weaver's driveway was encroaching slightly on the neighboring property. I met with Tony, and explained the situation to him. I informed him that we would have to remove the concrete which encroached on the next lot.

He requested that we pour additional concrete next to his 'straight in' garage stall and we obliged. Prior to deed transfer, the Weaver's were provided a copy of the survey showing the precise location of the home & all other improvements on the property. Had they taken issue with the location of the home on the lot, they should have voiced their concerns prior to accepting the home. I might also suggest that if it is one's intention to park in a garage it might behoove them to remove any stacks of boxes, any debris, or any other items which might make it impossible to utilize said garage for automobile storage.

I've read the certified mail which Donna sent to The HOA. I even spoke to the HOA representative about their complaints. The representative visited the site and concluded that there was no infraction. I suspect they might have responded to Donna's letter had it not been so frivolous. I believe the letter was sent as a malicious tactic to terrorize the neighbor, as it was directed at the current property owner and not at my company. I've always believed that jealousy is an ugly thing.

Certainly, I could rebut much more of The Weaver's complaint, and embarrass them by exposing the entire truth, but for the sake of brevity (and because somehow I still think TONY is a nice guy, and not at all the driving force behind all of this raucous insanity) I'll refrain.
