We are just like everyone else who has complained about this nightmare mortgage company. Our loan was sold to HSBC a couple of years ago. Things were fine up until last year when we refinanced to pay off some bills and set up an escrow. We were set up on EZ PAY PLUS because it would " help us out in the long run to pay off the house ". This was the biggest mistake of our lives!!! They were taking out about $700 every 2 weeks of our checking account. We were told that we could pick the dates of the debits, so we did, and thought everything was fine. Right off the bat, we started receiving late notices and fees.
Everytime we called, they said that things were not set up properly on their end and we would not assess any late fees, because we were not late. Well this went on for a full year, until I found out this August that they were claiming us to be 2 months behind. The " idiot " on the other end tried to convince us to " restructure our loan ". This, I found out, only meant that they would take these 2 months ( that I already paid and have proof ), and tack them on to the end of the loan. I, of course, said no way. Well after arguing back and forth, the idiot finally told me that one month's payment had been credited to the wrong area of the loan, and he would TRY to fix it. He had no guarantees... Well, to make a long story short, we got off the ez pay program, and that's when the harrassment started.
One of the collectors told us that our second monthly payment was not crediting until after the grace period. When asked why we had not been told, she told us that HSBC didn't have to tell us any info. that would help. SHE EVEN WENT AS FAR AS TO SAY THAT WE WERE " SHOOTING OURSELVES IN THE FOOT " WHEN WE GOT SET UP ON EZ PAY!!! Things got even worse when we found out last week that they had been reporting us 30 days late for the past 6 months!!!! This is absolutely false, as we have proof of all payments. How can they get away with this behavior? They are rude, inconsiderate, and downright immoral. They have been harassing us since the 4th of September ( before our grace period was even up ), and it hasn't stopped. We have complained to anyone who would listen. Complaints have been made as far as Washington ( we live in Kansas ). This really sucks.
We met with a bankruptcy lawyer last week. This is the point we've been driven to. Unfortunately, we have a loan with Beneficial and a HSBC credit card also. After dealing with HSBC for so long, bankruptcy doesn't look so bad!!! We have decided to let them have the house. It's just not worth it. WE WOULD ABSOLUTELY LOVE TO BE A PART OF A CLASS ACTION LAWSUIT!!!

Bankruptcy won't deter them!

We too have been victims of HSBC Mortgage. In order to save our home 4 years ago we filed Chapter 13. During the course of that time HSBC tried twice to tell the courts we were two months late but we were able to show cancelled checks and we always send our payments return receipt requested so we were able to show when they received it. Each time the judge told them to back off, we were current. Well on November 12th we finished our chapter 13 with no late payments and were given a discharge. On November 12 HSBC sent a statement to us saying we were two months behind! They have now sent back my December house payment and said they were starting foreclosure proceedings!! I have kept our lawyer and he said he can reopen our bankruptcy case and the judge is not going to like this at all so here we go again!!! I am also going to file a complaint with the Attorney General of Kansas and I highly suggest to all to do the same. Filing Chapter 13 does not stop this company!
