A lady insured with Liberty Mutual ran a stop sign and hit my husband. The lady admitted to failing to yield to a stop sign and it was recorded in the accident report. This was on the morning of October 8.
It is now October 26 and we have yet to receive a check for the damages to our vehicle (total loss) or rental car fees which are now exceeding $600.
We have to literally chase after the claims agent in charge of our case. She never answers the phone and never returns calls. She is very rude and treats us like we are the ones who ran the stop sign.
We finally got a hold of her on October 23 and she told us that my husband was 15% at fault and they would only cover 85% of expenses. How was my husband is 15% at fault when their insured ran a stop sign and admitted to it?
You definetely need an attorney when dealing with these people. They are rude, unprofessionaly, and take their sweet time handling claims. Needless to say, we will be taking their insured to court for the remaining 15% that is owed to us if they don't budge on the 85%.

If you plan on taking the other driver to court, you cannot accept the 85% from the insurance company and then file suit for the rest. If you accept a check from the insurance company it will come with a release that you have to sign. That release says that you are accepting the insurance companies check as full payment and have no further claims against their insured.
To get the full amount, you're going to have to reject the offer from the insurance company, then file suit against the other driver for the full amount. The insurance company will be obligated to defend the other driver and explain to a judge how your husband was 15% at fault.
