On March 11,2011, i used craigslist to look up autos for sale. I found one listed by Texas Direct Auto that fit my needs. I called to inquire about said vehicle, was asked for details to have my credit runto see about financing. I was also asked to give them a "deposit" for this vehicle, which ignorantly I did. At NO TIME did the salesman, Ray, tell me that the deposit was non-refundable if I chose not to purchase the vehicle. I decided against purchasing a vehicle from them, and asked that my 500.00 be returned--all I got was a run around from every single person I spoke with, and was told that the manager was a "busy individual" who could not be bothered with my questions regarding the deposit. I threatened to go to the BBB, a local news station, and the attorney general and was basically laughed off the phone--and told "not to waste my time or theirs", that I should have just purchased this vehicle.

I just want others to be aware that releasing your credit card info to anyone is a really bad idea, and I am now out 500.00 to prove it.I am not entirely sure how this is even legal,but somehow they manage it. do not do business with Texas Direct Auto!!!!

deposit not a scam

I have bought alot of vechiles from here and at bottom of each listing if you read the print it states deposits are non refundable and the terms listed. That dealer has takin many deposits from me and it holds the vechile for 9 days till you can get all funds takin care of. great dealer if i must say so. Great to business with and want to do much more.

I couldn't tell from your post if you signed a contract for a vehicle or if they had taken your deposit over the phone without any paperwork. Did you ever go to the dealership and pick out a vehicle? Or was this all done over the phone?

If you signed a contract for a specific vehicle, look at the terms to see what happens to the deposit if the transaction is cancelled, terminated or otherwise not completed.

If you didn't sign a contract, then by all means send them a letter demanding the return of your deposit immediately. If they won't return the deposit, bring them to small claims court. You can do this without an attorney.

Deposits serve a purpose

Agreeing to purchase a vehicle without negotiating and sight unseen is foolish.

The purpose of the deposit was so that the seller would take the car off the market and hold it for you. They lost the opportunity to show the car to potential buyers. The deposit should be considered nonrefundable because of the possibility that they lost a sale. A deposit would serve no purpose if it was refundable.
