I was trying to setup a payment processing solution with Finical that is called Shift Credit Card Processing. I had submitted two online call requests last month (April 2021) to which they didn't respond. So I called them on 4/21 & Darius Nasseh answered the phone who sent over a merchant account agreement which I filled out & signed. After that I got an auto reply wanting: a copy of my business voided check (didn't have any), a Copy of my ID (I sent). On 4/23 I got alerts from both Experien/Discover Credit Scorecard that my credit was run. I found they put a hard credit inquiry without my permission. At no point did ANYONE tell me that my credit would be checked! Had I known I wouldn't have tried to set this up in the 1st place!

I talked to Darius numerous times on the phone/ via text after that. He said they couldn't take back the inquiry but assured me my account would be approved soon. He made this promise 3 times that I should hear something by the end of the day which was a COMPLETE LIE – there was NO email communication from anybody else besides him and nothing further was sent from him those days we talked on the phone. On April 26 I had him send me an email to provide my business information via the MOTO form which I sent back that same day. In that email it also said to please provide Marketing material and to confirm home/business address because the driver’s license and application had a different address – the credit report didn’t match to the application.

April 28th I asked him in an email: Why did u tell me on 3 different occasions that I would have the login by the end of the night yet I don't? What is really going on?

He said that same day: “Hi Scotty,

Underwriting has certain guidelines to follow and after each piece of information we sent them something else came up. I apologize for any inconvenience this may have crossed all we need is that utility bill proof of address and you are good to go.”

So later that same day I sent him the cable bill which was in my friend’s name as I didn’t pay the utility bills for my house. Since that didn’t contain my name I also sent him a copy of the my credit union statement with my address showing on it as well, explaining this to him too.

On April 29th at 3:11 pm CST I sent him a text asking “Everything all set with the login?” He said “Can you put together something for marketing material just a flyer or something? They need to validate the business and know how you are getting customers”

Tomm. I did just that and sent him a flyer that I created. I messaged him twice later that day if the login was approved now but he did not bother to respond. So on May 3rd I sent Darius an email saying: “I still have no login link. What’s the holdup?” He didn’t reply so I forwarded the email the next day to him to which he simply replied at 10:27 am May 4th in 7 words saying: “Hi Scott, Sorry your account was declined.”

I tried calling him both on his cell and work number about it but he didn’t answer or return my call. Nothing on the website of www.shiftprocessing.com indicates that a credit report would be pulled with doing a hard inquiry. That is not right and this needs to be presented. I did not like getting the run around from this guy saying things like “don’t worry you should have a login at the end of the day” over and over again! Please see attached e-mails from him to prove my points.

I talked with the company and resolved these issues to the best of my ability. It was determined that I had not read the fine print of Section 9 and 10 of the account agreement about the credit being pulled, thus I jumped the gun of posting things I shouldn't have posted. It would have however, been more beneficial to me if there had been a clearer way that the credit file would have been pulled perhaps in bigger text or other notations on the website or by the salesperson himself but I spoke with the president of Shift and he offered to train his staff to notify new applicants from that point on about the credit being run. I hereby request the report be taken down or at least changed so there are no false, libelous statements being made here. Thank you.

I found they put a hard credit inquiry without my permission

That is an incorrect statement.  When you signed the Merchant Agreement, that contained terms that you were giving them permission to access your credit history.  Yes, all of that "fine print" really does matter.  Why exactly do you think you were giving them all of your personal information?  Did you figure that they wouldn't try to verify it in some way?

At no point did ANYONE tell me that my credit would be checked! Had I known I wouldn't have tried to set this up in the 1st place!
- You mean other than the Merchant agreement you signed? As for not setting it up in the first place. I don't think there is one "mainstream" merchant processor that wouldn't run your personal credit in order to set up an account. I am sure there are some out there, but these are also ones that are going to charge you an arm and a leg in fees.

So later that same day I sent him the cable bill which was in my friend’s name as I didn’t pay the utility bills for my house
- That statement right there would be a huge red flag for any company in many aspects.  First, why would you not be paying your utility bills, but more importantly you have no proof that you actually have a residence there.  They didn't want a Credit Union Statement...they wanted a Utility bill.

While you are probably legitimate, it seems as if you have enough "red flags" that would cause most companies dealing in financials to have concerns.  As you don't have any business checks, your address doesn't match and you have no utility bills, you seem very concerned about them running your personal credit, and had to create some business flyers instead of having something already done.
