The Risk and Operations Manager for Silver Creek Management Inc. has been named in a $750,000 lawsuit for alleged Harassment, Destruction of Property, Conspiracy to Molest, and Making False Claims to the Toronto Police.

A Statement of Claim filed at the Superior Court of Justice of Ontario in May 2019 names the middle-aged couple Jonathan Morwick and his wife Susan Oliver who currently reside in Leaside, Toronto.

It seems that a neighbour dispute over common issues that arise from living next to long term construction escalated quickly and took a dark turn perpetrated by Morwick and Oliver.





The Plaintiffs are a married couple with two toddlers and share a Mutual Driveway with the Morwicks. They claim that in November 2016 they were told by the Morwick’s that the construction of adding a large addition to their home would start the next day; and that their construction crew would need access to their Mutual Driveway as well as removing the Property Line Fence for a period of 4 months.  Although somewhat distraught by the short notice, the Plaintiffs agreed to accommodate the construction as long as it would not disrupt the access and enjoyment of their property. During the majority of the construction period, the Morwick family was living offsite.

The Claim states that the Construction took 2 years – not the 4 months the Plaintiff’s were told. For 2 years the Morwick’s construction crew would block access to their backyard for days at a time, illegally and repeatedly trespassed on their property and removed or dismantled fixtures at leisure, stored large constructions vehicles in the backyard, and left dangerous materials such as exposed nails and sharp stones on their property where in one incident injured their 18-month year old son.

After their child sustained injuries, in June 2018 the Plaintiffs contacted the City of Toronto to complain about the construction and how it was endangering their family and preventing them from utilizing their backyard.  City Inspectors visited the construction site and reprimanded the Morwicks for not following the safety and construction standards outlined in their permits.

The Plaintiffs attest that in retaliation to his complaint to the city, Morwick and Oliver began a year long vindictive campaign of harassment, intimidation, vandalism, and conspiring with their friends who lived on the same street in attempts to have the Plaintiff falsely arrested.

The Claim states that the Morwicks repeatedly vandalize the Plaintiff’s two vehicles by keying them or slashing their tires weekly; they called Parking Authority to have their cars ticketed daily, secretly videotaped the Plaintiff’s and sent edited videos to the Toronto Police claiming that they were being  harassed and intimidated, as well as conspiring with their friends who lived on the street to call the Police with fabricated stories to validate the Morwick Claims.

A Toronto Police Report filed by the Investigating Officer on November 15th, 2018 seems to validate the Plaintiff’s claims in the Lawsuit. The report states that a there was a series of phone calls, emails, and packages sent to the Police about parking issues and harassment claims made by Morwick and Oliver against the Plaintiff, all of which were deemed unfounded by the Investigating Officer. 

According to the Officer, Morwick mailed over a dozen video sticks to the Toronto Police that were edited to present the Plaintiff as an aggressor, however, the Officer determined the videos clearly showed that there was no harassment being perpetuated by the Plaintiff’s and deemed all the accusations by Morwick and Oliver to be unfounded and fictitious. 

Rather, and he concluded that Morwick and Oliver were “trying to bait” the Plaintiff into a confrontation to look like an aggressor.

The Police Report states that there were incidents where Morwick and Oliver would leave dangerous construction materials on the Plaintiff’s property even after being told not to do so, and then when he confronted them in frustration, they would secretly video tape the incident.  Morwick and Oliver would then edit the video and send it to the Police claiming that they were being harassed in hopes to have the Plaintiff arrested and charged with Criminal Harassment.

The Police Report further says that on September 24th, 2018 the Plaintiff’s two cars were viciously vandalized overnight and incurred over $13,000 in damages.  The cars were parked on two different streets and no other cars were damaged. One of the cars which was just purchased had every panel keyed and scratched multiple times. 

The Police Report declares that Jonathan Morwick was the obvious suspect and they believed the cars were vandalized in reprisal to the Plaintiff calling in a noise complaint on an outdoor party that the Morwicks were having that same night.  The Party ran pass midnight and the excessive noise continually woke the Plaintiff’s two toddlers. Even though the Police believed that Jonathan Morwick was the culprit for vandalism, the lack of evidence and grainy surveillance video prevented the Police from charging him.

The vandalism to the Plaintiff’s two cars did not end that night.  For the following 8 months, the Plaintiff’s cars keyed and their tires punctured with nails every few weeks. 

Interestingly, this is not the first time Jonathan Morwick had been accused of the criminal acts listed in the Lawsuit.

Morwick has a Criminal history of attacking adjacent neighbours and damaging their property.

In 2016, Jonathan Morwick was arrested and charged with Criminal Assault for attacking his former neighbour when taking his garbage bin to the curb.  The Victim says in a statement provided to the Police that Morwick ran out of his home and attacked him by punching him repeatedly and screaming “Stop moving my garbage bins! I’m going to kill you”.  The Victim says that Morwick was very intoxicated and only stopped the attack to run into his home when the Victim’s wife came to assist and screamed that she called the Police. 

Morwick was also criminally charged by the Police that same year on two accounts Criminal Mischief by different neighbours.  Morwick was arrested for vandalizing a neighbour’s vehicle and destruction of another neighbour’s property.  The Crown issued two Peace Bonds against Morwick and in a Plea Bargain dropped the Criminal charges on the condition that Morwick attended Anger Management Counselling for a year.

According to the most recent lawsuit, Jonathan and Susan also recruited their teenage daughter to conspire against the Plaintiff in order to have him falsely arrested.

On November of 2018, Oliver and Morwick filed two separate complaints on the same day to the Toronto Police claiming the Plaintiff was scaring and harassing their teenage daughter while she sat on her porch.  They told the Officer that the Plaintiff returned from work one night and stood in the rain without an umbrella and stared at their daughter with a menacing look for over 5 minutes. 

The Police determined that the allegations made by Morwick and Oliver to be fictitious after the Plaintiff provided surveillance video from that night clearly showing that the events they described never transpired.

The Plaintiff’s are suing for aggravated, exemplary and punitive damages. They state they have suffered profound shock and psychological trauma.  One of the Plantiff’s was terrified to leave her home with her young children, especially after she learned that Morwick was previously charged with assaulting a prior tenant.  The other Plaintiff who is a Licenced Financial Professional claims he would have lost his job and and his ability to provide for his family if falsely arrested on any of the fictitious claims made by the Morwick family and their conspirators. 

These allegations made against Jonathan Morwick could be a very serious concern for Silver Creek Management Inc. The Canadian Hedge Fund is heavily regulated by Federal and Provincial Bodies who take claims of lying to Police very seriously. The allegations would also be worrisome to Hedge Fund’s Investors.  The Portfolio Management for all Silver Creek funds are controlled by Louise Morwick, Jonathan’s sister.

Susan Oliver serves as Senior Vice President of Human Resources for the marketing firm Environics Analytics.  Oliver also served as Chair of the Ethics and Privacy Committee of the Canadian Marketing Association between 2011 to 2014.

Phone messages left for Morwick and Oliver were not returned. Their Lawyers have filed a notice of intent to defend against the lawsuit, but they have not filed their Statement of Defense since the Claim was served three months ago.

Victims win Judgement Against SilverCreek Management Inc. Operations Manager Jonathan Morwick for Harassment, Destruction of Property, Conspiracy to Molest, and for Filing False Reports to the Toronto

Sources reveal that after 6-months from being served the Statement of Claim in May 2019, Lawyers representing Jonathan Morwick failed to file a Statement of Defense and were NOTED IN DEFAULT; and subsequently the Plaintiffs were awarded DEFAULT JUDGEMENT. Under Ontario Law, Defendants have 20 days from the date they were served a Statement of Claim to file a Defence. 

Sources say that the Lawyers representing Morwick were trying to stall the legal proceedings and avoid filing a Defence because the evidence supporting the claims against their client were verifiable and supported by the Toronto Police.  If the claims against Morwick were frivolous, his Lawyers would have immediately have filed their Defence within the required 20 days, instead of delaying court proceedings by six months.

The Default Judgement awarded against Jonathan Morwick may have very serious consequences for SilverCreek Management Inc which operates as a Canadian Hedge Fund.

Financial Regulators such as the Ontario Securities Commission will may have issue with Morwick managing the Risk and Operations of SilverCreek’s Hedge Fund after being found guilty of Harassment, Destruction of Property, Conspiracy to Molest, and for Filing False Reports to the Toronto Police. 

Jonathan Morwick is the brother of SilverCreek’s Portfolio Manager, Louise Morwick.

Our family was also victimized by Jonathan Morwick and Susan Oliver when we lived on the same street with them a few years ago.  We once got into an argument with Jonathan about a parking issue, and from that day our car was consistently vandalized overnight for a year no matter which street we parked on near our home.  Our car was keyed or its tires slashed with nails over 20 times in a year and we incurred over $15,000 in damages.

Through the Public Information Act of Toronto, we have obtained the the Toronto Police Report that validates the claims made in the the Ripoff Report uploaded in August 2019 against Jonathan Morwick and Susan Oliver.

We are uploading the Toronto Police Report and have blocked out the names of the victims and the addresses for their protection.

We have also obtained the Statement of Claim Filed against the Morwick Family and will be uploading it to Ripoff Report shortly.

These Monsters must be stopped.
