A & S Collision Repair Center Abel Hernandez - Hernandez Customs -Took a deposit and never performed any services- Ogden, Utah

On 14 Febuary 2011, I took my son's car to A&S Collision and Repair to have autobody work and repainted.  Abel Hernandez Jr. stated it would take approximately 1 1/2 to 2 weeks.  After 1 week I started to visit the shop to check on the progress and found that 90%  of the time the building was locked up.  I would attempt to contact Mr. Hernandez on the phone and would only answer 1 out of every 13-15 calls.  When I would reach him he would claim that he's at an auction but when he's finished he would get right on it as soon as he got back from the auction. 

My son's car sat outside of the repair shop from 14 Febuary 2011 until 2 April 2011.  I visited the shop 3-4 times a week on average during normal business hours of 8a.m. to 5p.m. and on 2 April 2011 was the first time I was able to see him at the shop.  He said he was sorry and would get right on it and moved the car into the shop.  I continued to visit the shop 3-4 times a week and each time the doors were locked and would not get a response by phone.  On 3 May I sat outside the shop from 830a.m. until 11 a.m. waiting on someone to show up. 

I attempted to contact Mr Hernandez by phone with no response.  I could hear somone was in the shop but no one would answer the door.  On 4 May I returned at 0830 and waited outside again.  At approximately 930a.m. I received a phone call from Mr Hernandez asking if I was sitting outside the shop, I said yes and he said he was at an auction and wouldn't be at the shop all day.  I said o.k. and continued sitting outside the shop and approximatly 1030 he called again and asked if I was outside the shop and I responded yes, again he responded he was at an auction and would not be at the shop. 

At approximatly 1200 another customer showed up and called Mr Hernandez and he then came to the door and opened and appologized to me saying he was very busy and that's why he wouldn't open the door for me.  At that time I asked him to take my son's car out and refund my deposit. He said he would finish the car by Friday.  We went to the shop on Saturday and they were cleaning out the shop and he was no were to be found would not return any calls and had vanished. 

Government Actions

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.On May 3, 2011 the Utah Division of Consumer Protection issued a Final Order by Default against A & S Collision Repair Center, Abel Hernandez and Noemi Pena ("Respondents"). The Respondents were assessed and ordered to pay an administrative fine of $5,000 and ordered to cease and desist from: a) failing to ship goods or furnish services within the time advertised or otherwise represented after receiving payment; and b) failing to make refunds within thirty (30) days of receiving a valid request for refund from a consumer.

Under this report it shows it never went through becuase they could not find him to serve and the business was closed.  He's been doing this for years in Arizona and now in Utah.

There a many other folks that have been ripped off by this guy and have not done anything, just went with the loss. Stop Able S Hernandez, Jr from ever having another business....
