I own a 1995 Dodge Avenger and the transmission recently went into fail safe mode in the summer of 2002(torque converter died and blew chunks of metal throughout the transmission). Received a quote from Aamco Transmissions for $2200 to rebuild the transmission and replace driver's side axle which was cracked. Transmission took 2 weeks to rebuild and I purchased a lifetime warranty with the transmission rebuild. After I received the car it would not shift out of 2nd gear after supposedly being rebuilt.

Took it back to the garage and after a few days of "diagnostics" it was determined that a faulty wire was shorting out the solenoid pack. This was covered by my warranty and the manager Doug Robinson tried to scam me and say that I was going to be charged for it. After some argument he finally said it was covered by warranty.

After the "faulty wire" was replaced, one of the mechanics parked my car too close to the parking space concrete blocks and consequently caused my front bumper to tear when I put the car in reverse from hanging over that slab of concrete. After much argument again the manager Doug Robinson finally agreed to pay for the damages from his incompetent employees.

After 2 months of having the car and running good, I took it to my local mechanic to adjust the front and rear brakes and a major problem was discovered... The front driver side axle was never rplaced contrary to the receipt I received from Aamco Transmissions which stated they had replaced the part and I had paid for this part + labor. After some argument with the managaer it was determined that it was not replaced ever and I was given an excuse for their continued incompetence, but they replaced it.

This past December 2002, I felt the car shuddering a lot when I accelerated and assumed it was the transmission so I took it to Aamco Transmissions again to have it checked out. They stated that all the engine mounts and the transmission mount were cracked and were causing the shuddering. They tried to imply that I had had an accident and caused everything to break which was not the case. After much heated argument they gave me an excuse saying that they couldn't understand their non-english speaking mechanics, but finally received a good translation from them which stated that it was notcaused by an accident, but rather old age. The manager also stated that the engine mounts were not covered by warranty, but the transmission mount was. I told them to replace transmission mount and I would have my mechanic replace the rest. They acknowldeged that and said the part would be shipped in 2 days. It took 3 weeks of calling every 2 days to check on the status of the part and receiving excuses every time and being told to call back in 2 more days. Finally after 3 weeks of this I showed up at the garage and stated my frustration with them and was told the part would be arriving in 2 days to just bring the car by that day and drop it off. I dropped it off that day and was told it would be repaired same day. Called the garage that afternoon and was told part was arriving at 4:30pm to just leave the car overnight and call tomorrow afternoon and it would be ready. So I called next afternoon and was told part was still not in (more run arounds). Had a heated argument which turned into insults for having me wait almost 30 days without a car plus all the other mishaps/attempted deceptions from the past. I informed them I was going to pick up car and have my mechanic repair the warranty item and bill them for the part + labor. They refused and I told them I would be filing a legal claim shortly agaisnt them. So I had my mechanic repair everything and Aamco Transmissions refuses to reimburse me for the warranty item which they did not replace in a legally reasonable amount of time, which is considered a breach of contract + their repeated deceptions... I would like some sort of counsel on what I should do next. I am considering filing a lawsuit in small claims court, but I would like to avoid court because of costs. please respond asap thank you.
