Upon being laid off from my job of 24 years, I am now self-employed and too young to retire.

I applied for individual health coverage for my husband and myself and was denied based only on pre-existing medical conditions- All of which were covered under my employers Group Health Plan. I have the HIPAA certificate from employer to prove it. This certificate was provided to me specifically to prevent this type of discrimination.

I choose AETNA AARP Health Plans as I felt that due to our ages of 49 & 59 we would not have any trouble getting insurance with them. Most retired people have some pre-existing conditions and since they are the AARP sponsored program they would be more favorable to our situation

Was I wrong - they denied us solely on the pre-existing medical issues. They did not ask to see my certificate and I did indicate the reason was due to layoff and lose of employer provided insurance on the application

This is direct violation of Federal HIPAA laws in regards to pre-existing conditions previously covered under employer Group health plans.

I have filed formal appeals with AETNA both by fax and certified mail. I have filed formal complaints with the Health and Human Services Offices in Washington, DC. They have an e-form and I was able to attach all the supporting documentation to them as well.

I have also sent AARP an email informing them of the HIPAA Violation by Aetna. They need to be aware that the AETNA is discriminating against their members in violation of Federal HIPAA laws as my husband and I are both AARP members.

In the meantime I still have to locate some kind of insurance as I cannot allows coverage to lapse more than 63 days. Aetna left me hanging
