I get one to six phone calls per day to an unlisted telephone number that is on the National "do not call" list. I understand this company is a national debt collection agency; but I have NO past due debts nor have I had any for many years. They leave no messages, just call constantly. I see many complaints listed on this site and many others, and have noticed they've been filed against by several Atty Generals of various states, which make it more curious when I also found they are one of three "official" debt collectors for the City of Los Angeles (I live in Texas), but they appear to have branches nationwide.

Apparently, no one can stop their harassment of anyone they call (owe money or not). In my case, the harassment is simple the multiple phone calls. I did answer several times, but received a voice saying for me to "hold" and someone would talk to me shortly. I know better than to "hold" for this, but sure would like them to stop the phone calls.

I HAVE reported them for calling a "do not call" number, but, of course, all they have to do is claim they have a "business relationship" with me - which is the legal loophole for calling.

By the way, the number they call is simple a "distinctive ring" number I added about 4-5 months ago, and I have never given the number out to anyone. In fact, I had to look the number up on my bill just to report it, so I have no idea how they even got it. If I owed anyone, they would be calling my main, LISTED phone number that shows on my credit report.

DO NOT listen to Angel the debt collector!

AUTHOR: Steve - (U.S.A.)

POSTED: Wednesday, December 13, 2006

Regardless of what Angel the debt collector tells you, you NEVER answer a call or speak to any debt collector on the phone. There is no legal record of the call, and that is how the collectors like it.

Put EVERYTHING in writing by the means above. then when they violate your request, you put an easy $1000 in your pocket.

Debt collectors are so lazy and stupid, they expect you to do their jobs for them. Always make it as hard as you can on these morons. And, hold them accountable every chance you get.

Don't get mad, GET PAID!

Better suggestion

AUTHOR: Angel - (U.S.A.)

POSTED: Wednesday, December 13, 2006

Instead of going through the hassle of doing what Steve implies, heres a suggestion.

Collection agencies use different resources to collect contact information for the debtors they are trying to reach. Some times they come across people with the same name, or address, so they input any number that is a possible match to the person they are trying to reach. Whether its a relative number, or whatever the case may be.

My suggestion is to answer the call next time, see who it is they are looking for. Most of the time it will be a wrong number. If thats the case tell them its a wrong number and to remove it. There are times where we reach the person who we wanted to, only to find out that the account is fraud and the person had no idea.

Richard, it is very easy to stop these calls when done properly

AUTHOR: Steve - (U.S.A.)

POSTED: Thursday, December 07, 2006

Richard,

This is very simple to fix. And Don is right, debt collectors are not included in the provisions of the DO NOT CALL list. This list ONLY applies to TELEMARKETERS.

All you have to do is write one letter as per your rights under the FDCPA. It is called a CEASE COMMUNICATIONS request.

Send this by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important, as it proves WHAT you sent.

Now, when they call you again, you sue them for up to $1000 plus costs as provided for under the FDCPA.

Also go to ftc.gov and file a complaint, and go to whocalled.us to find out who the number belongs to, and file another complaint.

Send your letter to:

solution

Actually, collection agencies are not part of the Do not call list for the loophole you mentioned. And they can call constantly, until they make contact with you. IF you do not answer the phone and they don't leave a message, they have not made contact, and they can try back. Try answering the phone and waiting. You may find out that they are not looking for you (as the collector might find out too), and the calls might stop. You could also send a cease calls letter to them.
