So I get run over by an 85 y/o Allstate customer while on my motorcycle. I sustained damage to the MC, to my body and to my possessions. The total of my personal losses (not the bike damage) was around $800 (including a broken Iphone 5, scratched helmet, torn leather jacket, scuffed-up bags, etc). An appraiser was sent to my house, fully a month after the accident, and he took pictures of the items and documented them. After receiving no check from Allstate for a couple more weeks, I called the adjuster and she told me I'd have to box all the items up and send them to Allstate for salvage. Well, guess what, I didn't keep all that crap after the appreaiser came and I had my phone replaced under my Squaretrade warranty for which I had paid the premiums and the deductible. I'm going to take them to small claims court. Allstate is simply the worst. I'm going to ask for treble damages for the aggravation I have suffered. If that fails, I'll take the driver to court, though I really don't want to do that to the old lady, By the way, she was in another accident 3 days after she hit me. I wasn't asking for the full value of the phone, just the $90 Squaretrade premium and the $50 deductible. Thoughts?

You may not get all you want

My HD jacket alone cost me $490.00. I bet if I walked into the Allstate office and smashed one of their computers with a hammer, they'd expect me to pay them the full price of the computer, not just their deductible for getting it fixed !!!

 

Your analogy with a computer is different because smashing a computer with a hammer would guarantee that the computer will no longer functioning (no way to get a couple scratches on it and electronic stuff would stop working with hard impact). You may win the case in a small claim court but you may not expect to get all the money you want. You are likely to get a partial award as long as you did not sign a release as Robert mention. If you signed it, you are very likely to waste your time and money on suing regardless who you are suing (the owner of the car would still be protected by the insurance company document).

Squaretrade sent me a reconditioned phone. Mine was a brand new Iphone 5 with prob 4-5 hours on it. I don't know many folks who would trade a brand new Iphone for a recon and be happy about it. If there are such people, I'll trade recons for their new phones anytime.

 But all they asked from you was to send in the damaged helmet jacket and phone then they would pay you. YOU didnt keep those items. You should have until this situation had been resolved. Allstate HAS to follow policies. One of those policies was that you had to send in the claimed items. SO how is this a ripoff?? It sounds like youre ripping yourself off. If they are fixing your bike, and they sent an appraser out, then they are doing their part to help make the situation right for you. You can try and take the little old lady to court, but once the judge finds out that your sueing because YOU DIDNT SEND THE DAMAGED ITEMS TO THE INSURANCE COMPANY PER THEIR REQUEST, the judge is going to apoligize to the Lady and probably give you a stern lecture on your responsabilities.

Take what you can get, but dont expect extras especially when you are fighting them on it. Write off the damaged items and feel lucky you lived.

Well, I fixed my phone for $50 but that's because I carry an insurance policy on which I pay the premiums, not Allstate. Why should I have to use my insurance? They have paid me nothing yet for medical, they have paid pretty fairly for MC repairs, but understand they do that for their protection. If they scrimp on such things and later you suffer a serious injury from a bent wheel or weakened frame, they would really get socked. They don't fix your MC because they're trying to be nice, they're trying to cover their butts. If they wanted all my stuff I would have been happy to send it to them, but why have an appraiser come and take pictures of everything. I'm only wanting $800, no $8000. I bet if I walked into the Allstate office and smashed one of their computers with a hammer, they'd expect me to pay them the full price of the computer, not just their deductible for getting it fixed !!!

 You apparently are leaving out a lot of details in this "RipOff".

After all you say that you were run over and had damage to your MC, and your body as well(which is good that it appears you have recovered).  Yet the only dispute is over this $800 in property.  So did they cover your MC and medical bills?  If so..then not saying you aren't owed for your property you can hardly call this a "RipOff"..just a point on putting this in perspective.

In any accident a helmet should be automatically replaced(IMO) and has zero "salvage value" so you should(Again IMO) get money for the replacement of that without having to send it back.  As for your phone..yes only asking for the cost and deductable is fair and reasonable.  But what is a little confusing is that you only talk about having your phone replaced.    The rest of your items, it all comes down to what they were and actually how damaged they were.  That is did you have just one or two scratch on these bags or were they ripped beyond repair.  You may want to ask them what the difference would be if they deduct this "salvage" value from your claims.  If it is like $50 you may just want to take it to get this behind you.

Of course if all else fails, then yes unfortunatly you may have to take her to court.  The only thing you need to watch out for is if they have already paid you some money that you didn't sign anything that says that you now release them from any future claims.  As if you did..they will use that saying that they no longer owe you anything.

Now, I am not a lawyer and nothing here should be taken as legal advice, just giving you a different perspective.
